HomeMy WebLinkAboutCC Ord 408 1951-07-02 r' , I I '\ , , I , ' . , ORDINANCE No.4 Or( AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, REGULATING THE INSTALLATION, ARRANGEMENT, ALTERATION, REPAIR, USE, MAINTENANCE AND OPERATION OF ELEOTRIO WIRING, ELEOTRIO FIXTURES AND OTHER ELEOTRIO APPLIANCES AND EQUIPMENT IN THE OITY OF SEAL BEACH; PROVIDING FOR ELEOTRIO PERMITS AND INSPEOTIONS AND FIXING THE FEES THEREOF; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE AND REPEALING ORDINANOE NO. 205 AND ALL OTHER ORDINANCES OR PARTS OF ORDINANOES IN CONFLIOT THEREWITH. WHEREAS, the Oity Council of the Oity of Seal Beach, calif- ornia does ordain as follows: SEOTION 1 That a certain document, three copies of which are on file in the office of the City Clerk of the City of Seal Beach, Cslif., being marked and designated as, National Electrical Code, 1951 40th Anniversary Edition, with hereinafter designated changes, modifications, exceptions and amendments be and the same is hereqy adopted as the Electrical Oode of the Oity of Seal Beach for the regulation of the installation, arrangement, alteration, repair, use and operation of electrical wiring, connections, fixtures and other electrical applianoes in buildings and other structures within the City of Seal Beach, California; providing for the issu- ance of permits and the collection of fees therefor; providing penalties for the violation of such Electrical Oode; and eaoh and all of the regulations, provisions, penalties, conditions and terms, with hereinafter designated changes, modifications, exceptions and amendments of such "National Electrical Code, 1951 Anniversary Edition" on file in the office of the Oity Olerk are hereby re- ferred to, adopted and made a part hereof as if fully set out in this ordinance. SECTION 2. There is hereby created and established the Office of Eleotrical Inspector. It shall be unlawful for the Electrical Inspector to engage in the business of the sale, installation or the maintenance of slectric wiring, electric devices and eleotric material either directly or indirectly and he shall have no financial interests in any concern sngaged in such business in the City of Seal Beach at any time while holding office of Elect- rical Inspector. Any violation of the provisions of this section by said Electrical Inspector shall be sufficient cause for his re- moval from office but he may be removed for other just cause. The Electrical Inspector shall appoint by and With the advice and con- sent of the City Council, such assistant inspectors as are deemed necessary by said Electrical Inspector. -1... r' , Ordinance Number '. SEOTION 3. DEFINITIONS 1 For the purpose of this Oode, oertain terms, phrases, words and their derivative shall be oonstrusd as set out in this seotion. Words used in the singular include the plural and the plural the singular. (A) Whenever the term "Electrical Inspector" is used in any seotion of this ordinance other than this seotion, such term shall be construed to mean, "Building Inspector" of the Department of Building and Safety or his authorized representative. DEPARTMENT OF BUILDING means the Department of Building and Safety of the Oity of Seal Beach. OERTIFIED ELEOTRIOIAN is a person who ~s en~ged in the bus- iness of installing or repairing electrioal wiring or equip- ment, or who does, or who holds himself out as willing to do personally or through his employees any work or services in oonneotion with the installation, alteration or repair of any eleotrical wiring or squipment or part thereof within the incorporated Oity of Seal Beaoh and who is qualified as provided in Ordinance . (B) ( 0) I (D) MAINTENANCE ELEOTRIOIAN is any eleotrioian regularly em- ployed in accordance With the provisions of Section ~ of this Ordinance. (E) ELECTRIO or ELEOTRIOAL WIRING Means the installation or the alteration of any material, fixture, device, appliance or equipment in or on any building, structure or premises, used or designed or intended to be used to generate, transmit, transform or utilize eleotric energy. (F) BUILDING is any structure built for the support or shelter of persons, animals, chattels or property of any kind. I (G) A~RTMENT HOUSE is any building or portion thereof, which is designed built, rented, leased, let or hired out to be oocupied, or which is ocoupied as the home or residence of three or more families living independently of eaoh other and doing their own cooking in the said building, and shall include flats and apartments. All apartment houses shall be considered commeroial buildings. (H) HOTEL is any building containing six or more rooms intended or designed to be used, or Which are used, rented or hired out to be ocoupied, or which are occupied for sleeping pur- poses by guests. (I) DWELLING is any building or any portion thereof Which is not an "Apartment House" or a "Hotel" as defined in this Oode which contains one or more "Apartments" or Guest ROOms," used, intended or designed to be built, used, rentedt leased, let or hired out to be ooouppied, or whioh are occupiea for living purposes. SEOTION ~. APPLIOATIONS AND PERMITS (A) Applioations for electical permits, desoribing the work to be done, shall be made in writing by a Licensed electrician, main- tenance eleotrician, or their authorized representative. -2- ,~ I (E) Ordina.nce ~umber Where a license is required by Ordinance 336 and 365} a per- mit shall not be issued unless the applicant has sucn a li- cense. In the case of an owner such application shall be for a special owner's permit. Applications shall gi~ the location where such work is to be done either by street and house number, by lot, block and tract, or similar description that will readily identify and definitely locate the proposed work. Each suoh application shall be accompanied by drawings or blueprints as required by the Electrical Inspector. Applicatione may be made by a firm, partnership, or corpora- tion, any officer or member of which is a certified elect- rician, in the event that all construction or work is done under the direct personal supervision of such officer or member. SPECIAL OWNER'S PERMIT. An Electrical Permit may be issued to an owner of a single family dwelling occupisd as his residencs, provided that said owner shall personally pur- chase all material and shall personally perform all labor in connection therewith. (c) PERMITS. No alteration or addition shall be made to any existing wiring, nor shall any wiring for the placing or installation of any electric light, po~er or heating de- vice, or any apparatus whioh generates, transmits, trans- forms or utilizes electricity, operating at a voltage ex- ceeding 25 volts between conductors or capable of supply- ing more than 50 waUB, be made without first obtaining a permit therefor from the Electrical Inspector, excepting minor repair work euch as repairing flush and snap switches, replacing fuses, changing lamp sockets and receptacles, taping bare joints, repairing drop cords and the like. The application, plans and specifications filed as required by this section, shall be checked by the Eleotrical Inspec- tor, and if found to be in conformity with the requirements of this Code and all other laws or ordinances applicable therA- to, the Electrical Inspector shall, upon receipt of the re- quired fee, issue a permit therefor. Every permit issued shall be valid only for the location described on the appli- cation therefor. 1 ( D) SEOTION 5. I EXPIRATION OF PERMIT. Every permit issued by the Electrical Inspector under the provisions of this Code shall expire by limitation and become null and void, if the butlding or work authorized by such permit be not commenced within Sixty days from the date of such permit, or if the building or work authorized by such permit be suspended or abandoned at any time after the work is commenced for a period of sixty days. Before such work can be commenced a new permit shall be first obtained so to do. MAINTENANCE ELECTRJOJAWR Any person, firm or corporation regularly employing one or more electricians for the purpose of installation, alteration maintenance or repair on his or its own premises, shall make month)y reporte covering all installations, additions or al- teration, maintenance or repair on his or its own premises, shall make monthly reports covering all insallations, addi... tions or alterations and shall pay for each thereof the per- mit fees provided for in this ordinance. All such work shall be installed and done in accordance with the provisions of this ordinance, and such work shall be subject to inspection by said Electrical Inspector to the same extent as all other similar work for which such inspection is provided. -3- Ordinance Number SECTION 6. PUBLIC UTILITIES EXEMPTED I The provisions of this ordinance shall not apply to any electrical work performed by any electrical corporation, tele'" phone corporation, telegraph corporation, railroad corporation or street railroad corporation on or with any electrical equiP7 ment owned or controlled and operated or used by, and for the exclusive benefit of, such corporation in the conduct of its business as a public utility. or any other work which any such corporation may be entitled by law to perform without payment of any local tax; but all provisions of this ordinance shall apply insofar as they may consistently with the above be applicable to all other electrical work performed by any such corporation. The terms "electrical corporation," telephone corporation." "telegraph" corporation. "railroad corporation" and"street railroad corporation", are h~rein ussd as said terms are respectively defined in the Public Utility Act of the State of Oalifornia; and such terms shall also be deemed to in- clude similar utilities which are municipally or govern- mentally owned and operated. SECTION 7. INSPECTION (A) APPROVAL. Upon the completion of the electrical wiring in or on any building or structure of any nature, or tent, or pre- mises, except as otherwise exempted in this ordinance, the per- son, firm or corporation installing the same shall notify the Electrical Inspector, who shall inspect such installation, and if it is found by him to be fully in compliance with the pro- visions of this ordinance, he shall issue, as provided for herein, the certificate of inspection or approval tag authoriz- ing connection tothe electrical service ~ the energizing of the installation. 