" ORIGINAL OI=FICIAL COpy NOT TO BE rAJ<:EN FROM THE CITY CLERK'S OFFICE ORDINANCE NO. .Jlf r AN ORDINANCE OF THE CITY OF SEAL BEACH PRESCRIBING CERTAIN REQUIREMENTS FOR COLLECTION OF RUBBISH AND GARBAGE. The City Council of Seal Beach does ordain as follows: SECTION 1: The term "rubbish" shall mean and include: Leaves. shrub trimmings, small tree branches not to exceed two (2) inches in diameter and four (4) feet in length, excelsior, wooden ware, printed matter, paper, pasteboard, paper containers, lawn clippings, rags, straw, discarded clothing, crockery, bottles. tin ISns, metal vessels. and all waste material of every character accumulated within the City except garbage, swill, manure or sewage waste, automobile bodies. earth, turf, sod. sand clay, gravel, loam, stone, bricks, plaster, or other refuse from buUding construction or repair. or tree or shrub trimmings occasioned by the maintenance or construction of public utility lines or activities of City crews. Tree limbs. brush, and similar materials shall be cut to four (4) feet or less in length and securely tied with cQrd or wire. All floor sweepings shall be double-wrapped. 18 SECTION 2: The term "garbage" shall mean and include: Table refuse, 19 swilL, offal, and every accumulation of animal, vegetabLe, and other matter that attends preparation, consumption, decay, dealing in or storage of meats, 20 21 22 23 fish, fowl, fruits, and vegetables or other food and shall include all animal and vegetablE! refuse from kitchens and all household waste from or intended for use as food, and all vegetable trimmings from markets and stores. The following are specifically not included in the term "garbage": Organic residues resulting from commercial canning or processing of food products, dead animals, manure, sewage waste, waste paper, paper and other combustible materials (other than such wrapping for garbage as may be 24 25 26 27 28 required by the City), crockery, glass, cans, and other metallic objects, 29 ashes and sweepings. 30 SECTION 3: All rubbish and garbage shall be placed for collection in 31 adequate COl}~,ainers, each of which. together w:ith the contents thereof, shall 32 not exceed 65 pounds in weight and in no. event shall an empty container weigh III ..4 .,. 1 2 I 3 4 5 6 7 8 9 10 11 12 ~ 13 . o !c 14 p:; ~- III a~ 15 ~..~ .-~ ,J . SECTION 4: Containers provided for in this Ordinance shall be placed adjacent to the curb along the street in front of each residential or commercial occupancy, or if no curb, then adjacent to the main traveled portion of the street fronting the occupancy, or the alley in the rear of each such occupancy, except where alleys, having access to streets at each end, exist in the rear of commercial occupancies and from these latter occupancies placements shall be made in said alley. All containers shall be grouped together for each occupancy. The owner or tenant of a commercial occupancy may provide by mutual written agreement with the contractor for collection at a location other than as specified herein if such agreement is approved, including fees therefor, by the Director of Public Service. SECTION 5: The owner of every lot or parcel of property in the City of Seal Beach having erected thereon multi-family living units shall at all times furnish therewith one rubbish and one garbage container for each Living unit to and including four (4) living units and in every instance where there are more than four (4) living units so erected, such owner shall furnish one garbage container for each living unit and one rubbish container for each two (2) living units or fractions thereof. SECTION 6: Any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $100.00 or be confined in jail for not more than thirty (30) days or by both such fine and imprisonment. SECTION 8: The City Clerk shall certify to the passage and adoption of this Ordinance by the City Council and shall cause the same to be printed and published once in the "Seal Beach Post and Wave, " a newspaper of general circulation published and circulated in the City of Seal Beach, and shall post copies of this Ordinance in three (3) conspicuous places as provided for in the Government Code. PASSED, APPROVED AND ADOPTED by the City Council of the City of Seal Beach at a regular meeting thereof held on the 18th day of August, 1959.
