HomeMy WebLinkAboutCC Res 1892 1970-09-21 I I I . . , RESOLUTION NUMBER .1(9 r A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, EVIDENCING POSITIVE INTEREST IN SECURING NATIONAL FLOOD INSURANCE. WHEREAS, certain areas of the City of Seal Beach are subject to periodic flooding from the Pacific Ocean, causing serious damage to residential properties within these areaS7 and WHEREAS, Relief is available in the form of Flood Insurance as authorized by the National Flood Insurance Act of 1968 as amended 7 and WHEREAS, It is the intent of this Council to comply with land use and management criteria regulations as required in said Act7 and WHEREAS, It is also the intent of this Council to recognize and duly evaluate flood hazards in all official actions relating to land use in the flood plain areas having special flood hazards7 and WHEREAS, Title 7, Chapters 1 through 5 inclusive, The Conservation and Planning Law of the Government Code of the State of California, does enable local governments to adopt land use and control measures 7 and WHEREAS, This City has authority in accordance with Ordinance Number 596, The Municipal Code of the City of Seal Beach, to adopt land use and control measureS7 NOW, THEREFORE, BE IT RESOLVED, that the city Council of the City of Seal Beach, California, hereby assures the Federal Insurance Administration that it will take legislative action as follows: Section 1. Enact by December 31, 1971, and maintain in force for those areas, adequate land use and control measures with effective enforcement provisions consistent with the criteria set forth in Subpart B of Section 19l0 of the National Flood Insurance Regulations: section 2. If necessary, seek state enabling legislation conferring authority to enact land use and control measures designed to reduce the exposure of property to flood 10SS7 and take such other offi- cial action as may be reasonably necessary to carry out the objectives of the program. Such actions will include but not be limited to: (1) Assisting the Federal Insurance Administrator, at his request, in delineating the limits of the flood plain having special flood hazard on available local maps of sufficient scale to identify the location of building sites. I I I Resolution Number (2) After flood insurance is made available, furnishing representatives of appropriate federal or state agencies, or of the National Flood Insurance Association, information, as requested, concerning new or substantially improved structures within the area of special flood hazard. This information will include flood elevations and, if there is a basement, the distance between the first floor and the bottom of the rowest opening where water flowing on the ground will enter. (3) Cooperating with federal, state, and local agencies which undertake to study, survey, map, and identify flood-prone areas as well as cooperation with neighboring jurisdictions with respect to adjoining flood plains in order to prevent aggravation of the flooding problem. BE IT FURTHER RESOLVED that the City Council of the City of Seal Beach hereby appoints the city Manager to assume the respon- sibility and authorizes him to implement the commitment made herein. In December 1969, Congress amended the National Flood Insurance Act to authorize an emergency two year program. The new program allows a community to obtain subsidized coverage prior to the completion of its individual rate-making study. In order to secure such coverage, the City must submit an Expression of Interest including various maps of flood prone areas, and a Corps of Eng1l1eers outline of flood history and the attached Assurances of Future Compliance. With reference to the required criteria that must be adopted by December 31, 1971, hopefully, within two years the City will have adopted a comprehensive program of sand replenishment. In this regard, the basic requirement "(H) for coastal areas, necessity of establishing programs for building bulkheads, seawalls, breakwater and other damage abatement structures, and for preserving natural barriers to flooding" will have been met.