1 (B) PERMISSION TO COVER WORK. It shall be unlawful for any per- son to lath over, seal, cover or conceal any electrical wiring or other electrical equipment, for the installation of which a permit is provided herein, until such electric wiring or other electrical equipment shall have been inspected and approved by the Electrical Inspector. Said Electrical Ins- pector shall have the pQwer to remove, or to require the re- moval of any obstruction which prevents proper inspection of any electrical equipment. 1 (0) OORREOTIONS. All defects shall be corrected within ten daye after inspection and notifications or within such other reason- able time as is permitted by the Electrical Inspector. (D) CONNECTION. It shall be unlawful to energize or cause or per- mit to be energized any electrical wiring coming under the pro- visions of this ordinance, until such electrical wiring shall have been inspeoted and approved by the Electrical Inspector. Provided, however, that the Electrical Inspector may give written temporary permission to furnish electric current to, or the use of electric current through any electrical wiring for a length of time not exceeding thirty days, if it appears to said Electrical Inspector that such electrical wiring may be used safely for such purpose, and that there exists an urgent necessity for such use. -4- Ordina~ce N~mber SECTION g RIGHT OF ACCESS 1 The Eleotrioal Inspector shall have the right during reasonable hours to enter any building in the discharge of his official duties, or for the purpose of making any inspection or test of the installation of any electrical wiring, electrio device or electrioal material contained therein. 1 SECTION 9 HE-INSPECTION The Electrioal Inspeotor is hereby authorized and smpowered to make at such times and as often as in his disoretion it may seem neoessary, a thorough re-inspection of the installation in or on any building, structure or premises of all eleotrioal wiring, eleotric devices and eleotrioal material now installed or that may hereafter be installed within the incorporated City of Seal Beach and when the installation of any such wiring de- vioe or material is found to be in a dangerous or unsafe con- dition the person, firm, corporation or governmental agenoy owning, using or operating the same shall be notified in writ- ing and shall make the neoessary repairs or changes required to place such wiring, device or material in a safe condition and to have such work completed within a period of 10 days after such notice, or within a period speoified by the Eleotrical Inspector in said notice and shall pay such fees as are re- quired by ths provisions of this ordinance. The Electrical Inspector is hereby empowered to disconneot or to order the discontinuanoe of electrical service to Wiring! devices or materials found to be defective until the instal - ation of such wiring device or material has been made safe as directed by the Elec!rical Inspector, and any person, firm, corporation, political subdivision or governmentalegency oxered to disoontinue suoh electrical service shall do so within twenty- four hours after the receipt of such notice and shall not reconnect such service or allow the same to be reconnected until notified so to do by the Electrical Inspector. Provided, however, that no re-inspection shall be made in any dwelling house, while the same is occupied as a dwelling house, without the oonsent of the oooupant thereof. It shall be unlawful for any person, firm or oorporation to hinder or prevent, or to cause or permit to be hindered or prevented, the Electrioal Inspector or his duly author- ized representative from making any electrical inspection pro- vided for in this ordinanoe. SECTION lO. FEES REQUIRED. (A) The fees prescribed in this section must be paid for each elect- rioal installation for which a permit is required by this ijode. (~ The fee for any additional electric wiring, not included in or authorized by a permit shall be the difference between the fee paid when the permit was issued and the fee for eleotric wiring added to the installation by the same person or firm. After final approval has been given by the Eleotrical Inspection Division, a new permit must be obtained for any electrio wiring installed on the same premises. No permit shall be issued to any person, firm or corporation unless all fees for permits or additionals to permits due are paid in full. In the event that any inspection fee due for any previous in- spection shall not have been paid as reqUired by this Code, such fee shall be paid upon request and before any subsequent inspec- tion for any eleotrioal installation shall be made. (b) ( c) Each point at which a lamp holding device or group of lamp holding devices is attached shall be considered to be an elect~ic outlet for which a fee is provided and required