ORIGINAL OFFICIAL COpy NOT TO BE TAKEN FROM THE CITY CLERK'S OFFICE AN ORDINANOE OF THE OITY OF SEAL BEAOH, OALIF- ORIIA, PROHIBITING TRESPASS CPOI, AND LOITERIIIG ABOUT, OERTAIN OLASSES OF PROPERTY. The Oity oouncil of the City of Seal Beach, Oalifornia, does ordain as follows: Section 1. Declaration of PU1'1)ose. Public safety is hereby declarsd to require that the uninterrupted cperation of certain industries essential to national defense, suoh as the aircraft manufacturing industry, and of companies or agencies supplying water, gas, eleotrio and other essential services, be protected by preventing the intrusion upon the properties thereof of idle, ourious or malicious persons and of persons whose pre- sence thereon is not necessary, and by prohibiting the lcitering about such places by persons capable of inflicting harm or of impeding the operation conducted thereon. Section 2. Posti~ - Kanner of. Prescribed. ADy person, firm, corporation, governmental agency, department or instrument- ality having possession or control, of aUf of the faoilities, plants or utility properties enumerated in section 3 hereof, m&J post, at each entranoe to any struoture devoted to aUf use so enumerated, at each entranoe tc any fenced cr enclosed area de- voted to any such use, and at intervals cf not more than three hundred feet around any area devoted to such use, substantial signs nct less than one square foot in area, d1splaying prominent- ly in addition to such other information as may be deemed desirable, the words, "TRESPASSING - LOITERING - B'ORBIDDD BY LAW" in legible letters not less than two inches in height; provided, however, that any public waiting room, dining room, office or o~er por- tion of aUf such structure or premises to which general public , , access is required in the normal use and operation thereof or where materials are delivered to or received by the publio, shall nct be so posted. Section'. Postin~ - Where Permitted. The plaoes whioh may be so posted are the following: (a) Every airport, and every plant, area, field and struo- ture used for the manufaoture, storage, assembling, flying, landing, or testing of airoraft; (b) Every tant-farm, refinery, oompressor-plant or absorp- tion plant, marine terminal, pipe line pumping station and reservoir, used for the bulk treatment, bulk handling or bulk storage of petro- leum or petroleum produote; (0) Every reservoir, dam, pumping station, plant, area, building, structure, aqueduct, main oanal or pipe line, o~ publio water or sewage system; (d) Every reservoir, da.m~ generating plant, area, struoture, reoeiving station, distributing station and transmission line of a oompany or agenoy furnishing eleotrioal energy; (e) Every gas generating plant, oompressor plant, gas holder, gas tant, and gas main used for the production, storage and distribution of gas; (f) Every plant or vital part thereof or other prinoipal property essential to rendering telephone or telegraph servioe; (g) Every radio broadoasting oentral plant or station; (h) Every publio highway, railroad or vehioular bridge, tunnel, publio pier, wharf, jetty or groin. (i) !very plant for the bulk storage of dynamite, giant powder, gun powder or other explosive. (j) Every plant, structure and area for the storage and manufaoture of ohemioals. Seotion!j.. Tresl)assiu - a K1sdelll8anor. When any such premises is posted as provided in this seotion, it shall be un- lawful for any person to go upon or to remain upon any place wi th- 2. ' in the posted boundary of any such premises, or to enter or to remain in any such posted structure, without having upon his per- son the express written oonsent of the person, firm, oorporation, department or agenoy lawfully in possession or oontrol thereof. Seotion 5. Loiterin<< - a Misdemeanor. It shall be un- lawful for any parson to loiter in the immediate vicinity of any premises posted as provided in this seotion while having 1n his possession any explosive, tool, or devioe, of whatever oharaoter oapable of doing harm or damage to any structure, maohinery, equipment or other property of a similar or dissimilar oharacter, installed or looated upon such posted premises or area. Seotion 6. Exem-ot1ons. This ordinanoe does not apply to" any entry in the oourse of duty of any peaoe offioer nor to any person traversing an established and e~isting publio sidewalk, street or highway. seotion 7. DamaRin~ Si~ns. Every person who tsars down, defaoes or destroys, or oauses to be torn down, defaoed or de- stroyed, any sign plaoed or posted under the provisions of this ordinance without the oonsent of the person, firm, oorporation, goverlllllental agenoy, department or instrumentality having pos- session or oontrol of the premises on whioh suoh sign has been ereoted, is guilty of a misdemeanor. Seotion 8. Penalty Clause. Every person, as prinoipal, agent or otherwise, violating any of the provisions of this or- dinanoe shall be deemed guilty of a misdemeanor and upon oonvio- tion thereof shall be punishable by a fine of not to e~ceed Three Hundred Dollars (0300.00) or by imprisolllllent in the oity jail in the Oi ty of Seal BaaOh, Oalifornia, or in the Oounty Jail of Orange Oounty, Oalifornia, for a period of not to exoeed three (,) months, or by both such fins and imprisOlllllent. Seotion 9. If aUf provision of this ordinanoe, or the application thereof to any person or oiroumstance, is bald in- valid, the remainder of the ordinance and the applioation of suoh . provision to other persons or oiroumstances shall not be affeoted ,.
