AMENDING SUB-SECTION (b OF SECTION 4 OF ORDINANCE
NO. 199i PROVIDING FOR E ERECTING, MOVING AND
CONSTRUuTION OF BUILDINGS WITHIN THE CITY:
REGULATING THE CONSTRUCTION AND ALTERATION OF
BUILDINGS: PROVIDING FOR A METHOD OF PROCEDURE TO
OBTAIN BUILDING PERMIT FOR THE RECONSTRUCTION.
ALTERATION AND MOVING OF BUILDINGS WITHIN THE CITY~
PROVIDING PENALTIES FOR THE VIOLATION OF THIS
ORDINANCE: REPEALING ALL ORDINANCES OR'PARTS OF.
ORDINANCES IN CONFLICT HEREWITH: DECLARING AN
EMERGENCY.
The City Council of the City of Seal Beach.
California, do ordain as follows:
Section 1. That Ordinance No. 199 of the
City ~ach, california, entitled:

AND THE LOCATIO~ OF BUILDINGS AND OTHE~
STRUCTURES DESIGNED FOR ANY SPECIFIED USE:
ESTABLISHING THE BOUNDARIES OF DISTRICTS
FOR SAID PURPOSES: PROVIDING PENALTIES FOR
THE VIOLATION OF THIS ORDINANCE, .AND RE-
PEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH".
and adopted by the City Council of Seal Beach on
the 2nd day of April. 1936. be amended by amending
Sub-Section (b) of Section 4 thereof to read as
follows:-
(b) In the Single family residence
district (R-ll. not more than fifty percent (50%)
of the area or a corner lot nor more than fifty
percent, (50%) of the area of an interior lo.t
shall be occupied by a building or buildings.
No building shall be used. nor
shall any building be erected, altered or enlarged,
on any lot which has an area of less than 2,400
square feet. prOVided that a residence may be
erected on a lot which has an area of less than
2,400 feet if such lot shall be existing as such
prior to the date upon which this Ordlnancetakes
effect.

and adopted by the City Council of Seal Beach on
the 2nd day of April, 1936,r. be, amended by adding
Sections 23. 24, 25. 26, 2'(~ 28. 29. 30, 31, 32
and 33 thereof. to read as rollows:
Section 23: That small building's of not less
than 400 square feet in area and of not more tha~
650 'square feet in area are hereby allowed to be
moved onto the rear of any residence building lot
within the City of Seal Beach.
Section 24. Buildings not less th~n 18 feet in
width. constructed with not less than 2 x 3 studd-
ings and not over 24" on center, weather Sided,
may be moved from any location within the area of
the proposed united States Ordinance Depot. to
other parts of the, Ci ty. p:rovi ded other constructio~
of the building be structurally sound and first
approved by the City Building Inspector.
Section 25. Any person. firm or corporation
may app~y 'to tffe' City Building Inspector for
pe.rmission to move a building from the area included
in the proposed United States Ordinance Depot, to
other parts of the City. providing the followlng
restrictions, rules and regulations are fully com-
plied with.
Every person, firm or corporation desiring to
move such building shall after receiving per-
mission from the City Building Inspector~ apply in
writing to the Building Superintendent or the City
for a pe rmi t which apoI1 caliion shall set forth a
full description of toe building sought to be moved
and the location upon which it is proposed such
building shall be located~
The Building Inspector shall thereupon inspect
said bui1ding and shall make an estimate of the
total cost of material and labor necessary to repair
and reconstruct said building, in order that the
same shall fully comply with the building code and
ordinances of the City;
The Applicant for the permit shall forthwith
deposit with the City Treasurer. a sum of money
equal to such estimated cost of reconstruction or,

in lieu thereof. may deliver to the City Treasurer a
Bond to be approved by him. in a sum equal to such
estimated cost of reconstructionl' when such sum of
money is deposited. or Bond furn shed, as provided
herein. a Permit shall thereupon be granted by the
Building Department to the Applicant. authorizing
such APplicant to move said building from one
location to another. provided that the Applicant
sh~ll, within 120 (one hundred twenty) days from
the date of said permit. alter. reconstruct, repair
and make other necessary improvements and fully
comply with all of the conditions provided for in
such building permit;
The Building Inspector. after said building
has been reconstructed and repaired. shall then
inspect said building and. if approved by him. he
shall report to the City Council his approval and,
if the City Council accepts said report the
City Council shall thereupon refund to the Applicant
the cash deposited by the Applicant with the City
Treasurer. or. shall order the City Treasurer to
return to the APplicant the Bond deposited. which-
ever the case may be;
In the event the APplicant shall fail or
14 refuse to comply with all of the conditions of the
Permit upon the expiration of 120 (one hundred
15 twentyJ days from the date of the building permit
then. and in that event, the deposit of money made
16 by the Applicant, shall forthwith be forfeitea and
shall become the property of the City and the
17 Applicant shall have no further claim thereto;,
In case a Bond is deposited with the City
Treasurer. as herein provided. the principal and
Surety! executing such Bond shall thereupon pay to
the Ci~y Treasurer, in cash. the amount provided
in said Bond.
Section 26~ The foregoing permit may be
extenaeo: for an additional 120 (one hundred twenty)
days at the discretion of the Building Superintendent
Section 27' Nothing contained in this
Ordinance shal~prohibit any person now living in
or owning property in the area of the proposed
United States Naval Depot. from constructing a new
building of not less than 400 square feet in area
upon the rear of any residence lot within the City
without there being located thereon a residence
building located upon the front portion of such
Lot. providing such new building shall otherwise
comply with all of the building Codes and Ordinances
of the City and providing a building permit is
granted to such Applicant.
Section 28~ The provisions relating to the
construction of and moving of buildings as provided
in Sections 23 24 and 27 are enacted as a
temporary builAing regulation and solely for the
purpose of assisting the residents who are now living

Section 29~ Any person. firm or corporation
violating any ot the provisions of this Ordinance.
shall be deemed guilty of a misdemeanor and shall.
upon convictiont be fined in the sum of not to
exceed $300.00 ~Three Hundred Dollars),
Section 30: All Ordinances or parts of
Ordinances in conflict with this ordinance, are
hereby repealed..
Section 31. Whereas, an emergency exists in
the CIty of sear-Beachi the facts creating the
emergency being as fol aws: .
The United States Navy has acquired or is
about to acquire. a large tract of land In the
Easterlr portion of the City of Seal Beacn and, in
p~rticu art the land on the- North and South
Boundaries of Anaheim Bay and have given formal
notice to the residents and occupants of said
District that they are required to vacate their
homes within a very short time. and whereas there
are a 11m! ted number of building and residence lOfts
within the City of Seal Beach; that the residents
of the aforesaid area. affected br the United States
Navy Depot are in danger of becom ng homeless.
and the City Council deems it necessary that certain
rules and regulat.1onS be immediately enacted by an
Ordinance to assist the people affected by reason
of the taking of their homes by the United States
Navy.
Section 32. It is deemed that a necessity
now exists for the immediate enactment of this
Ordinance and it is therefore declared that this
Ordinance shall have full force and effect from and
after its passage and publication..
