ORDINANCE NO. 5;(~
AN ORDINANCE OF THE CITY OF SEAL BEACH
PROHIBITING PARKING OF VEHICLES ON OCEAN
A VENUE WEST OF THE WESTERLY CURB LINE
OF FffiST STREET AND DECLARING THIS TO BE
AN EMERGENCY MEASURE
The City Council of the City of Seal Beach does ordain as follows:
SECTION 1: It shall be unlawful for any person to park or leave standing
any motor vehicle on any portion of Ocean Avenue within the City of Seal Beach
west of the westerly curb line of First Street between the hours of 8:00 o'clock
P. M. and 6:00 o'clock A. M..
SECTION 2: Any person violating the provision of Section 1 of this
Ordinance shall be deemed guilty of a misdemeanor and shall be punished
by imprisonment in jaU not to exceed thirty (30) days, or by a fine of not to
exceed One Hundred Fifty ($150) Dollars, or by both such fine and imprison-
ment.
SECTION 3: It shall be presumed that the registered owner of any vehicl
left parked or standing in violation of the provision of Section 1 of this
Ordinance was the person leaving such vehicle so parked or standing, which
shall be a rebuttable presumption and the burden shall be on the registered
owner to prove by competent evidence he did not leave such vehicle so parked
or standing.
SECTION 4:
The City Council declares this is an emergency measure
which shall take effect immediately upon the passage and adoption by the
City Council of the City of Seal Beach, and the facts constituting the urgency
therefore are, that people come to the beach area during the summe r months
and although the portion of Ocean Avenue referred to in this Ordinance is
partially barricaded and Ocean .-l.venue brdige has been heretofore removed
60 that vehicles cannot proceed on Ocean Avenue west of the Seal Beach City
limits and therefore as a practical mattar such area cannot be used for
vehicular traffic and that there have been acts of vandalism destroying property
by occupants of cars parked during nighttime hours on said portion of Ocean
Avenue, the Council deems that in order to prevent acts of vandalism, cars
should not be left standing or parked on such portion of Ocean Avenue; that

1 the City Clerk shall certify to the passage and adoption of this Ordinance by
2 the City Council and shall cause the same to be published once in the "Seal
3 Beach Post and Wave", a newspaper of general circulation, printed, published
4 and circulated in the City of Seal Beach, and this ordinance shall take effect
5 immediately upon the passage and adoption by the City Council.
6 PASSED, APPROVED AND ADOPTED by the City Council of the City of
7 Seal Beach at a regular meeting thereof held on thej4 ~day of August, 1958.
