ORDINANCE NO. 4,"90
AN ORDINANCE OF THE CITY OF SEAL BEACH
DESIGNATING THE DUTIES OF THE CITY ATTORNEY;
PROVIDING FOR ADDITIONAL.COMPENSATION;
PROVIDING FOR AN EMERGENCY; PROVIDING FOR
REP EAL OF ALL ORDINANCES IN CONFLICT HERE~
WITH; AND PROVIDING FOR PUBLICATION THEREOF.
The City Council of the City of Seal Beach, California,
does ordain as follows:
Section ~: It shall be the duty of the City Attorney
of the City of Seal Beach to advise the city offioials in all
legal matters pertaining to city business; he shall frame all
Ordinances and Re~olutions required by the City Council, of the City
of Seal Beach; he shall perform other legal services required from
time to time by the City Council. In addition to the foregoing
duties, it shall be the duty of the City Attorney of the City of
Seal Beach to represent the City in all other legal matters and to
represent the City in all civil litigation involving the City.
Section 2: The City Attorney shall receive such compensa-
tion as is allowed by the City of Seal Beach by resolution, ordinanoe,
or minute order.
Section ~: It is hereby declared that the passage of this
ordinance is an urgency measure for the immediate preservation of,
the public peace, health and safety, ana the following is a declara-
tion of the facts constituting such urgency:
The present compensation of the City Attorney, as
determined by resolution, is the sum of Three Hundred Dollars
($300.00) per month, payable monthly; there is in full force and
effect in the City of Seal Beach an ordinance commonly designated
as an anti-drilling ordinance, and the City Council is informed
that a oertain oil company, contraotors, and employees of the
contractors and oil company have commenced operations within the
terri torial l1m1 ts of the City for the purpose of constructing an
island in the waters of the Pacific Ocean, in violation of said
anti-drilling ordinance, and the City Council feels that it is nec-

oessary that legal proceedings be taken on behalf of the City to
prevent said persons and corporations, and any other psrson or
corporation, from proceeding with said operations, and it will be
necessary for the City Attorney to begin such proceedings as may be
necessary in order to enforce the provisions of the aforesaid ant~-
drilling ordinance and that the City Attorney should be compensated
for additional work to be performed in the future by him in addition
to the present salary of the city Attorney, whioh has been determined
by appropriate resolution, and that at this time there is no
ordinance in effect in the City of Seal Beach setting forth the
duties of the City Attorney of the City; that it is necessary that
immediate proceedings be instituted on behalf of the City in order
to protect the oitizens of Seal Beach and property owners insofar as
the above ordinance is concerned; that it is expected that considerable
litigation will be necessary in order to protect the citizens of
Seal Beach; based upon the foregoing facts, the City Council hereby
declares this ordinance to be an emergency measure, and this ordinance
shall take effect immediately upon being adopted and passed by the
City Council of the City of Seal Beach.
Section 4: All ordinances or parts of ordinances in conflict
with this ordinance are hereby repealed.
Section 5': The City Clerk shall cause this ordinance to be
published onoe in the Seal Beach "POST AND WAVE", a newspaper printed,
published and circulated in said City of Seal Beach; and said
ordinance shall take effect immediately after its passage and approval
by the City Council of the City of Seal Beach.
PASSED, ADOPTED, AND APPROVED this 2nd day of September, 195'2.