and each lamp holding device or group of lamp holding devices shall be consid- ered to be an electric fiBture for which a fee is provided and reqUired. -7- I I I Ordinance Number (d) Failure to obtain a permit and pay the fees therefor before commencing work shall be deemed prima facie evidence of violation of the provisions of this Code. (~ DOUBLE FEES Whenever any person shall willfully commence any electric wiring for which a permit is rsquired, without obtaining a permit therefore, he shall be required to pay double fee for such electric wiring unless he obtains the permit before twelve o'clock noon on the first day the office of the Electrical Inspection Division is open for public business after the elsctrio wiring was started. The payment of a double fee herein required shall not prevent or be a defense to any prosecution for the violation of any of the provi- sions of this Code. Except as otherwise provided herein, all Electrical Installations shall be in strict conformity to the requirements as set forth in the following publications: 1. The "National Electrical Code, 1951 Edition, Anniversary Edition". 2. Electrical Safety Orders of the Division of Industrial Safety of the State of Oalifornia. 3. The Rulee for Overhead Line Construction, General Order No. 95 of the Public Utilities Oommission of the State of Oalifornia. ~. Eleotrical Service Requirements of the Southern Oalifornia Edison Company. THAT Article llO,be chang~d, modified and amended to read as follows: 1. APPROVAL. The conduotors and wquipment required or per- mitted by this code shall be acceptable only if approved. 2. WIRING METHODS. Only wiring methods recognized as suitable are included in this code. The recognized methods of wiring may be installed in any type of building or occupancy ex- cept as otherwise provided in this code. 3. MECHANICAL EXECUTION OF WORK. Electrical equipment shall be installed in a neat and workmanlike manner. ~. MARKING. The makers name, trademark or other identifi- cation symbol shall be placed onall electrical equipment. Other markinge shall be provided giving voltage, current, wattage, or other ratings as are prescribed in the National Electrical Code. 5. All wiring in or on oommeroial and or industrial structures shall be in a metal protected wiring system. THAT Article 210 (Branch Circuits), be ohanged, modified and amended . to rsad as follows: 2115 (a) LIGHTING AND APPLIANCE OIRCUITS. For the lighting and for appliances, branch circuits shall be provided for a computed load not less than that determined by Section 2116. (~) RECEPTACLE CIRCUITS (DWELLING OCCUPANCIES). For the small appliance load in kitchen, laundry, pantry, dining room and breakfast room, one or more branch circuits shall be provided for all receptaole outlets (other than clock outlets) in these rooms, and such circuits shall have no other outlets. The con- ductors for such circuits shall not be smaller than *12 A.W.G. protected at 20 amperes. The matimum number of outlets on this circuit shall not exceed twelve (12) outlets. -~ ~ I I I Ordinance Number (b) RECEPTACLE CIRCUITS (DWELLING OCCUPANCIES), oontinued. 1. The outlet for a garbage disposal and diswashing unit shall be an individual circuit. One of such units may be connected to the 20 ampere oircuit with not more than six (6) reoeptaole outlets. 2. The outlet box for suoh units shall be grounded to the oold water line. 3. Suoh outlet box shall be provided with a disconnect- ing switch, preferably above the drain board level. ~. The motors of suoh units shall be oonneoted in a permanent manner with metal oovered conductors. (0) ~IGHTING CIRCUITS (DWELLING OOCUPANCIES). 15 Ampere branoh circuits shall not have more than 15 outlets. In addition to the small applianoe circuit, all other 20 ampere oirouits shall not exoeed 15 outlets. 2116 (CALOULATION OF LOAD) The branch circuit load for ,lighting and applianoes shall be oomputed in accordance with the pro- visions of this seotion. Wtrera,:~normal operation the maxi- mum load of a branoh cirouit will oontinue for long periods of time, suoh as store lighting and similar loads, the minimum unit loads speoified in this section shall be inoreased by 25~ in order that the wiring system may have suffioient branch circuit and feeder oapacity to insure safe operation. (a) GENERAL LIGHTING. For general illumination: 1. In Listed Occupanoies. In the ocoupancies listed in the table in Section 2203, a load of not less than the unit load of column A shall be included for eaoh square foot of floor area. All receptacle outlets of 15 ampere or less rating in single-family and multiple family dwellings and in guest rooms of hotels (except those connected tone receptacle cirouits specified in Paragraph b. of Section 2115) may be considered as outlets for general illumination, and no additonal load need be included for such outlets. The provisions of paragraph b. of this section shall apply to all other receptacle outlets. 