AN ORDINAIDE OF THE CITY OF SEAL BEACH, OALIFORNIA, AMENDING ORDUICE NO. 252 EltTITLED:".AN::oRDINAIDE OF THE CITY OF SEAL BEACH, CALIFORNIA. CREATING A LOOAL DEFENSE OOUNCIL AND PRESORIBING ITS DUTIES AND RESPONSIBILITIES"; BY ADDING SEIlTIONS 7,8,9,10, 11 AND 12 THERETO AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. 1 The City Counoil of the City of Seal Beach, Ca11fornia, do ordain; as follows: Seotion 1. That Ordinance No.252 entitled II An Ord1nance of the Oity or ~eaJ. Beach, California, Creating a Local Defense Council and Presoribing 1ts n,.t1es and Responsibil1ties", adopted by the C1ty Council on May 1, 1941; be, and the same is hereby amended by adding thereto the follow1ng: Section 7. The C1ty Counoil shall authorize and obta1n badges, arm bands or other 1nsign1a as a means of indentification, and suoh arm bands, badges or other insignia shall be recognized by all po11c , fire and other off1cers as authority for the person wearing the same to pass any police or fire linsa. Such ar.m~bands, bages or insignia shall be retained by the City and members of the Defense Council un- til an emergency exists and then may be issued to anY person author- ized to work upon emergency relief. It shall be unlawful for any per son not properly authorized by a member of the Defense Council to wear or carry any such arm band, badge or 1nsignia, or any sim11ar badge, arm band or ins1gnia, and any person so wearing or carrying about h1s person any such insignia without such authority or any rePi lioa thereof during emergency relief work or at any other time shall I be guilty of a misdeaeanor. Section 8. It shall be unlawful for any person to fail, neglect o~ refUse to comp~y with the authorized prder of any person lawfully wearing or oarrying any such arm band, badge or insignia, and to un- necessarily use the telephone or assemble upon the streets of the City of Seal Beach during any announced period of emergency, or loit r at or near any mititary zone or area, or to do any other act contrari to and in violation of any order of the Military or Naval authorities of the Un1ted States. Any person violating the provisions of this Section shall be deemed guilty of a misdemeanor. Seotion 9. Any person who shall violate any provision of this Ordinanoe shaJ.l be guilty of a misdemeanor and upon conviction there of shall be punished by a fine of not exceeding three hundred dollar ($300.00j or by imprisonment in the City jailor the County jail of I Orange County, Iorb~ peilaoduo1ll' i16teezo.teding threel3)months, or by 1 both such t1ne and impr1sonment. Seotion 10. If any section, subsection, sentenoe, clause or phrase of this Ordinanoe is for any reason held to be unconstitution 1 or invalid, suoh deois10n shall not affeot the validity or constitu-i t10nality of the remain1ng portions of this Ord1nanoe. The City Ooun c11 hereby deolares that it would have passed this Ordlnanoe and eac sect10n, subsection, sentence, clause and phrase thereof irrespeotiv of the fact that one or more ot the seotions, subsections, s8ntences olauses or phrases thereof be declared unoonstitutional or invalid. Seotion 11: This Ordinance is required for the immediats preservation of the public peace, health and safety and the follow- ing is the statement of facts oonstituting suoh urgency: The United states is at war and this Oity is in imminent danger of attack or invasion from the air or otherwise. Bection 12. The Oity Clerk shall certify to the adoption of thiE! Ordinance and cause it to be published once in the "Seal Beach Post & Wave", a newspaper of general oirculation printed and published in this Oity and thenceforth and thereafter the same shall be in full foroe and effect.
