The City Council of the City of Seal Beach, 4 5 6 7 California, does hereby ordain as follows: 8 S3:cTION 1. The term "open fire" as used in this ordinance shall be construed to mean and shall 9 mean fires built in the open air and outside of closed structures and buildings. 10 SECTION 2: It shall be unlawful for any person 11 to ignite, kindle, start or maintain an open fIre 12 on any public or private proper,ty within the City ~~~ ~"the City of Seal Beach between the hours f~~ ~~et and one hour after sunrise on any daX, 13 providingl however, that it shall not be unlawful to ignite, k ndle, start or maintain an open fire in 14 designated fire rinLs provided for such purpose and 15 located upon the pUblic beach areal provided fur"tIler, that any person or persons who ignlte, kindle start 16 or maintain an open fire in said designated flre rings must extinguish said fire before l:t. o'clock, ~~t::h:l;.. 17 SECTION 3: It shall be unla\'1fUl for any person 18 to igni te, Idndle, start or maintain an open fire upon any oeach within the limits of the City of Seal 19 Beach, between the hours of fl}Al'l1 ~'^' and one hour after sunrise. SECTICfI 4: Anr person who shall violate any 21 provision or this ord nance shall be deemed guilty of a misdemeanor and upon conviction th~reof shall 22 be ~untshed by a fine of not exceeding ~300.00, or by lmprisonment in the City Jailor in the County Jail 23 for not to exceed three months, or by both such fine and imprisonment. . SECTION 5: All ordinances or parts of ordinanc ~ 25 in conflict TIith this ordinance are hereby repealed. 26 SECTION 6: This ordinance is required for the immedlate preservation of the DUblic oeace, health 27 and safetYJ and shall take effect lmQediately, and the followin~ lS a statement of facts constituting such 28 urgency: A large numoer of people are using the beach located within the City for recreational purposes 29 and desire to build fires upon the beach; no adequate regulation for the building of fires is now in force 30 in the City and it is necessary that immediate regulations be enacted for such purpose. 31 SECTION 7~ The City Clerk shall certify to 32 the adoption of this ordinance and CBuse it to be 20 24 DANA R.
