REGULATING TIlE OPERATION OF TAXICABS;
REQUIRING PERMITS THEREFOR; PRESCRIBING
PENALTIES FOR VIOLATION; PROVIDING FOR

The City Council of the City of Seal Beach does ordain as
follows:
Section 1. DEFINITIONS. For the purpose of this Ordinance
the following terms shall be deemed and construed to have the mean-
ings respectively ascribed to them in this Section, unless from the
particular context it clearly appears that some other meaning is
intended:
(a) DCity" shall mean the City of Seal Beach, California.
(b) "Carriero shall mean and include every person, corpor-
14 ation, partnership, joint venture or other form of business organ-
15 ization, their lessees, receivers or trustees, engaged in operating,
16 or causing to be operated, taxicabs as defined herein.
17 (c) DTaxicabo shall mean and include every vehicle used for

18 the transportation of passengers over the streets of the City, but
19 not over defined routes, for compensation.
20 (d) "Compensationo shall mean and include any money, thing

21 of value, payment, consideration, revmrd, tip, donation, gratuity
22 or profit paid to, accepted or received by the driver of any veh-
23 icle in exchange for transporation of a person, or persons, whether
24 paid upon solicitation, demand or contract, or voluntarily, or int-
25 ended as a gratuity or denation.
26 (e) "Vehiclen shall mean every motor propelled vehicle used

27 for the transportation of persons over public streets.
28 (f) DDriverR shall mean and include every person driving,

2~ operating or in charge of any vehicle as defined by this Ordinance.
30 (g) I'Driver's PermitD shall mean and include the permit
31 issued by the Chief of Police to any person operating or driving any
32 vehicle as defined in this Ordinance.

1 (h) uPersonu shall mean and include all domestic and foreign
2 corporations, associations, syndicates, joint stock companies, part-
3 nerships of every kind, Massachusetts business or common law trusts,
4 societies and individuals.
5 (i) UStreet- shall mean and include every public street.
- -
6 road, alley. place, way or highway in the City.
7 Section 2. No person shall drive, operate or cause to be
8 operated. nor shall any person employ, permit or allow another to
9 drive, operate or cause to be operated, any vehicle over any street
10 of this City for the purpose of transporting a passenger, or pass-
11 engers, for compensation, regardless of whether such operation ex-
12 tends beyond the boundary limits of the City. nor shall any person
13 solicit, induce, persuade, invite or procure such transportation of
14 passengers for compensation, or accept compensation therefore. with-
15 out a permit or license first having been obtained auth~izing such
16 operations and acts, except:
17 (a) A vehicle which is lawfully transporting a passenger,
18 or passengers, from a point outside to a destination within this
19 City. or is enroute to a destination outside this City; provided
20 that no such vehicle shall, without such permit or license. solicit
21 or accept a passenger, or passengers, from within this City for
22 transportation to any destination whatsoever.
23 (b) A vehicle being operated pursuant to authority of the
24 Railroad Commiasion or Public Utilities Commission of the State of
25 California.
26 (c) A vehicle being operated under ymat is commonly referred
27 to as a "share the rideR plan, or arrangement, where a person en
28 route from his place of residence to his place of business, or vice
29 versa, transports another person, or persons, living and vrorking in
30 the same general vicinities unon payment of Q sum estimated to cover
31 the actual or approximate cost of the operation of the vehicle.
32 (d) Vehicles being operated as ambulances and being operated

pursuant to authority granted by. and in accordance with. other

(3) Vehicles rented or leased for self operation by a person
4 , using such vehicle under a plan commonly known as "U-Orive", but
-
5 not when transporting other persons for compensation.
6 Section 3. No carrier shall engage In business in this City
7 without having first obtained a license and certificate of public
8 convenience and necessity from the City Council.
9 Section 4. All carriers applying to the City Council for a
10 license and certificate of public convenience and necessity shall
11 file with the City Clerk a sworn application therefor stating as
12 follows:
13 (a) The names and addresses of the person or persons making
14 application.