2. In Other Oooupancies. In other ocoupanoies, a load of not less than the unit load specified in paragraph b. of this section shall be included for eaoh outlet. (b) OTHER LOADS. For lighting other than general illumination and for appliances other than motors, a load of not less than the unit load specified belOW shall be insluded for each outlet. 1. Outlets supplying specifio applianoes ~nd other loads. Ampere Rating of appliance. 2. Outlets supplying heavy-duty lampholders. 5 amperes each. (0) EXOEPTIONS. The minimum load for outlets specified in paragraph b. shall be modified as follows: 1. Ran~es. For household electric ranges, the branch cirouit load may be computed in accordance with Table 29, Ohapter 10, of the National Electrical Oode. -9- 1 1 I Ordinance Number 2. Show-Window Lill:htinil:. For show-window lighting a load of not le8s than 200 watts for each linear foot of ahow window, measured horizontally along its base, may be al~owed in lieu of the speoified load per outlet. 2121. CONDUCTORS. Cirouit oonduotors shall oonform to the following: (a) CARRYING CAPAOITY. Shall have a oarrying capaoity of . not less than the rfting of branch circuit and not lsss than the maximum load to be served. 2122. OVER CURRENT PROTECTION. The rating or setting of overcurrent devioes shall conform to the following: (a) RATING. Shall not be in excess 'of the oarrying oapaoity of the cirouit conduotor. SINGLE APPLIANCE. Shall not exceed 150~ of the rating of the applianoe, if the cirou~t supplies only a single applianoe of 10 ampere or more rating. TYPE OF OVERCURRENT PROTECTION. In residential and oommeroial installations, non-tamperable fuses or breakers shall be used. (b) ( 0) For other requirements, refer to National Electrical Code. 2124. REOEPTACLE OUTLETS REQUIRED. Reoeptacle outlets shall be installed as follows: (a) GENERAL. Where portable cords are used, except where the attachment of cords by other means is ~pecifioally permitted. (b) DWELLING TYPE OCCUPANCIES. In every kitchen, dining room, breakfast room, living room, parlor, library, den, sun room, recreation room and bedroom, one receptacle outlet shall be provided for every twenty linear feet or major fraction thereof of the total distance around the room as measured horizonally along the wall at the floor line. At least one receptacle outlet shall be installed for the connection of laundry applianoes.- This reoeptacle shall be of a three pole type designed for grounding. 2126. PERMISSIBLE LOADS. Individual branoh circuits may supply any loads. Branch circuits having two or more outlets may supply only loads as follows: (a) 15 and 20 AIIJ!E8.1il BRAR'OH OIRCUITS. Lighting units and or applianoes. The total rating of fixed appliances shall not exceed 50% of the branoh circuit rating if lighting units or portable appliances are also supplied. THAT Article 220 (Feeders) be changed, modified and ame~d to read as follows: 2202. VOLTAGE DROP. The size of the feeder oonduotors should be suoh that voltage drop up to the final distribution point for the load as computed by Section 2203 will not be more than 3% for power loads, and not more than 1% for lighting loads, or combined lighting and power loads. 220). CALCULATION OF LOAD. The oomputed load of a feeder shall be not less thAn the sum of all branoh circuit loads supplied by the feeder, as determined by Section 2116, eubjeot to the following provisions: (a) GENERAL LIGHTING. THAT Article 230 (Services) be changed, modified and amended to read as follows: Services shall oomply with' Southern California Edison requirements. 2304. SIZE OF SERVICE CONDUCTORS. Service conductors shall have adequate carrying capacity to safely conduct the ourrent for the load supplied without a temperature rise detrimental to the insulating covering of the conductors, and shall have adequate mechanical strength. Ungrounded metal lighting fixtures, lamp holders and face plates shall not be installed within g fest verti- cally or 5 feet horizontally of laundry tubs, bath tubs, shower baths, plumbing fixtures or other grounded metal work or grounded surfaces. Metal pull chains used at these locations shall be provided with insulating links. ~216. METHODS OF GROUNDING. SECTION 24. PEWALTIES. Any person, firm or oorporation violating any of the pro- visions of this ordinance shall be guilt;, of a m~emeanor upon oonviotion thereof shall be punishable by a fine of not more than Three Hundred Dollars ($:300.00) or by im- prisonment for a period of not more than three (;3) months, or by both such fine and imprisonment. Each person, firm or corporation vXlating any of the provisions of this ordinance shall be deemed guilty of a separate offense for each day or portion thereof during which such viola- tion continues and shall be punishable therefor as herein provided. SECTION 25 That Ordinanoe No. 205 and and all other Ordinances or parts of ordinances in conflict herewith are hereby replealed. SECTION 26 I The City Clerk shall certify to the passage of this Ordinance by the City Council of the City of Seal Beach and cause the same to be published onee in the Seal Beach Post & Wave, a newspaper of general oiroulation printed, published and circulated in said City.
