CALIFORNIA RESOLUTION NO. 1140 A RESOLUTION OF THE CITY COUNCn. OF THE CITY OF SEAL BEACH CON- CERNING THE OFFICE OF THE CITY A'l"rORNEY. THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Duties of City Attorney. (a) In consideration of the retainer fee set forth in Section 4(a) hereof. it shall be the duty of the City Attorney to: (1) Attend meetings of the City Council and advise the Council on legal matter.. (2) Prepare Ordinances and approve the same as to form and legal propriety. (3) Prepare Resolutions of the Council and approve the same as to form and legal propriety. (4) Prepare contracts to which the City is a party and approve the same as to form and legal propriety. (5) Advise the Council and City Officers with respect to legal problems affecting the City. the Councilor the conduct of any municipal office. (b) In consideration of the special or extraordinary fees described in Section 4(b). hereof. it shall be the duty of the City Attorney to: (1) Prosecute civil actions for and in behalf of the City. (2) Defend any action brought against any Council- man or CitI Officer in his official capacity. when instructed by the Counci or requested by such Officer. SECTION 2. Additional Powers and Duties. (a) The City Attorney is authorized to appoint not more than three assistant or deputy City Attorneys at his own expense. (b) The City Attorney is authorized to employ a secre- tarial staff. subject to prior approval of the Council. the c~ pensation of which shall be a charge against the City. (c) The City Attorney shall have such other powers and perform such other duties as the Council shall from time to time confer. authorize or empower. SECTION 3. Duties -- Exclusions. (a) It shall not be the duty of the CitY'AttorneI to represent persons in matters which affect their personal r ghts. privileges. powers or immunities. (b) It shall not be the duty of the City Attorney to prosecute violations of Ordinances of the City. 30 SECTION 4. COIIQ:lensation. 31 32 (a) Tqe City shall pay to the City Attorney a retainer fee in the sum of $600.00 per month. commencing August 15, 1961, -1- (b) Special or extraordinary fees, as determined by the mt"i""1DI fee schedule of the Orange count! Bar Association, shall be paid to the City Attorney in addit on to the retainer fee for the following special or extraordinary services: (1) Preparation of pleadings in connection with civil actions prosecuted by or in behalf of the City, or against the City; or in connection with any action brought against any Councilman or City Officer in his official capacity, or in connection with any hearing before State, County or City agencies, commissions, boards or tribunals. (2) Appearances in courts in prosecution of civil actions for and in b1!ha1f of the City, and in defense of any act! prosecuted against the City. (3) Appearances in courts in defense of any action brought againat any Councilman or City Officer in his official capacity, when requested by the City Council. (4) Appearances before State, County or Federal agencies, cODllDiss1ons, boards, and tribunals, when authorized or instructed by the City Council or when required by law. (c) Court costs, disbursements, and necessary expenses of the City Attorney and his staff shall be a charge against the City, upon presentation of vouchers therefor.
