AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER 23, 1954, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN MUNICIPAL IMPROVEMENT. WHEREAS, the City Council of the City of Seal Beach, California, did on the 11th day of October, 1954, by a vote of more than two-thirds of the members of said City Council, adopt Resolution No. ..ESt . entitled "Resolution of the City Council of the City of Seal Beach, California, determining that the publiC interest and necessity demand the acquisition and construction of a certain municipal improvement, and making findings relating thereto", which said resolution was duly signed and approved by the Mayor of said city and attested and certified by the City Clerk of said city; NOW, THEREFORE, the City Council of the City of Seal Beach DOES ORDAIN as follows: Section 1. That a special election be held, and the same is hereby called to be held, in the City of Seal Beach, California, on the 23rd day of November, 1954, for the purpose of submitting to the qualified voters of said city a proposition of incurring indebtedness and issuing bonds of said city therefor, for the object and purpose set forth in said resolution and hereinafter stated. Ordinance Number I Section 2. That the object and purpose for which said indebtedness is to be incurred and bonds issued therefor is as follows: I The acquisition and construction by the City of Seal Beach of a certain municipal improvement. to wit: aqueducts. water pipelines (including pipelines to replace existing lines). reservoir site. and pumping facilities and other works for the transmission and distribution of water. including the city's share of aqueducts. water pipelines and related works to be owned and used jointly with other public corporations and public agencies. and including the acquisition of all land. easements. pipe. pumps. valves. controls. machinery and other property necessary therefor. Section 3. That the estimated cost of the municipal improvement described in Section 2 hereof is the sum of $369.000 and that the amount of the principal of the indebtedness to be incurred therefor ,is the sum of $369.000. I That the maximum rate of interest to be paid on said indebtedness shall not exceed the maximum rate permitted by law. to wit. six per cent (6%) per annum. payable annually the first year and semiannually thereafter. the actual rate or rates of interest on said bonds to be determined at the time of the sale or sales thereof, That if the proposition for the incurring of bonded indebtedness so submitted receives the requisite number of 2. Ordinance Number I votes, to wit, two-thirds of the votes of the qualified electors voting on said proposition, bonds of said city in not exceeding the principal amount stated in such proposition shall be issued and sold for the object and purpose set forth in said proposition. Section 4. That the polls tor said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until seven o'clock P.M. of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. I That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) INSTRUCTIONS TO VOTERS I To vote on any measure, stamp a cross (+) intle voting s~uare after the word "YES" or after the word "NO'. All marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obta~n another. On absent voter's ballots mark a cross (+) with pen or pencil. 3. Ordinance Number I : BOND PROPOSITION: Shall the : City of Seal Beach incur a bonded : indebtedness in the principal sum : of $369,000 for the acquisition and : construction by said city of a certain : municipal improvement, to wit: : aqueducts, water pipelines (including : pipelines to replace existing lines), reservoir site, and pumping facilities : and other works for the transmission : and distribution of water, including : the city's share of aqueducts, water pipelines and related works to be : owned and used jointly with other pUblic corporations and public agencies, : and including the acquisition of all : land, easements, pipe, pumps, valves, : controls, machinery and other property : necessary therefor? . . : I . . . . . . : : YES : : . . . . : . . . . : : . . . , . . . . . . . . . . . . : NO . . : . . : . . : . . . . . . , , : : : . . : : . . . . . . . . . . . . . . . . . . . . . . . . . . Section 5. A cross (+) placed in the voting square after the word "YES" in, the manner hereinbefore provided shall be counted in favor of the adoption of the question or proposition. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the question or proposition. Section 6. That for the purpose of holding said election there shall be and are hereby established eight election precincts designated as hereinafter stated. Each such precinct shall consist of a regular election precinct in the City of Seal Beach established for the holding of state and county elections, as said regular election precincts exist on the date of adoption of this ordinance. The polling places for the respective precincts shall be the places hereinafter designated and the persons hereinafter named, being competent I 4. I Ordinance Number and qualified electors and residents of said city and of their respective election precincts, are hereby appointed officers of election and they shall hold said election and make return thereof in the manner provided by law. That except as otherwise provided in this ordinance, the election called hereby shall be conducted as provided by law for other municipal elections in said city. I Section 8. That the City Council of said City shall meet at its usual place of meeting in the City Hall on Tuesday, the 30th day of November, 1954, at 7:30 o'clock P.M. of said day, and proceed to canvass the election returns and declare the result of said election. Section 9. That the City Clerk shall certify to the passage and adoption of this ordinance by a vote of more than two-thirds of all of the members of the City Council of said City, and shall cause said ordinance to be published once a week for two successive weeks in the SEAL BEACH POST & WAVE, a weekly newspaper of general circulation in said City. No other notice of such election need be given. Section 10. This ordinance shall take effect immediately upon its passage.
