I I 1 1 2 3 4 5 6 7 .' -. .:- ~- . , RESOLUTION NO. lJOU A RESOLUTION OF INTENTION OF THE CITY 00UNCIL OF THE CITY OF SEAL BEACH TO IMPROVE THIRTEENTH STREET (13th), FOURTEENTH STREET (14th), FIF- TEENTH STREET (15th), SIXTEENTH STREET (16th), AND SEVENTEENTH STREET (17th) from ELECTRIC AVENUE TO' U. S. AiJrERNATE 101, and LANDING AVENUE from ELEVENTH STR.EET TO BAY BOULEVARD, and ELEVENTH STREET from ELECTRIC AVENUE TO TWELFTH STREET 8 The city Council of the City of Seal Beach does hereby 9 resolve as follows: 10 Section 1: That the City Council intends to order the 11 improvement of Thirteenth Street (13th), Fourteenth street (14th), 12 Fifteenth street (15th), Sixteenth Street (16th), and Seventeenth 13 Street (17th) from Electric Avenue to U.S. Alternate 101, and 14 Landing Avenue from Eleventh Street to Bay Boulevard, and Eleventh 15 Street from Electric Avenue to Twelfth Street, by the construction 16 of concrete curbs, gutters, cross gutters, drive approaches, side- 17 walks and paving, doing all necessary grading and any other rela- 18 ted work required. 19 Section 2: That the aforesaid improvement shall be per- 20 formed in accordance with plans and specifications prepared in 21 the offices of Voorheis-Trindle & Nelson, Inc. and which were 22 approved by the City Council by Resolution No. 1099, which plans 23 and specifications are on file in the office of the City Manager 24 and reference is hereby made to said documents for a detailed 25 description of said improvement and for a description of the grade 26 27 to which the improvement is to be made. Section 3: That said improvement is designated as "1911 28 Improvement District No.1" and is also referred to as "Northeast 29 Improvement District". 30 Section 4: That said contemplated improvement is of more 31 than local or ordinary public benefit and said City Council hereby 32 determines and declares that the District to be benefitted thereby Page 1 . '=i 1 and to be assessed to pay the costs and expenses thereof is shown 2 in a report of the City Engineer made pursuant to Sections 2824 3 I and 2825 of the streets and Highways Code, which report has b~en 4 approved by the City Council and is on file in the office of the 5 City Clerk, to which reference is hereby made for a description of 6 the Assessment District; and all expenses for said improvement 7 are to be paid by the Assessment District. 8 section 5: Notice is hereby given that proceedings have 9 been taken by the City Council in the form, time and manner under 10 the I'Special Assessment Investigation, Limitation and Majority 11 Protest Act of 1931", as contained in the streets and Highways Code 12 and that all requirements of said Act have heretofore been complied 13 with. 14 15 Section 6: The City Council hereby determines and de- clares that no protests were made at the hea:cing on the report 16 required by Secticns 2824 and 2825 of the streets and Highways Code 17 Section 7: The City council hereby determines and de- 18 clares that the proceedings for the aforesaid improvement shall be 19 taken under and pursuant to that portion of the streets and High- 20 ways Code designated as the "Improvement Act of 1911" and that 21 serial bonds shall be issued in the manner and form provided for 22 in said Streets and Highways Code, bearing interest at the rate of 23 siX per ,cent (6%) per annum, to represent each assessment of Fifty 24 Dollars ($50.00) or more remaining unpaid for thirty (30) days 25 after the date of recordation of the warrant. ,Said serial bonds 26 27 shall extend over a period ending nine (9) years from the second day of January next succeeding the next September first following 28 their date. 29 Section 8: Notice is hereby given that on the fourth day 30 of April, 1961, at the hour of 7:30 P.M., at the Council chamber 31 in the City Hall, any and all persons having any objections to the 32 proposed work and improvement may appear before the City council Page 2. .... ,- . 1 I 2 3 4 5 6 7 8 9 10 11 12 13 1 14 15 -16 } 17 " 18 ('.... ~ ,19 20 21 22 23 24 25 1 26 27 28 29 30 31 32 Page 3. .' Section 9: The city Clerk shall certify to the passage of this Resolution and shall cause the same to be published twice in the Seal Beach "Post and wave", the first of such publications to be not less than ten (10) days prior to April 4, 1961. Notices of said hearing of April 4, 1961, shall be mailed to the owners of all property within said Assessment District, in accordance with the ImprQvement Act of 1911.
