PROVIDING FOR THE LICENSING AND 1M POUND...
ING OF DOGS; REGULATING AND KEEPING CON-
TRoL OF OOGS; THE CONTROL AND SUPPRESSION
OF RABIES AND PROVIDING FOR V ACCINA TlON
OF OOGS FOR RABIES; PROVIDING FOR PENALTIES

EMERGENCY MEASURE
The City Council of the City of Seal Beach does ordain as follows:
SECTION 1. Ordinance No. 388 and all other ordinances in con-
10 flict herewith are repealed.

SECTION 2. The word "dog" whenever used in this Ordinance shall

and are being used by blind persons in the City of Seal Beach for that purpose.
SECTION 3. Every person owning or having control of any dog in ,
the City of Seal Beach shall pay a license tax of $ \.Xr- per annum for each
18 spayed female dog; $ l.1vr" per annum for each male dog, and $ 3. tfJIO
19 per annum for each female dog so owned or controlled by him.

The license shall be dated the lst day of January of each year,
21 unless it be issued on or after July 1st, in which case it shall be dated the 1st
22 day of July, and shall be void on the 1st day of January, or the 1st day of July,
23 respectively, thereafter.

SECTION 4. It shall be the duty of the license collector to collect
25 said license taxes and to procure at the expense of the City, plates or tags
26 having thereon numbers corresponding to numbers of licenses issued, and
27 figures indicating the year for which said tax is payable. He shall furnish a
28 plate or tag with number corresponding to license number to each person payin

29 a tax, and shall enter into a book to be kept for that purpose, the name of th e',
30 owner and a description of the dog so entered.

SECTION 5. Every registered dog shall be provided by the owner
32 or possessor thereof with a suitable collar at least three-fourths (3/4) of an

2 or tag provided for in Sectlon. hereof, and such collar or devic e must be

worn by such registered dog at all tilI"es.
SECTION 6. Whenever a dog tag, issued for the current year by
5 the license collector, has been lost, or tB:ken or stoLen by parties llnknown to
6 the owner or person having controL of the dog for which the same was issued,
7 such owner or person having control of such dog may, on the payment of fifty
8 (50rl) cents and on making and subscribing to an affidavit of such loss of such
9 tag, receive from the license, collector a duplicate tag fOr the remaining por-
10 tion of the year for which the originaL license was issued.

SECTION 7. It is hereby declared unlawfuL, and shall constitute
12 a misdemeanor, for any owner of a dog, as herein defined, to .ilerlLit or allow

said dog to run at Large on any public street, avenlle, alley, lane, place, park
or public grounds, whether or not said dog shall be licensed; and any dog,
whether licensed or not, found running at large shaLL be impounded, subject to
redemption or sale, as hereinafter provided.
SECTION 8. All dogs shall be kept securely under Leash while on
any street, avenue, alley, lane, place, park or pubLic grounds in said City, and
19 all dogs must be confined at all times when not under leash by the owner to the
20 premises occupied by said owner, and either be securely tied on said premises
21 or confined so as to prevent said dog from escaping therefrom.

SECTION 9. In case it is satisfactorily proven to the poundmaster
23 that a license for the then current year has been paid upon any dog impounded,
24 said dog shall be released upon payment of a fee of $ J,,{'C; , and in the event
25 said dog shaLL not have a license for the then current year, as herein provided,
26 then the owner thereof, in order to release said dog, shaLL pay to the pound-

28 SECTION 10. Any person or the owner of any dog under their
29 controL or custody who requests the poundmaster to take up and dispose of any
30 such animal, shall be charged the sum of $ /"v,':;t.- for such service.

SECTION 11.
It shall be unlawfuL for any person to imitate or
32 counterfeit the tags provided for in this ordinance, or to use any imitation or
counterfeit of sllch tags.

SECTION 12. If any dog shall bite any person or any animal
2 within the City of Seal Beach, the owner or person having custody or control
3 of such dog shall upon request of any peace officer, poundmaster or his
4 representatives, deliver such dog forthwith to such officer, poundmaster or

5 his representative to be held for ~ (MiJ days for the purpose of determining

whether or not such dog is afflicted with rabies, and the owner or person hav-
ing control of such dog shall pay all the expenses of the keeping thereof during
the time such dog shall be so held.
In lieu of impounding said dog in the City Fbund, the owner or
person having control of such dog, with the approval of the Police Department,
shall forthwith make arrangements with a veterinarian in the City of Seal Beach

approved by the Health Department, for the impounding of said dog for a period

13 of left- (I';) days, and deliver said dog to said veterinarian forthwith; upon re-

ceipt of such dog, the said veterinarian ghall immediately notify the Police
Department.
The provisions of this Section shall not apply in those cases where

any dog bites the owner or person having control of such dog, or any member of
the immediate family of the owner or person having control of such dog.

