BE IT RESOLVED by the City Council of the city of Seal Beach: Section 1. It is found and determined that the public interest and necessity require the acquisition of an estate in fee simple in and to the real property hereinafter described for the construction, use, and maintenance of a public park and other related public uses. Section 2. Section 3. It is found and determined that said public improvement and works are planned and located in the manner which is and will be most compatible with the greatest public good and the least private injury. section 4. The City Attorney of the City of Seal Beach is authorized and directed to (1) commence an action or actions in eminent domain in the name of the City of Seal Beach in the proper court to acquire, in fee simple, said property described herein7 (2) except and reserve from the taking such noninterfering rights to the owners as will not substantially impair the use of said lands for the construction, use, and maintenance of said improvement7 and (3) do such further acts and things and take such further steps as may be necessary or convenient in connection therewith. ':' ',~, . _. ;", ".,111I" , I July 15, 1970 Honorable Mayor and City Council City of Seal Beach Seal Beach, California Subject: Request for Approval to Initiate Proceedings to Acquire Certain Lands Commonly Referred to as the Gum Grove or Bullet Hill to be Used for Public Park and Recreation Purposes. Gentlemen: You will recall that the approved 1970-71 General Fund budget contains an allowance of $190,000 for the acquisition of 10.5t acres of hill side property north of Marina Hill, said property commonly referred to as Bullet Hill or the Gum Grove. Attached is a map and legal description of the subject property. The property is owned by the Hellman Heirs. One appraisal has previously been secured on the subject property. You will recall that proposition G on the June 2, 1970 City wide ballot stated in part "Shall the City Council, on a pay-as-you-go basis, utilize recurring revenues currently available, commence a park acquisition and development program including (1) leasing or acquiring a 10.5t acre site immediately north of the Marina Hill section of the City_n." This proposition was approved by the elec- torate 6,552 to 2,674. The proposed site had previously been approved by your Ad Hoc Park Committee for acquisition or leasing. It is recommended in view of the budgetary allocation and the time element that may be necessary because of eminent domain proceedings which will be necessary that your Honorable Body authorize the following actions: 1. The City Manager and City Attorney to secure the services and opinion of a second appraiser if such is deemed necessary, said expense not to exceed $3,000. 2. The City Manager and City Attorney to secure a title report including sufficient insured information for eminent domain proceedings. 3.
