BEACH CALLING AND GIVING NO'.l'ICE OF i'BE HOLDING OF A
SPECIAL MUNICIPAL EIBC'l'ION TO BE HELD ON TT,lESDAY, THE

PROPOSITION OR ME:ASORE REIATING TO THE ADOPTION OF THB
CITY MANAGER FQRM OF GOVERNMEN'l' IN THE CITY OF SEAL
BEACH.
WHEREAS, the City Council of the City of Seal Beach desires
8 0 sUbmit to the qualified electors of said City a certain question,
9 roposition or measure relating to the adoption of the C.ity Mansqer
10 form of gover~ent in said City, and

WHEREAS, the City Council of Seal Beach has heretofore, an
12 the 5th day of JUly, 1960, adopted Resolution No. 1068 requesting the
13 Board of Supervisors of the County of Orange to consolidate such
'SECTION 1:
'!'hat pursuant to the right and power vested in
19 of California relating to elections, there shall be and there is
20 hereby called and ordered held in the City of Seal Beach, County of
21 Orange and State of california,r on Tuesday, the 8th day of NoveIl1ber,
22 1960, a Special Municipal Election of the qus~ified electors of said
23 City for the purpose of submitting to the qualified electors a cer-
24 tain question, proposition or measure relating to the adoption of a
25 ~ity Manager Porm of government.

AN ORDINANCE 'ENACTED BY-THE PEOPLE
OF THE CITY QF SEAL BEACH CREATING
THE CITY MANAGER FOBM OF GOVERliIMENT
IN THE CITY AND DEFINING THE RES~ONSI-
BILITY, AtlTBOlUTY ANI! DUTIES OF SAID
OFFICE.
The people o~ the city of Seal Beach do hereby ordain as
. follows:
SECTION I: The office of City Manager of the city of Seal
Beach is hereby created and established. The city Manager shali
be appointed by the City Council solely on th~ b~sis of his ad-
,m1nistrative and ~xecutive qualifications and abilities1 and shall
hold office at and during the pleasure of the Council.

SECTI~N 2:' ELIGIBILITY. Residence in the-City of Seai Beach
, ,
at the time Of-appointment shall not ~e required as a condition 'of
appointment, ,but within 6ne hundred eighty (180) days thereafter

the City Manag-er must become a resident of the City or the City

~ouncil shall declare the offiee to be vacant. No person elected
to membership in-the City Council' shlilll.. subsequent to such
election, be eligibie for'~pp~intment as City Manag~r until pne
, year has elapsed after completion of his term of office.
SECTION. 3: UNCLASSIFIED STATUS,. The position of City Manage
shail be in the unclassified service of the City and he shali not
be covered by Civil Service provisions.
SECTION 4: BOND. The City Manager shall fur~ish a. corporate
surety bona. to be approved by the City,Council in such sum as may

in. He shall be responsible_for the efficie~t administration of
all of the affairs of the City within his jurisdiction. In-addi-

and not as a limitation thereon, it shall be his duty and he shall
have the power to perform or cause to be,' performed the f61lowing ,
functions:
A. To enforce all laws and ordinances of the
City and to see that all franchises, ~er~'
mits and privileges granted by the City
are faithfully observed.

to develop a comprehensive personnel program.

such other powers as may be delegated to
him from time to time by resolution, ordinance
or other action of the City Council.
SECTION 8: COUNCIL POLICY. The City CQlincil and its
members shall deal with the administrative services of the City
only through the City Managerr except for the purpose of inquiry,'
and neither the City Council nor any member thereof shall give or-
ders to any subordinates of the City Manager.
SECTION 91 RESIGNATION. ',tIhe City Manager shall notify
the City Council at least thirty (30) days in advance of his in-
tended resignation. Failure to do so shall be grounds for with-
holding any payment du~ him for his services. This provision may,
however, be waived by majority vote of the City Council.
S.EC'l'ION 10: REMOVAL. The removal of the City Manager
shali be only upon majority vote of the whole City Council in
regular n\eeting. In case of intended removal, the city Council
shall furnish the City Manager with written notice stating the in-
tention to remove and the reasons therefor at least thirty (30)
days before the effective date. In such removal, the city Council
shall use its uncontrolled discretion and its action shall be final

date of this ordinance, the City Council of the City of Seal Be~ch
