I I I i, ,- RESOLUTION NO. /7 9 if A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH DECLARING WORK TO BE COMPLETED AS TO PLANS AND SPECIFICATIONS FOR PROJECTS 124/125 - WATER TRANSMISSION FACILITIES AND SEWER FORCE MAIN SERVING SUNSET AQUATIC PARK - IN ACCORDANCE WITH CONTRACT ENTERED INTO BETWEEN GALLACHER & MCICERVEY AND CITY OF SEAL BEACH. The City Council of the City of Seal Beach does hereby resolve: WHEREAS, on the 16th day of January, 1969, the City of Seal Beach had entered into a contract with Gallacher & McKervey for the installation of water transmission facilities and sewer force main to serve Sunset Aquatic Park, Projects 124/125, in the City of Seal Beach;. and WHEREAS, the City Engineer has submitted his approval of the final quantities and cost figures; NOW, THEREFORE, the City Council of the City of Seal Beach does resolve as follows: Section 1. That the work required to be performed by said contractor has been completed. Section 2. That the total cost of"said work is in the amount of $366,133.86. Section 3. That the work is hereby accepted and approved, Section 4. It is further ordered that a "Notice of Completion" be filed, on behalf of the City, in the office of the County Recorder of the County of Orange within ten days of the date of this resolution. This should be prorated to the two facilities as follows: Water Transmission Facilities - $10,604.28 (%8699-09), and Sewer Force Main - $11,324.72 (%8699-10). When the payment is made for the 10% retention the proration should be as follows: Water Transmission Facilities - $19,507.54 (%8699-09), and Sewer Force Main - $17,l05.85 (%8699-10). In addition to this payment, it 18 recommended that the City Council take the following action: 1. By resolution, determine that the work has been completed in accordance with the contract documents and declare the work to be accepted. 2. By resolution, determine that the total amount of work performed under this contract is in the sum of $366,133.86. 3. Within ten (10) days frOlll the date of acceptance, file a Notice of Completion with the Orange County Recorder. I 4.
