RESOLUTION NUMBER ~~~~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AFFIRMING PLANNING COMMISSION RESOLUTION 511 AND DENYING THE APPEAL OF PETER J. TRAMA FROM PLANNING COMMISSION DENIAL OF UV-1-71 TO PERMIT A RESTAURANT WITH COCKTAIL LOUNGE IN THE C-1 SERVICE COMMERCIAL ZONE. WHEREAS, in the matter of Use Variance Application No: UV-1-71, the Planning Commission of the City of Seal Beach, after conducting a public hearing thereon on January 6, 1971, did report and find as follows: 1. Subject application was initiated by Peter Trama, 1017 Pacific Coast Highway, the authorized agent for Seal Beach Center, a limited partnership. 2. Subject property is located in the Seal Beach Center at 1017 Pacific Coast Highway. 3. Subject proposes operation of a restaurant with cocktail lounge in t~e C-1, Service Commercial, Zone. 4. Prior Planning Commission Use Variance No. UV-11-69 permitting the same applicant to operate a restaurant with cocktail ,lounge and entertainment upon the same premises in a C-1, Service Commercial, Zone was granted for a period of one year and expired on December 16, 1970. , 5. Since expiration of Use Variance UV-11-69, Resolution No. 3B2, the operator has continued to sell liquor without proper municipal approval. 6. The entertainment permit business license for the establishment was revoked early in December, 1970, by the Interim City Manager for failure to comply with State and Municipal regulations, and no appeal has been taken by the former licensee therefrom. 7. The County Health Department had revoked the applicant's Health Permit for violations of County standards. 8. All provisions of the previous year's approval designed to insure that the operation was conducted primarily as a restaurant and not as a bar were violated. WHEREAS, the Planning Commission of the City of Seal Beach on January 6, 1971, did deny Use Variance Application No. UV-1-71; WHEREAS, the matter of the appeal of applicant Peter J. Trama from the Planning Commission denial of Use Variance Application No. UV-1-71 came on regularly for public hearing b~fore the City Council at its regular meeting held on February 16, 1971, and a public hearing thereon being held thereat by the City Council, and no appearance having been made by or on behalf of appellant Peter J. Trama, and evidence having been offered by the Planning Department and the Police Depart- ment of the City of Seal Beach, and said public hearing having been duly and lawfully concluded and closed; AGENDA ITEM VII C ~I I I ... .'... Resolution Number ,.. ~' ,i" ~ NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Seal Beach as follows: (1) All notices required by law and by ordinance of the appeal and public hearing by the City Council upon this matter have been given, posted and mailed as required by law, and (2) Each finding heretofore made by the Planning Commission is true and each such finding was and is supported by substantial evidence. (3) The appeal of Peter J. Trama from the Seal Beach Planning Commission Resolution No. 511 is denied, and the action of the Seal Beach Planning Commission adopting its Resolution No. 511 is affirmed.
