Home My WebLink AboutCC Ord 357 1948-06-15 ,~ I ORDINANCE NO.~~ AN ORDINANCE OF THE CITY' OF SEAL BEACH, CALIFORNIA REGULATING THE ISSUANCE OF PERMITS FOR FOOD HANDL- ING BUSINESSES; PROVIDING A PENALTY THEREOF: REPEAL- ING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT I HEREWITH TO THE EXTENT OF SUCH INCONSISTANCY AND NO FURTHER. The City Council of the City of Seal Beach does ordain as~ follows. .1 I Section 1: It shall be unlawful for any person, firm or corpo- ration owning, controlling or leasing, acting as agent for, conduct- ing, operating or managing any resturant, cafe, lunch counter, cafateria, soda fountain, ice cream parlor, soft drink stand, fruit and vegetable stand, grocery, meat market, bakery, popcorn, peanut or other food vending stands or stations, or food processing or manufacturing plants, bottling plants, or other places or vehicles in the City of Seal Beach, where food is prepared for sale, sold distributed, or displayed for sale, to bonduct or operate, or cause or permit to be conducted or operated in said City of Seal Beach, such resturant, cafe, lunch counter, cafateria, soda fountain, ice cream parlor, soft drink stand, fruit and vegetable stand, grocery, meat market, bakery, popcorn, peanut or other food vending stands or stations, or food processing or manufacturing plants, bottling plant or other places or vehicles where food is prepared for sale, sold, distributed, or displayed for sale, or for any person to sell, or offer for sale, or cause or permit to be sold or offered for sale, any food or drink therein or therefrom without first applying, for and receiving from the Health Department of the ab~tQfdfealrR~eqh California, a permit therefor. A permit for which application is made under the provisions of this Ordinance, may be granted at any time during the year, but all I . permits granted hereunde~ shall expire concurrently w~th the City businese license issued for the corresponding period. A permit may be temporarly suspended by the health office upon violation by the holder of any law, ordinance or regulation governing food sanitation or revoked after a hearing by the health officer. Section 2: It shall be lawful for any member or employee of the I -1- '" . . Ordinance Number' -2- I' Health Department of the ~1~ytbf~Seal Bea~hCallfornia, to enter and go upon any premises herein mentioned at any time for the purpose of inspecting the same~nd any member of the Health Department may require any person owning a permit under this Ordinance to produce the same for inspection. ~f such inspection be refused, the permit shall be forthwith revoked. Section 3: That any person violating any of the provisions of ' this Ordinance shall be deemed guilty of a misdemeanor and upon con viction thereof shall be punishable with a fine not exceeding Three Hundred Dollars ($300.00), or by imprisonment in the County Jail of the County of Orange for a period of not exceeding three (3) months or both fine and imprisonment. PROVIDED, that this Ordinance 'I shall not apply to cigar stands or other places or vehicles of bui- sness where no food of any kind or nature is offered for sale or sold other than candy or soft drinks received in sealed packages, or boxes are not broken prior to sale thereof. Section 4: All ordinances or parts of ordinances inconsistent with this ordinance are hereby repealed to the extent of such inconsistency and no further. Section 5: The City Clerk shall cause this Ordinance to be published once in the Seal Beach EElS ~~<<, a newspaper of gen- eral circulation published and circulated in said City, and said Ordinance shall the~eupon take effect in the manner and at the time as provided by Law.