SECTION13. It shall be unlawful for any person to rescue, or
20 attempt to rescue, ,or in any way interfere with the Poundmaster, his deputies
21 or assistants, while impounding or attempti. g to impound dogs pursuant to
22 this Section.

SECTION 14. It shall be unlawful for any person to bring into, or

for any person to allow any dog to enter any place of business in which food is
sold, prepared for sale, produced, ~anufactured, packed, stored or otherwise
disposed of.
SECTION 15. It shall be unlawful for any person to keep on anyone
28 premises owned or occupied by him, more than three (3) dOJs if said dogs are
29 more than six (6) months old, unless said dogs are pro;;>erly housed in kennels
30 approved by the Health Departme,rt.
31 If more than three (3) dogs over the age of six (6) months are kept
32 in a permanent enclosure or in a k~~.1"_l as herein provided, no part of said

1 enclosure or kennel may be within twenty-five (25) feet of any dwelling
2 occupied by human beings, except any and all dwelling houses owned or occu-

pied by the person owning or having control of the dog~ provided, however, th t
the provisions of this Section will not apply to kennels and enclosures owned
5 and operated as a business.

SECTION 16. The poundmaster, upon impounding any dog, shall
7 immediately notify the owner or person entitled to the possession thereof, of
8 the impounding of said dog if such person is personally known to him.

SECTION 17. After the expiration of forty-eight (48) hours from
10 the time of impounding any dog, pursuant to the provisions of the preceding
11 section, may be sold, given away or destroyed by the poundmaster.
12 SECTION 18. The position of poundmaster is hereby created. It

shall be filled by appointment by the City Council, the appointee to serve at
the pleasure of the City Council and, as such, shall not be included in the
classified service of the City. The poundmaster shall receive such compensa-
tion as may be provided by the City Council, and all license fees, charges,
costs, receipts from sales, etc., collected by the poundmaster monthly to the
City Council as to his activities as poundmaster.
SECTION 19. Every person who owns or harbors any dog or dogs
20 in the City of Seal Beach shall have such dog or dogs vaccinated by a duly
21 licensed veterinarian with a vaccine approved by the Health Department.
22 Such vaccination shall be at intervals of not greater than two (2) years.

SECTION 20. Before any license shall be issued for any dog,
24 a certificate of a duly licensed veterinarian shall be exhibited to the pound-
25 master or City Clerk certifying that said dog has been vaccinated for rabies
26 within a period of fourteen (1M months prior to said application; the certificate
27 shall be given a number and the certificate number, date of vaccination, and
28

type of vaccina.tion shall be recorded on the records of the poundmaster; the
vaccination number shall be shown on the dog license fee receipt.
SECTION 21. All dogs in the City of Seal Beach which have not
31 been vaccinated for rabies within the fourteenth (14th) month preceding the
32 effective date of this Ordinance shall be vaccinated for rabies within sixty

SECTION 22. Any dog brought into the City of Seal Beach, which
has not been vaccinated within a fourteen (14) month period imILediately pre-
ceding the date such dog was brought into the City, shall be vaccinated for
5 rabies within five (5) days after the arrival of such dog in the city.

SECTION 23. Any person violating any of the provisions of this
7 Ordinance shall be deemed guilty of a misdemeanor, and, upon convic tion
8 thereof, shall be punished by a fine of not more than One Hundred Fifty
9 Dollars ($150.00) or by imprisonment for not more than thirty (30) days or by
10 both such fine and imprisonment.

SECTION 24. This Ordinance is declared to be an emergency
measure necessary for the immediate preservation of the public peace, health
and safety, and shall become effective immediately upon its passage. The
facts constituting the emergency are that the County of Orange has been
quarantined by the State Department of Public Health; three persons have been
bitten by dogs in the County and are undergoing Pasteur treatment; in addition
there have been positive cases of rabies infection in the County, and the State
Department of Public Health has asked the City of Seal Beach to take action by
ordinance for the inoculation of dogs within the City for the protection of the
public health and safety.
SECTION 25. The Ci,y Clerk shall certify to the passage and
22 adoption of this Ordinance and cause the same to be published once in the
23 SEAL BEACH POST AND WAVE, a newspaper of general circulation, printed,
24 and pllblished in the City of Seal Beach.
25 PASSED, APPROVED AND ADOPTED by the City Council of the
26 City of Seal Beach at a regular meeting thereof held on the 3rd day of
27 January, 1956, by the following vote:
