J3%5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH OF INTENTION TO ANNEX CERTAIN UNINHABITED TERRITORY; DESIGNATING THE TERRITORY AS "ANNEXATION NUMBER 65-1; DESCRIBING BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR, AND PLACE WHERE ANY PERSON OWNING REAL PRO- PERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY PROTEST OR APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF SEAL BEACH. THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, the proposal for annexation of the territory hereinafter described to the City of Seal Beach was submitted to the Boundary Commission of the County of Orange, State of California, and reported on by said Boundary Commission with respect to the definiteness and certainty of the proposed boundaries; and WHEREAS, the proposal for annexation of the territory herein- after described to the City of Seal Beach was submitted to the Local Agency Formation Commission of the County of Orange, State of California, and said Commission did on the 18th day of August, 1965, approve said annexation to the City of Seal Beach, and WHEREAS, the territory proposed to be annexed to said City of Seal Beach is situated in the County of Orange, State of California, and is contiguous to the City of Seal Beach and is uninhabited terri- tory; and WHEREAS, the City Council finds from evidence and reports that at the time of submission to the Boundary Commission of the descrip- tion of the territory proposed to be annexed, said territory did not form a part of any municipal corporation and that said territory was uninhabited and is contiguous to the City of Seal Beach; and WHEREAS, the City Council finds from evidence and reports received, that the boundaries of the territory so proposed to be annexed to the City ,of Seal Beach are as contained in the attached description marked EXHIBIT A. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES RESOLVE AS FOLLOWS: Section 1. That such proposed annexation be designated as "ANNEXATION 65-1" and that notice of such proposed annexation be given as hereinafter provided. -1- < I 1 I '. Resolution Number Section 2. That a public hearing shall be had upon the date stated, not less than forty (40) nor more than sixty (60) days after the passage of this resolution, unless the owner or owners of all of the territory to be annexed have petitioned for annexation or filed their consent to such annexation, in writing, with the City Council, in which event the hearing may be set by the City Council at any time after the completion of publication and posting of this resolution as hereinafter provided. Section 3. That the City Council does hereby fix the Fourth day of October, 1965, at the hour of 8:00 p.m., in the City Council Chambers in the City Hall, as the day, hour, and place when and where the City Council will hear protests made by any owner or owners of the real property within the territory proposed to be annexed; and that, at any time before the hour set for hearing objections, any owner of property within said territory may file with the City C~erk written protest against such annexation. Said protests shall be in writing and shall state the name of the owner of the property affected and the description and area of the property in general terms. , ' Section 4. That the City Clerk be, and he is hereby, authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in a newspaper of general circulation in the City of Seal Beach, and also in a newspaper of general circulation published outside of the City of Seal Beach, but in the County of Orange in which is located the territory pro- posed to be annexed to the City of Seal Beach, and that such publica- tion shall be completed at least twenty (20) days prior to the date of the hearing hereinabove specified; the City Clerk is further authorized and directed to post a copy of this resolution, not less than twenty (20) days before such hearing, in at least three con- spicious places within the territory so proposed to be annexed. Section 5. That the City Clerk be, and he is hereby, authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date when these proceedings were initiated, at the address shown on said assessment roll or as known to said Clerk, and to any person who has filed his name and address and the designation of the lands in which he has any interest, either legal or equitable, with said Clerk. The foregoing notices shall be given not less than twenty (20) days before the first public hearing as herein provided on the proposed annexation. -2- I I 1 ., Resolution Number . ' Section 6. That the proceedings for said annexation have been initiated by the City Council of the City of Seal Beach as legislative body of said city on its own motion, and its reasons for desiring annexation are that the area designated, may not have the benefit of important and necessary services, in particular, police, fire, and water services, unless it is annexed to the City of Seal Beach; and that this annexation has been requested by the owners and the developers of substantial portions of said annexation and further, that this annexation is important to the continued growth and develop- ment of the City of Seal Beach.
