RESOLUTION NO. 1119 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH TO IMPROVE THIRTEENTH STREET (13th), FOURTEENTH STREET (14th), FIFT~N~tt STREET, (15th), SIXTE~H STREEl' (16th), AND SEVEN- TEENTH STREET (17th) FROM ELECTRIC AVENUE TO ' U. S. ALTERNATE 101, AND LANDING AVENUE FROM ELEVENTH STREET TO BAY BOULEVARD, AND ELEVENTH STREET FROM ELECTRIC AVENUE TO TWELFTH STREET. The City Counoil of the City of Seal Beach does hereby resolve as follows: . Section 1: That the City Council intends to order the ,improve- ment of Thirteenth Street (13th), Fourteenth Street (14th), Fifteenth Street (15th), Sixteenth Street (lQth), and Seventeenth Street (17th) from Electric Avenue to U. S. Alternate 101, and Landing Avenue from Eleventh Street to Bay Boulevard, and Eleventh Street from Electric Avenue to Twelfth Street, by the construction of concrete curbs, gutters, cross gutters, drive approaches, side-walks and paving, doing all necessary grading and any other related_work required. Section 2: That the aforesaid improvement shall be performed in accordance with plans and specifications prepared in the offices of Voorheis-Trindle & Nelson, Inc. and which were approved by the City Council by rtesolution No. 1099, which plans and specifications are on file in the offices of the City Manager and reference is hereby made to said documents for a detailed description of said improvement and for a , description of the grade to which the improvement is to be made. Section 3: That said improvement is designated as "1911 Improvement District No.1" and is also referred to as"NQrtheast Improvement District~ Section 4: That said contemplated improvement is of more than local or ordinary public benefit and said City Council hereby determines and declares that the District to be benefitted thereby and td be assessed to pay the costs an~ expenses thereof is shown in a . , report of the City Engineer made pursuant to Sections 2824 and 2625 of the Streets and Highways Code, whioh report has been approved by the City Council and is on file in the offIce of the City Clerk, towhich reference is hereby made for a description of the Assessment District, and all expenses for said improvement. ar~ to be paid by the Assessment I,. > I: . Section 5: Notice is hereby given that proceedings have been taken by the City Council in the form, time and manner under the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931", as contained in the Streets and Highways Code and that all requirements of said Act have heretofore been complied with. Section 6: The City Council hereby determines and declares that no protests were made at the hearing on the report required by Sections 2824 and 2825 of the Streets and Highways Code. Section 7: The City Council hereby determines and declares that the proceedings for the afore~aid improvement shall be taken under and pursuant to that pOEtion of the Streets and Highways Code designated as the "Improvement Act of 1911" and that serial bonds shall be issued in the manner and form provided for in said Streets and Highways Code, bearing interest at the rate of six per cent (6%) per annum, to represent each assessment of Fifty Dollars ($50.00) or more remaining unpaid for thirty (30) days after the date of recordation of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September first following their date. Section 8: NotIce is hereby given that on the 25th day of July, 1961, at the hour of 7:30 P.M., at the Council Chamber in the City Hall, any and all persons having any objections to the proposed work and improve- ment may appear before the City Council and show cause why the proposed work and improvement should not be carried out in accordance with this Resolution of Intention. Section 9: The City Clerk shall certify to the passage of this Resolution and shall cause the same to be published twice in the Seal Beach "Post and Wave", the first of such publications to be not less than ten (10) days prior to July 25, 1961. Notices of said hearings of July 25, 1961, shall be mailed to the owners of all property within said Aasessment District, in accordance with the Improvement Nct of 1911.
