(A. ) Where water is furnished through meters, the monthly minimum rate to be charged for each meter installed shall be as follows: For each 5/8 or 3/4 inch meter, per month For each 1 inch meter, per month For each 11/2 inch ser, per month For each 2 inch meter, per month For each 3 inch meter, per month For each 4 inch meter, per month For each 6 inch meter, per month For each 8 inch meter, per month For each 10 inch meter, per month For each 12 inch meter, per month For each 16 inch meter, per month $ 2.00 $ 2.. 50 $ 3.00 $ 3.50 $ 6.50 $ 13.00 $ 26.00 $ 40.00 $ 55.00 $ 75.00 $ 135. 00 Whenever a battery of smaller meters is installed in place of one large one, the monthly minimum charge therefor shall be based upon the size of meter or service ordered by the consumer. (B.) The monthly charge for private fire lines shall be as follows, as a minimum: $1.00 per month for each inch or part thereof. (C.) Should an account not be paid on or before the 20th day of the month in which it became due. it shall be deemed delinquent and a penalty of 100/0 shall be added thereof. If not paid before ten (10) days thereafter, the water shall be shut off from the premises where used and shall not again be turned on until all arrearages and penalties, together with a charge of $2.00 to cover expenses, shall have been paid. In case water shut off, either because of non-payment of bills or on written order hereinafter provided, and shall be found to have been turned on without the consent of the Superintendent of Water Department, the meter shall be removed and an additional charge of $2.50 collected before meter shall agai be installed. Section 4: At the time of application for water service the owner of the property, concerning which service is applied for, shall sign an applica- tion together with the occupant of the premises to which water is to be furnish- ed. which application shall provide that said owner agrees that the rate, charge or account for water, all other rates or charges provided for in this Ordinance shall be charged against the property on which furnished and shall be deemed delinquent at the same time and in the same manner as the next regular water bill and shall be a lien against the property where furnished. In addition to any other remedy provided herein for the enforcement and collection of any water rate, charge or account, all rates or other charges provided for in this ordinance shall be charged against the property on which furnished and against the owner or owners thereof and shall be deemed de- l inquent at the same time and in the same manner as the next regular water bill and shall be a lien against the property where furnished and if for any cause any sums owing therefor become delinquent, the water shall be shut off and in no case shall it be turned on to the same property until all such de- l inquencies shall have been paid in full, and such property owner shall be responsible to the City of Seal Beach in an action waged in any court of compete t jurisdiction for the amount of all such rates or other charges as may be due and unpaid, together with all penalties provided herein and costs. All consumers unless otherwise provided for in this Ordinance shall be supplied with water measured through a meter, which meter together with service connections shall remain the property of the City of Seal Beach and shall be applied for and installed in the manner hereinafter specified. Section 6: Application for Service. Before water shall be supplied to any person or for any premises from the mains of the Seal Beach Water De- partment, the owner thereof shall make application for same on such form as may be provided by the Superintendent of the Water Department for that purpose. Section 7: Form of Contract. The application shall "ontain a contract, on the part of the applicant to pay the stipulated rates at the time and in the manner provided for in this ordinance or any subsequent ,ordinance, to accept water rates, charges or penalties as a lien against the property to be served and assuming responsibility for same, reserving to the City of Seal Beach the right to enforce and collect rates, charges and penalties in the manner provided for by ordinance, to change rates and to temporarily discontinue the service at any time without notice to the conSllmer, and further to provide that the water Department of the City of Seal Beach or any of its employees shall not be responsible for any damage by water or otherwise, resulting from defective plumbing, broken or faulty services or water mains, or resulting from any con ditions of the water itself or any substance that may be mixed with, or be in the water as delivered to any consumer. Having complied with all requirements of this ordinance relating to application for meter and service, and having paid all charges incurred, the Water Department shall cause the property described to be connected with water mains in the following manner: Section 8: When property is located upon a street in which a water main is laid, same shall be connected with the water system by a copper servic pipe from the main to the curb line, a stop cock placed inside the line of the street curb, together with a meter, meter box and shut off box. However, nothing in this paragraph shall interfere with the Water Department installing a service pipe of sufficient size to allow off leading branches to the right or left in the parking or street for the purpose of supplying two or more separate -3- I ill ~ {,) D-C .... When the property to be :3 4 served is a part or subdivision of a lot or lots originally abutting on a water main but because of subdivision has been separated from said main by another 5 property, the service shall be laid to and meter installed at the nearest curb 6 Line or such point as may be designated by the Superintendent of the Water 7 Department. 8 No one service shall sllpply water to properties under separate 9 ownership. 10 The charge for water service to start from the date the meter is in- 11 stalled. When new subdivisions are opened and new mains desired, the sub- 12 divider shall pay for such service at cost and plus ten per cent. 13 14 15 16 17 20 21 22 23 24 25 26 27 28 29 Section LD: Cost of Service, Connections. The Water Department shall make the following charges for the perpetual maintenance of all services, meters and meter boxes installed, except as herein otherwise provided; same to remain the property of the City of Seal Beach. Section Ll: That the following fees are established and fixed for the 18 1 nstaLlation of service and meters in, upon, over and along the streets, alleys, 19 rights of way and other public ways of said City as follows: 3/4" service, or under 1" service 1-l/2" service 2" service $ 50. 00 $ 80.00 $ LlO.OO $ 175.00 Services larger than two inch shall be charged for at cost of material and labor used, plus ten percent for supervision, the charge for same shall be due and payable as soon as the work is comp leted. These prices shall indude the service connection complete, including meter and meter box set in place, except when meters are required under a sidewalk excavated to the curb Line, in which case the property owner shall comtruct a cement box for said meter, open on the top side only and of sllch size and in such location as may b 30 31 designated by the Superintendent of the Water Department. U 0< 14 ;J "- 3:5z ~<(lDg Ill' 15 ~~6 . ,. ! :r .. 16 aU. . < 0 rac!!4~i 17 ~~S~ )1<"Z ~ = 9 18 . - III ~ 19 20 21 22 23 24 25 26 27 I 28 29 30 31 32 PAGE O~dinance Number Section 12: The following schedule, which is based on 1/4 the rated capacity of meters in a four hour per day continuous flow, shall determine the size meter that shall be imtalled without additional charge: For a monthly consumption up to 7200 cu. ft. a 3/4" meter For a monthly consumption from 7200 cu. ft. to 14400 cu. ft. l" meter Monthly consumption from 14400 cu. ft. to 21600 cu. ft. a 1 1/2" meter Monthly consumption from 21600 cu. ft. to 36000 cu. ft. a 2" meter Monthly consumption from 36000 cu. ft. to 64800 cu. ft. a 3" meter Monthly consumption from 64800 cu. ft. to 129600 cu. ft. a 4" meter Monthly consumption from 129600 cu. ft. to 216000 cu. ft. a 611 meter The Superintendent of the Water Department shall have the dis- cretionary right to order a battery of meters which are smaller in size in place of one large meter if such is deemed necessary and proper by him. Section 13: The following minimum rates for the use of water by con- Sllmers within the City of Seal Beach for inde~endent fire lines (private) use exclusively for fire protection, whether said fire line be connected with auto- matic sprinkling systems or to hose attachments are hereby fixed and the Water Department is hereby authorized and directed to charge and collect the same in accordance with the provisions of this Ordinance: The monthly charge therefor is fixed as $1.00 per month for each inch or part thereof. No private fire line shall be u.;ed for any purpose other than the ex- tinguishment of fires unless the same be equipped with a meter, in which event the regular meter rates shall be charged in addition to the foregoing charges for fire line service. All faucets, hose, sprinklers, nozzles or water plumbing equipment must be shut off promptly upon an alarm of fire being given and the water not to be turned on again until the fire is known to be extinguished. Section 14: Water to pass through meters. All water used, sold or distributed in the City of Seal Beach shall be measured by meter or meters un- less otherwise provided for by the terms of this ordinance. Section l6: The monthly minimum rate to be charged for water furnished through meters and private fire lines, as provided for in Section 1 of this Ordinance shall be for the use of the first 500 cubic feet, or part thereof, or water furnished through such meter, and an additional charge of 15~ shall be made for each additional 100 cubic feet, or part thereof, of water furnished through such meter or private fire line. Section 17: Testing Meters. That,an y consumer may demand that the meter through which water is being furnished be examined