" I ~.," :~;:~"CIAL COPY ~l ,: i r) :- .: TA.I:GtJ I="'OM T~iG -.TV CL"'R,~'S Ol=FICE 2 , ORDINANCE NO. 4-t7 , 3 4 5 6 AN ORDINANCE OF THE CITY OF SEAL BEACH PRO- VIDING FOR SICK LEAVES FOR CITY EMPLOYEES The City Council of the City of Seal Beach does ordain as follows: SECTION 1: That the City of Seal Beach recognizes that there 7 . should be sick leave benefits provided for employees of the City, which sick 8 \ leave shall not be considered as a privilege which an employee may use at 9 his discretion, but shall be allowed only in case of necessary and actual 10 sickness or disability. 11 SECTION 2: Sick leave shall not be considered as a privilege 12 which an employee may use at his discretion, but shall be allowed only in case 13 of necessity and actual sickness or disability. 14 SECTION 3: A sick leave with pay shall be granted to permanent 15 ; employees at the rate of one work day for each calendar month of service from I I the date of appointment, or from one year prior to the adoption of this ordinance 17 IWhichever is the smaller period of time, except that at the discretion of the 18 'City Council sick leave with pay may be granted at the rate of one day per . , Imonth of service from the date of appointment. Records shall be maintained I . ',WhiCh indicate the total sick leave accumulated to each employee's credit, and 21 sick leave granted shall be deducted from that total in accordance with these 16 19 20 22 rules. No additional sick leave above the total provided for the various classes 23 in the city service in these rules shall be granted. Sick leave shall be accumu- 24 ated to the total number allowed for the various groups of positions, and after 25 ny days have been deducted as the result of any illness, sick leave will again 26 ccumulate to the total allowed. 27 SECTION 4: Employees in positions or classes of positions de- 28 ignated by resolution of the City Council as performing services five days per 29 shall be allowed to accumulate sick leave to a total of one hundred (l00) 30 ys. Sick leave shall be charged at the rate of one day for each work day an 31 mployee is absent on sick leave, provided absences of one-half day or less 32 hall be charged at the rate of one-half day against the employee's total. -1- I .1 I .. ~: .. .. . . Ordinance N~be~' . . . . ..., 1 SECTION 5: The City Council may grant additional sick leave 2 without pay for a period not to exceed one year. :5 4 SECTION 6: In order to receive compensation while absent on sick leave, the employee shall notify his immediate superior or the chief 5 of department prior to, or within two hours after the time set for beginning 6 his daily duties, or as may be specified by the chief of his department. When 7 an absence is for more than three successive work days, the employee shall 8 file a physician's certificate with the Chief of Department, stating the cause 9 of illness. The City Council may, upon its own motion, order an examina- 10 tion of the employee by a physician of its own choosing to determine whether 11 or not sick leave shall be granted. The decision of the City Council in such 12 cases shall be final. 13 SECTION 7: Sick leave is hereby defined to mean the absence from 14 duty of an employee because of illness, or exposure to a contagious disease, 15 16 or death in the immediate family. "Immediate family" shall mean the spouse, the father, mother, son, daughter, brother or sister of the employee. 17 SECTION 8: No person shall be entitled to sick leave with pay 18 while absent from duty on account of any of the following causes: (a) Dis- 19 ability arising from any sickness or injury purposely self-inflicted or caused 20 by any willful misconduct. (b) Sickness or disability sustained while on 21 leave of absence without pay. 22 SECTION 9: Whenever an employee receives Az,kmen's Com- 23 pensation under authority of the laws of the State of California, the sick 24 leave with pay allowed to such employee shall begin with the first day he is 25 absent from duty because of injury, and continue until the first day for 26 which he is paid compensation from the insurance fund. Deduction shall be 27 made from his accumulated sick leave for the period of time he is paid full 28 29 salary by the City, while he is absent from duty. For the limited r.emaining duration of time he receives Workmen's Compensation for total temporary 30 disability he shall be paid the difference between his regular salary and the 31 amount of Workmen's Compensation he receives. No deduction shall be 32 made from the accumulated sick leave for such payment. Ordinance N'xmbez difference shall not continue for more than six months because of anyone injury. SECTION 10: The City Clerk shall certify to the passage and adoption of this Ordinance by the City Council of the City of Seal Beach and shall cause the same to be printed and published once in the SEAL BEACH POST &. WAVE, a newspaper of general circulation printed, published and circulated in the City of Seal Beacllo.
