RESOLUTION NUMBER ~ A RESOWTlal OF THE CITY COUNCIL OF TilE CITY OF SEAL BEACH DENYING TilE APPEAL (A-2-71) OF HARRY AND SARA MILLEDGE FROM PLANNING COMMISSION DENIAL OF V-4-7l TO PERMIT A STORAGE BUILDING TO BE LOCATED IN THE SIDEYARD OF A SINGLE FAMILY RESIDENCE. WHEREAS, in the matter of Variance Application No. V-4-7l, the Planning Commission of the City of Seal Beach, after conducting a public hearing thereon March 17, 1971, did report and find as follows: 1. Subject case was initiated by Harry & Sara Milledge, 4724 Dogwood Ave., Seal Beach. 2. Legal description of subject property is Lot 153, Tract 6173, and is more . commonly known as 4724 Dogwood Avenue. 3. Subject request is to permit an existing 7' x 12' wood frame storage building to encroach 4' into a 5' sideyard setback, leaving 2'10" between the main dwelling unit and the accessory building in lieu of the required 6 feet. 4. The intrusion of the motorcycle storage building into the sideyard could impair the movement of emergency equipment to the rear of the property and constitute a fire hazard. 5. The location of the accessory building and the marginal distance between it and the main structure combine to substantially restrict light and ventilation to at least one bedroom and possibly two. 6. Approval of the proposal could establish an undesirable precedent within the community. 7. The applicant indicated that he was not aware that the location of the storage building constituted a violation of municipal regulations until he was contacted by the City's Building Department. 8. A letter signed by six neighboring property owners was submitted indicating their approval of the request. No protests were received. WHEREAS, the Planning Commission of the City of Seal Beach did, on March 17, 1971, deny Variance Application No. V-4-7l; and W1UKREAS, the applicants; Harry & Sara Milledge, appealed the Planning Commission denial of Variance Application No. V-4-7l to the City Council; and WHEREAS, at a regularly scheduled meeting held on April 19, 1971, the City Council held and lawfully concluded and closed a public hearing on Appeal No. A-2-7l by Mr. and Mrs. H. Milledge from the Planning Commission denial. NOW, THEREFO~E, BE IT RESOLVED by the City Council of the City of Seal Beach' as follows: , (1) All notices required by law and by ordinance of the appeal and public hearing by the City Council upon this matter have been given, posted and mailed as required by law, and , ( AGENDA ITEM # IX E .... , I . ~1('cuJ/;.
