WHEREAS, this City Council has received from Standard Gas Company, a corpora- tion, organized and existlng under and by virtue of the laws of the State of Idaho, and engaged in the business of transporting oil, gas and other substances within, through and across various municipalities and commmities in the State of California, incJ.uding the City of SesJ. Beach, an application for a franchise, which application states that the purpose for which the franchise therein applied for is desired is to construct from time to time and for a period of thirty (30) years to maintain, operate, repair, renew, change the size of and remove or abandon in place pipes, pipe lines, conduits, wires, cables and other appurtenances for the transportation of petroleum, liquid hydrocarbon substances, gas, natural gasoline, water, waste. water, mud, steam and other substances and the transmittal of electricity and communications signals to or from Standard Oil Company of California's State Lease P.R.C. 3905.1, in, under, along or across public streets and other public places in the City of Seal. Beach, State of California; and WHEREAS, said application states that the public streets and public lands in, under, along or across which said pipes, pipe lines, cables, wires, conduits and appurtenances will be constructed are Central Avenue, First Street, Ocean Avenue, Seal. Way and that portion of the beach bounded by San Gabriel river, Ocean Avenue, the southwesterly extension of the center line of Second Street and the high tide line; and WHEREAS, said application states that the sole and excJ.usive purpose for which said pipes, pipe lines, wires, cables, conduits and appurtenances will be used will be to serve the operations of Standard Oil COIIWallY of California, its subsidiaries, successors or assigns on State Lease P.R.C. 3905.1 by transportl.ng and transmitting to or from said State Lease, petroleum, liquid hydrocarbon sub- stances, gas, natural gasoline, water, waste water, mud, steam, electricity, communications signals and other substances; and WHEREAS, said a,pplication further states that the applicant, if granted the franchise therein applied for, will pay to the City of Seal Beach, during the life of such franchise, two per cent (~) of the gross annual receipts of applicant arising from the use, operation or possession of said franchise; proVided, however, that such payment shall in no event be less than forty cents (4016) per cubic foot of street space occupied pursuaIIt to the franchise. For purposes of this minimum payment, the street space required for a pipe line or conduit, together with protective coverl.ng, pipe connections, cathodic protection facilities, pipe casings, and other minor appurtenances, shall be taken as equivalent to the volume occupied by a cylinder of equal length having a diameter one inch (1 ") greater than the nominal internal diameter of the pipe or conduit, but in no case with an equivalent cylinder diameter less than six inches (6"), and the payment rate therefor shall be computed to the nearest tenth of a cent per lineal foot of pipe. Street space required by any larger appurtenances such as manholes, valve boxes or gas drip boxes shall be compute~ from the outside dimensions of the structure.