and tested by said Warter Department for the purpose of ascertaining whether or not it is register ing correctly the amount of water which is being delivered through it. Such demand shall be made on forms furnished by the Water Department and shall be accompanied by a deposit to cover the cost of testing the various sizes as foHows: For testing a 3/4" meter For testing a 1" meter For testing a 1-1/2" meter For testing a 2" meter For testing a 3" meter For testing a 4" meter For testing a 6" meter $l.OO l.50 J.. 75 2.,00 3.00 4.00 5.00 Upon receipt of such demand accolIp anied by the proper deposit it shaH be the duty of the Water Department to cause the meter to be examined a tested for the purpose of ascertaining whether or not it is registering correctly the water being delivered through it. If on such examination and test the meter shall be found to register over three per cent more water than actually passes through it, another meter shall be substituted therefor and the fee so charged shall be returned to the person making the application, and the water bill for the current period adjusted in such a manner as the Superintendent of the Water Department may deem fair and just. Section 18: Moving meters or services. The Superintendent of the Water Department may if deemed necessary remove a meter or water service temporarily for the purpose of testing or repairs, or both, and in event another meter is not substituted therefor, th.. charge for service during the time said meter is removed shall be computed pro rata upon the amount of water consumed during the previous calendar month, or upon the rate provided in this ordinance for the sale of water where no meter is installed. No meter or meters and/or service pipes or connections shall be removed or changed without consent in writing of the Superintendent of the Water Department first had and obtained. Section 19: Fire Hydrants. Fire Hydrants shall be used exclusively fo the purpose of extinguishing fires and for flushing water mains under the jllris- diction of the Fire Department and the \/Vater Superintendent of said City, except and provided however, that a public or building contractor may make a connection to such fire hydrant or hydrants upon an application first made, upon a form to be provided, to the Water Superintendent of said City. Section 20: Unlawful to Meddle with Water Department Property. It shall be unlawful for any person, firm or corporation to meddle with, tamper with, move water, or change any water meter service pipes, curb cocks, or other fittings installed by Water Department of said City without consent of the Water Superintendent in writing first had and obtained. Section 21: Condition of Service. All consumers must prevent waste of water and must keep their service pipes, fixtures, stop cocks and other plumbing and apparatlls (except that portion of the service installed and owned by the City) in good condition and repair and free from leakage at their own cost and expense. All meters the property of said City shall be left open and uncovered and an y authorized agent of the Water Department shall have access to the premises at any and all reasonable hours for the purpose of inspecting, testing and repairing service connections. No sewer pipe or sewer ditch shall be placed nearer than two (2) feet to any water main or service pipe for water except upon the written permission of the Superintendent of the Water Department. Any water pipes or service connections required to be removed in orde to comply with any of the terms and conditions of this ordinance shall be moved u?on the order and at the direction of the Water Superintendent, and any cost of expense for labor, material and supplies with respect thereto shall be paid by the property owner of the premises effected thereby. Section 22: Penal Clauses. It shall be unlawful for any person, whether as principal, agent, clerk, employee or otherwise, whether for himself, or for any other person, or for anybody corporate, or as an officer of any corporation, or otherwise, to violate any of the terms and conditions of this Ordinance, and each and every day shall constitute a separate violation thereof, and the violat- ing of any of the provisions of this ordinance shall be deemed a misdemeanor, and upon conviction thereof, any such person, firm or corporation as herein enumerated, shall be punished by a fine of not more than Three Hundred ($300. 0) Dollars, or, by imprisonment for a term not exceeding Three (3) Months, or, by both such fine and imprisonment. Section 23: That Ordinances Nos. l81, 224, 344, 362 and 433 of the City of Seal Beach and all ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed. This Ordinance shall take effect and be in full force upon and after th~ hour of l2:01 A. M., July 1, 1955. Section 24: The City Clerk shall certify to the passage and adoption of this Ordinance by the City Council and shall cause the same to be published once in the SEAL BEACH POST & WAVE, a newspaper of general circulation printed, published and circulated in the City of Seal Beach.