(b) The type of business organization.
(c) The number of taxicabs actually operated by the carrier
17 on the date of application.
18 (d) The number of taxicabs for which a license and certific-
19 ate of public convenience and necessity is desired.
20 (e) The make and type of taximeter, if any, intended to be
21 installed on each taxicab for which application is made.
22 (f) Such other information as the City Council may in its
23 discretion require.
24 Section 5. Any license which may be issued by the City
25 Council to any carrier under the terms and conditions of this Ord9
26 inance may be suspended or revoked by the City Council at any time
27 in the following cases:
28 (a) Whenever the City Council finds the carrier's past
211 record to be unsatisfactory.
30 (b) \Vhenever the carrier fails to operate the taxicab or
31 taxicabs in accordance with the provisions of this Ordinance.
32 (c) Whenever the carrier shall cease to operate any taxicab

1 or taxicabs at all for a period of thirty consecutive days without
2 having obtained permission for cessation of such operation from the
:5 City Council.
4 (d) The taxicab or taxicabs are operated at a rate of fare
5 other ttrn that approved by the City Council.
6 (e) For any other reason which the" City Council, in its
7 sound discretion, may deem warrants suspension or revocation.
8 Section 5. Every carrier shall file or cause to be filed
9 with the Clerk of the City a true and correct statement of the rates
10 to be charged for the transportation of passengers in any and all
11 taxicabs operated by said carrier and such carrier shall not change
12 or modify said rates in any manner without the written permission
13 of the City Council and without filing said modified or changed
14 rates with said City Clerk.
15 Section 6. The Chief of Police of the City shall have the
16 right at any time after displaying proper identification, to enter
17 into or upon any taxicab for the purpose of ascertaining whether or
18 not any of the provisions of this Ordinance are being violated.
19 Section 7. The City Council may at its discretion issue an
20 annual license to any such carrier as provided in this Ordinance
21 upon the payment of the sum of $50.00 for the first taxicab and
22 $30.00 for each additional taxicab, and such fee shall accompany
23 the application for the license and application for the ce~tificate
24 of public convenience and necessity provided for herein.
25 Section 8. Such annual license shall not be transferable,
26 and the holder of any license who desires to operate additional
27 taxicabs, other than those for which already licensed, shall apply
28 for an additional license and said certificate and pay any addition-

30 Section 9. Vfuenever the holder of a certificate and license
31 shall substitute one taxicab for another, without increasing the
32 number of taxicabs operated, he shall have the right so to do, with-

out procuring a new license or certificate, provided such carrier
shall notify the City Council in writing of such substitution with-
in ten days after such substitution is made.
Section 10. It shall be unlawful for any person to drive or
operate any taxicab in this City without first obtaining a driver's
permit in writing from the Chief of Police of the City, upon pay-
ment of an annual fee of $2.00, subject to the following conditions:
(a) Such applicant shall be fingerprinted by the Chief of
Police of the City.
(b) Such applicant shall not be under twenty-one years of
age.
(c) No applicant may obtain a permit to drive or operate an
of the vehicles mentioned in this Ordinance unless and until he sha
have been a continuous resident of the City of Seal Beach for at
least thirty days immediately preceding the date of said application;
provided, however, that a temporary permit only shall be granted
for a period not to exceed sixty days after which time said license
shall be made permanent, if said applicant otherwise qualifies.
Section 11. The Chief of Police may revoke or refuse to re-
new a driver's permit if the driver or applicant has since the
granting of his permit been convicted of a felony; shall have had
his California operator's or chauffeur's license suspended or rev-
oked, or been convicted of driving while under the influence of
intoxicating liquors.
Section 12. It shall be unlawful for any person to refuse

to pay the authorized fare of any of the vehicles mentioned in this
Ordinance after having employed the same, and it shall be unlavnul
for any person to hire any vehicle herein defined with intent to
defraud the person from whom it is hired, or engaged, of the value
of such service.
Section 13. It shall be unlawful to operate any taxicab
unless there shall have been issued, and filed with the City Clerk,

a policy of insurance executed and delivered by a company authorized
to carryon an insurance business in the State of California, by
the terms of which said insurance company assumes responsibility fo
injuries or death to persons or damage to property caused by the
operation of said taxicab in the following amounts: $5.000.00 for
damage to, or destruction of, property; $25.000.00 for death or
injuries to anyone person in anyone accident; $50.000.00 for
death or injuries to two or more persons in anyone accident.
SectiQn 14. Any person, firm or corporation violating any
of the provisions of this Ordinance shall be guilty of a misdemeano
and upon conviction thereof shall be punished by a fine not exceed-
ing $300.00, or imprisonment in jail for a period not exceeding
thirty days, or by both such fine and imprisonment.
Section lq. Ordinance No. 298 is hereby repealed.
Section 1~. The City Clerk shall certify to the passage of
this Ordinance by the City Council of the City of Seal Beach and
shall cause the same to be printed and published once in the ~
BEACH POST, & WAVE, a newspaper of general circulation printed,
published and circulated in the City of Seal Beach, and it is here-
by designated for that purpose!
Section 17. This Ordinance shall take effect thirty days
from and after its final passage and adoption.
