ORDINANCE No._~~k AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING ORDINANCE NO. 181, The City Council of the City of Seal Beach, California, does or- dain as follows: SECTION 1: Section 1 of Ordinance No, 181 of the City of Seal Beach, California, is hereby amended to read as follows: "SECTION 1: That the following monthly rates for the use of wate by the inhabitants of the City of Seal Beach, California, are hereby establish- ed. and the water department is hereby authorized and directed to charge and collect the same in accordance with the provisions of this ordinance. a. Where water is furnished through a meter for domestic use and all business purposes, other than agricultural: Per one hundred cubic feet $0.20 b. The monthly charge for private fire lines shall be as follows: For each l-inch or part thereof per month $1. 00 For each 2-inch fire line, per month 1. 25 For each 3-inch fire line, per month 2.00 For each 4-inch fire line, per month 2.50 For each 6 -inch fire line, per month 5.00 c. For all other purposes not provided for in this ord- inance, the rate shall be fixed by the Water Superintendent. " SECTION 2: SECTION 5 of Ordinance No. 181 of the City of Seal Beach, California, is hereby amended to read as follows: "SECTION 5: At the time of application for water service the owner of the property, concerning which service is applied for, shall sign an application together with the occupant of the premises to which water is to be rrurnished, which application shall provide that the said owner agrees that the water rate, charge or account, all ot,ler rates or charJes provided for in -1- .' 1 2 1 3 4 5 6 7 8 9 10 11 12 13 14 15 I 16 17 18 19 20 21 22 23 24 25 26 27 1 28 29 30 31 32 '. Ordinance Number . 1 ... ~ '" in this ordinance shall be charged against the property on which furnished an shall be deemed delinquent at the same time and in the same manner as the next regular water bill and shall be a lien against the property where furnish- ed. "In addition to any other relDedy provided herein for the enforce- ment and collection of any water rate, charge or account, all rates or other charges provided for in this ordinance shall be charged against the property on which furnished and against the owner or owners thereof and shall be deem ed delinquent at the same time and in the same manner as the next regular water bill and shall be a lien against the property where furnished and if for any cause any sums owing therefor become delinquent, the water shall be shut off and in no case shall it be turned on to the same property until all such delinquencies shall have been paid in full, and such property owner shall be responsible to the City of Seal Beach, in an action waged in any court of com- petent jurisdiction for the amount of all such rates or other charges as may be due and unpaid, together with all penalties provided herein anc costs. No change of ownership or occupation shall in any way effect the application of this section. " SECTION 3: SECTION 9 of Ordinance No. 181 of the City of Seal Beach, California, is hereby amended to read as follows: "SECTION 9: When property is located upon a street in which a water main is laid, same shall be connected with the water system by a cop- per service pipe from main to curb line, a stop cock placed inside the line of the street curb, together with a meter, meter box and shut off box. How- ever, nothing in this paragraph shall interfere with the Water Department in- stalling a service pipe of sufficient size to allow off leading branches to the right or left in the parking or street for the purpose of supplying two or more separate properties. Services larger than four inch shall be charged for at cost of material and labor used, plus ten per cent for supervision, the charge for same shall be due and payable as soon as the work is completed. These prices shall include the service connection com- plete, including meter and meter box set in pLace, ex- cept when meters are required under a sidewalk exca- vated to the curb Line, in which case the property owner shall construct a cement box for said meter, open on top side only and of such size and in such location as may be designated by the Superintendent of the Water Department. For a monthly consumption from 7200 cu. ft. to l4400 cu. ft. a l"meter. For a monthly consumption from l4400 cu. ft. to 21600 cu. ft. a 1 l/2" meter. For a monthly consumption from 21600 cu. ft. to 36000 cu. ft. a 2" meter. For a monthly consumption from 36000 cu. ft. to 64800 cu. ft. a 3" meter. For a monthly consumption from 64800 cu. ft. to l29600 cu. ft. a 4" meter. For a monthly consumption from l29600 cu. ft. to 216000 cu. ft. a 6" meter. The Superintendent of the Water Department shall have the discre tionary right to order a battery of smaller meters installed in place of one large meter if such is deemed necessary by him. SECTION 6: SECTION l4 of Ordinance No. l8l of the City of Seal Beach, Califcrnia, is hereby amended to read as follows: "SECTION l4: The following rates for the use of water by consum ers within the City of Seal Beach for independent private fire lines used ex- elusively for fire protection, whether said fire line be connected with automa tic sprinkling systems or to hose attachments are hereby fixed and the Water Department is hereby authorized and directed to charge and collect the same in accordance with the provisions of this Ordinance: For each 1 inch fire line, per month $l.OO For each 2 inch fire line, per month l.OO For each 3 inch fire line, per month l.50 For each 4 inch fire line, per month 2.00 For each 6 inch fire line, per month 4.00 No private fire line shall be used for any purpose other than the extinguishment of fires unless the same be equipped with a meter, in which event the regular meter rates shall be charged in addition to the foregoing charges for fire line service. All faucets, hose, sprinklers, nozzles or water and plumbing equ p- ment must be shut off promptly upon an alarm of fire being given and the wat er not to be turned on again until the fire is known to be extinguished. " SECTION 7: SECTION l6 of Ordinance No. l8l of the City of Seal -4- , ' 1 2 I 3 4 5 6 7 8 9 10 11 12 13 14 15 I 16 17 18 19 20 21 22 23 24 25 26 27 1 28 29 30 31 32 Ordinanpe Number , , 1 Beach, California, is hereby amended to read as follows: "SECTION 16: All water meters, service pipes, curb cocks and other fittings installed by the water department shall remain at all times the property of the City of Seal Beach and shall be maintained and repaired free when rendered unserviceable through ordinary wear and tear, (except in case of replacement of old services with copper service pipe), provided, that when replacements, repairs or adjustments of any meter, service pipe, curb cock or other fitting is rendered necessary by the act, neglect or carelessness of the owner or occupant of the pl'emises, any expense caused to the department thereby shall be charged against and collected from the owner of the premise at the same time and in the same manner as is provided for in Section 3, her - of. " SECTION 8: The City Clerk shall certify to the adoption of this Ordinance and cause it to be published once in the Seal Beach Post and Wave, a newspaper printed, published and circulated in the City of Seal Beach, Cal- ifornia, and this Ordinance shall take effect and be in force thirty(30ldays from and after its final adoption by the City Council. The above and foregoing Ordinance was introduced at a regular meeting of the City Council of the City of Seal Beach held on the 19th day of May, 1953, and was finally passed and adopted on the day of June, 1953, by said City Council at a regular meeting thereof, by the following vote to wit: AYES: NOES: ABSENT: Councilmen: Councilmen: Councilmen: The foregoing Ordinance is signed and approved by me this day of , 1953.
