A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH, CALIFORNIA, ,A CHARTER CITY, ESTABLISH-
ING'HOURS AND LOCATIONS FOR SURFING PURSUANT TO
ORDINANCE NUMBER 624, AND RECINDING RESOLUTIONS
1286 and 1581 AND ANY OTHER RESOLUTIONS IN CON-
FLICT HEREWITH.
WHEREAS, Ordinance Number 624 provides that hours and locations for
surfing within the City of Seal Beach be established by resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIU OF THE CITY OF
SEAL BEACH:
Section 1. Winter Season. Paddleboard and surfboard surfing and the
use of bellyboards within the City of Seal Beach during the period 6f
October 1 to June 15, inclusive, shall be allowed in and restricted
to the follOWing areas and the following hours of the day and days of
the week:
(a) The area westerly of the prolongation of the centerline
of Second Street in the City of Seal Beach to the westerly
jetty of the San Gabriel River, paddleboard and surfboard
surfing and the use of bellyboards shall be permitted daily
from 7:00 a.m., o'clock, to 11:00 a.m., o'clock, and from
3:00 p.~., o'clock, to 6:00 p.m., o'clock.
(b) In the area westerly of the westerly line of the
Municipal Pier to the prolongation of the centerline of
Second Street in the City of Seal Beach, surfing and the
use of bellyboards shall be permitted on weekdays OKonday,
Tuesday, Wednesday, Thursday, and Friday) from 3:00 p.m.,
o'clock, to 6:00 p.m., o'clock, and on weekend days
{Saturday and Sunday only) from 7:00 a.m., o'clock, to
11:00 a.m., o'clock.
Section 2. Summer Season. paddleboard and surfboard surfing and the

use of bellyboards, within the City of Seal Beach, during the period
commencing June ,16 and ending Seppember 30, inclusive, shall be allowed
in and:.,restricted to the followi~g areas and following hours of the
day and days of the week:

(Summer Season)
(a) In the area westerly of the westerly line of the
Municipal Pier to the westerly jetty of the San Gabriel
River surfing and the use of bellyboards shall be per-
mitted daily from 7:00 a.m., o'clock, to 10:00 a.m.,
o'clock.
(b) In the area westerly of the east jetty of the
San Gabriel River to the westerly jetty of said river,
surfing and the use of bellyboards shall be permitted
daily from 6:00 p.m., o'clock to 8:00 p.m., o'clock.

Section 3. Life~uard Authority to Discontinue Surfing.
Notwithstanding any provisions of this resolution, if in the opinion
of the Senior 'Lifeguard on duty, the use of paddleboards, surfboards,
and/or bellyboards, and/or surfing during any period of time in which
surfing is permitted, would constitute a hazard to swimmers and/or
bathers, the Senior Lifeguard on duty shall order the discontinuance
of surfboards, paddleboards, and/or bellyboards for surfing purposes
in the area designated in Sections 1 and 2 of this resolution permitting
surfing, or any portion of said area, for so long as, in his opinion,
surfing and/or the use of surfboards, padd1eboards, and/or belly-
boards constitutes or may constitute a hazard to swimmers and or
bathers. In the event, the Senior Lifeguard shall order the dis-
continuance of surfing and/or the use of surfboards, paddleboards,
and/or bellyboards, he shall announce his order by use of the lifeguard
public address system or other similar means and the persons using
said aquatic equipment shall immediately remove said equipment from
the ocean waters.
Section 4. Definitions.
(a) Surfboard is defined as a piece of aquatic equipment,
equipped with a skeg, generally in excess of six (6) feet
'in length, which equipment is designed for or may be used
by one or more persons for surf and/or wave riding.
(b) Paddleboard is defined as a piece of aquatic equipment,
without a skeg, generally in excess of five (5) feet in
length which equipment is designed for or may be used by
one or more persons for surf riding or paddling.
(c) Bel1yboard is defined as a piece of aquatic equipment
with a skeg, under six (6) feet in length, which equipment
is designed for or may be used by a person for riding surf.
(d) Skimboard is defined as a piece of aquatic equipment,
without a skeg, which equipment is designed for, or may be
used by a person for riding surf or skimming in shallow water.

Section 5. Violation. Violation of this resolution is a violation
of Ordinance Number 624 and is punishable as a misdemeanor.
Section 6. Severability. If any section, subsection, sentence,
clause, phrase, or portion of this resolution, or the application
thereof to any person, firm, corporation or circumstance, is for any
reason held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance.
The City Council of the City of Seal Beach hereby declares that it
would have adopted this resolution and each section, subsection,
sentence, clause, phrase, or portion thereof, irrespective of the
fact that anyone or more sections, subsections, sentence, clause,
phrase, or portion thereof, irrespective of the fact that anyone
or more sections, subsections, sentence, clause, phrase, or portion
be declared invalid or unconstitutional.
