AN ORDINANCE OF THE CITY OF SEAL BEAOH, CALIFORNIA,
PROVIDING FOR SUBMISSION AT THE GENERAL MUN'ICIPAL
ELECTIBB TO BE HALD ON TUESDAY, APRIL 9TH, 1940, IN
SAID CITY, TO THE QUALIFIED ELECTORS OF SAID CITY THE
PROPOSITliON OF OREATIIG A FUND FOR OAPITAL OUTLAYS,
FOR THE TRANSFER TO SUCH FUND ANY UNIl<<JUMBERED SURPLUS
FUJIDS REMAINIID ON HAND IN SAID OITY AT THE END OF ANY
FISCAL YEAR AND FOR THE LEVY OF TAXES AND ASSESSMENTS
FOR SAID FUND FOR PUBLIC IItPROVEMENTS UNDER THE PRO-
VISIONS OF THAT CERTAIN AC.T OF THE LEGISLATURE OF THE
STATE OF CALIFORNIA, ENTITLED: " AN ACT TO PROVIDE FOR
THE LEVY AND COLLECTION ,OF TAXES AND ASSESSMENTS FOR
THE PURPOSE OF CREATIliG A FUND FOR CAPITAL OUTLAYS BY
CITIES, COUNTIES, OITIES AND COUNTIES OR DISTRICTS";
APPROVED JULY 1, 1937, CHAP.TER 717, STATUTES, 1937.
The City Council ot the City ot Seal Beach, California, do ordai ;

Section 1: That at the General Municipal Election to be held on
Tuesday, April 9th, 1940, in the City of Seal Beach, Calitornia, the e
shall be submitted to the qualitied electors ot said city the propo-
sition of creating a fUnd for public improvements under the provi~io' s
ot that certain Act of the Legislature of the State ot Oalitornia,
entitled: " An Act to provide of the levy and collection ot taxes an
assessments tor the purpose ot creating a fund for capital outlays
bitles, counties, cities and counties or dist~icts~ approved July 1,
1937, Chapter 717, Statutes ,1937, and tor the transter to such fUnd
any unincumbered surplus tunds remaining on hand_~n said City at the
end ot any tiscal year, and !br the levy o't taxes for said fUnd.
Seation 2: That it the proposition so submitted rece~ves the re-
qUisite number ot votes, to wit: the assent ot two-thirds(2/3)ot the
qualified electors of said City voting at said election at which suc
proposition is to be submitted, then the city council ot said Oity
may at any SUbsequent tax J.evying period levy and collect a tax not
to exceed $0.15 on each One Hundred Dollars of the taxable property
within said Oity in anyone year, to be levied and collected in the
same manner and at the same time as all other municipal taxes, and
which tax moneys shall be deposited in said fUnd tor capital outlays
to be used tor the bbjects and purposes hereinbetore stated.
Seat ion 3: That at any time after the creation ot such tund the
cityr..councll of said City may transter to such tund any unincumbered

surplus funds remaining on hand in said City at the end of any tiscal
year.
Section 4: The ballots to be used in such election shall, in
addition to any other matters required ~ law, contain substantially
the following:

INSTRUOTIONS TO VOTERS: '
To vote on any question or p~Dposition, stamp a cross(X)
in the voting aQuare atter the word "Yes"or atter the

All marks except the cross(X)are torbidden.
All disti~ishing marks or erasures are forbidden and make
the ballot void.
It ybU wrongly stamp, tear or detace this ballot, return it
to the inspector ot election and obtain another.

Section 5: That in all particulars no,t recited in this ordinanc~
for the purpose ot submitting the above reterred to proposition the
election p~ecinots, polling places and ofticers ot eleotion shall be
the same as those named and designated for said General Mun1oip~
Blection; and the City Council shall meet and canvass the returns upop
said proposition at the same time as the returns are canvassed tor
said election as provided by law.
Section 6: That the Oity Clerk shall cer~ify to the_passage and
adopti?n ot this ordinance by a vote ot at least tw-thirds ot all the
embers ot the City C~uncil ot said Oity of Seal Beach and to its ap-

ublished once a week tor two suoeeeding weeks in the "Seal Beach Pos
Wave", a newspaper of general cirCUlation, prin~ed, published and
llrculated less than six days a week in said City, whioh newspaper is
ereb, designated tor that purpose. Such publication of this Ordinancl
hall constitute notice ot said election.
