AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA,
PROVIDING FOR LICEleING AND RMULATlliG CERTAIN BUSI.
NESSES AND PURSUITS CARRIED ON WITHIN SAID CITY,HE-
PEALING ORDINANCES NOS .152, 167, 179, 186 AND ALL
OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
WITH THIS ORDINANCE AND FIXIln PENALTIES FOR THE
VIOLATION HEREOF": .
The City Counol1 ot the City ot Seal Beach, Cal1torn1a, do ordai
as tollows:
Section 1: DEFINITIONS: The tollowing worda and phra8e8 in thi8
ordinance shall have the signitication attached to them in thie sec-
tion, unless otherw08e clearly apparent trom the context.
A. ANNUAL LICENSE TAX. The phrase "snnual l1cense tax" shall
mean and inolude the tax tor a l1cense which shall expire with the
tir8t day ot July next tollov/ing its ie8uance; and the person or in-
dividnal applying tor such l1cen8e shall pay the same in 'f'Ull tor
one year in advance, 01' tor any unexpired portion ot said year, at
the time ot application, except as otherwise provided ~ thi8 ordi-
nance. All license8 shall expire with the last day ot the period tor
which the tax is paid as h~re1natter provided.
B. AUTOR FOR HIRE. The phrase "auto tor hire" shall mean and in-
clude the leasing, renting or hiring by day, hour, trip or otherwi8w
whwther with or without driver, ot any automobile, sight8eeing car,
omnibu8 or 8tage; or the using 01' maintaining ot any automobl1e tor
any sight-seeing trip, excursion or outing, 01' showing point8 ot in-
terest 01' conveying per80Ds to point8 within or without the city to
show or exhibit landa or houses, or both, tor the purp08e ot ettecti
a 8ale ot any 8uch lands or houses, 01' to show or exhibit 011 pro,-
pects, land or wells tor the purpose ot securing investments in any
enterprises tor the prodnction ot or drilling tor oil, whether or no
a tare or remuneration i8 charged, collected 01' accepted, or the us-
ing or maintaining ot any automobile, omnibus or stage tor carrying
passengers tor hire over a route, one termiDUs ot which is inside
the City ot Seal Beach.
C. BOAT FOR HIRE. The phrase "boat tor hire" shall mean and in-
clude any bast propelled by machinery, oars, paddle8, sails 01' other
wise and used or maintained tor lease, rent or hire by the hour, trip
or otherwise, whether with or without an operator, tor carrying or
transporting any passenger or passengers upon sny body ot water and
trom any pier, whart or landing place or dock in the City ot Seal
Beach. .
D. CIRCUS. The wolid "circus"' 8hall mean and include any tent 01'
canvas incl08ure wherein are exhibited any teats ot horsemanship, ~
trained animals, clown8, acrobatic or trapeze pertormancesGand such
other torms ot 8kill 01' amusement as are commonly given in rings a
combinations ot entertainment.

E. INDIVImAL. The word "individual" shall mean and include a
person or individual, exclu8ive ot any firm, corporation~ co-partne
ship, association, club, society 01' other organization, engaged in
any business specitied in the sections ot this ordinance wherein the
word "individnal" is used and wherever a tirm, corporation, co-part-
ner8hip, association, club,society or other organization is engaged
or seeks to engage in a business 01' pursuit herein where it is pro-
vided that the license theretoI' shall be issued to an individual, t
president, secretary, manager, partner, employee or other individua ,
and each ot them actually carrying on the beuiness or engaged in the
pursuit tor and on behalt ot such tirm, corporation, co-partnership,1
association, club, society or other organization, shall secure such
licenljle. .

F. MEDICINE SHOW. The phrase "medicine show" shall mean and in-
clude the using of any music, lecture, entertainment, operation, 0
other like scheme or plan to attract an audience or crowd and the
selling or giving to any person in such audience or crowd, or arra
ing tor sale at a future time, ot any drug 0' medicine, or any sur-
gical or medival appliance, instrument or treatment. .
G. PEDDLING. The word "peddling" shall mean and include travel-
ing or going trom place to place or trom house to house and peddl ,
hawking, vending or selling any gooda, wares or merchandise carried,
or caused to be carried or conveyed by or with the person peddling,
hawking, vending or selline; the same, where del1very is made at *he
time or within twenty-tour(24)hours SUbsequent to the sale.
H. PERSON. The word "person" shall mean and include both the
singular and plural and shall also mean and include any person,in-
dividual, tirm, corporation, copartnership, asaociation, club,
society or any other organization.
I. SELLING. The word "selling" shall mean and include selling,
ottering tor sale, or contracting to sell any gooda, wares or mer-
chandise.
J. SOLICIT:niG. The word "soliciting" shall mean and include
traveling or going trom place to place, or trom hcuse to house and
sol1citing or taking orders tor any goods, wares or merchandise tor
delivery at a time in the future not less than twenty-tour(24)hours
subsequent to the t1me ot sol1cit~ng or taking such order.
Sec.2. ADVERTISING-GENERAL. Every perscn oarrying on the busines
ot advertising, except as herein otherwise provided, ~hall pay a
license tax ot Fitty Dollars($50.00)Ner year.
Pol' the purpose ot this section Advertising" shall include ad-
vertising agencies or the posting, sticking, att1xing, tscking or
J8inting of any bill or sign to or upon any post, tence, billboard
or advertsing signboard, except as hereinafter provided in Section
2a hereot, motion p!cture or theatre curtain, building or other
structure o~ any character whatsoever; or operating or maintaining
any billboard or Signboard, except as hereinafter provided in Sectio
2a hereot, or window display; or distributing any posters, dodge.s,
ciculars, brochures, or other printed advertlAements ot any kind; ex
cept drugs or medicine, or advertising by means ot any vehicle or
steropticon, biograph motion picture machine or other mechanical or
electrical device 01' contrivance; or handing out printed matters of
aDf lind to the public in the Oity ot Seal Besch; provided, that
nothing in this section, shall be construed to ettect or apply to a
person, tirm or corporation delivering handbills or posting, sticki ,
ta'b'll:1I!ng, att1xing, painting or erecting any business signs on the
premises or buildings occupied and used in the business ot such per-
son, firm or corporation within the City of Seal Besch and which ban -
bills or signs advertise only the goodS, wares, merchandise or busi-
ness ot such person, tirm or corporation.
Sec.28. BILLBOARDS OR SIGNBOARDS- Every person erecting, con-
structing or maintaining or operating any billboard or advertising
signboard in the City ot Seal Beach, the advertising surtace ot whic
is in excess of thirty(30)square teet, shall pay a liDense tax ot On
HUndred Dollars($lOO.OO)per ye.r.
Sec.3. ADVERTISING BY MFANS OF ELlOClTRIC SIGNS- Every person con-
ducting, managing or carrying on the b1Iainess ot advertising bf mearul
ot aDf electric sign, shall pay a license tax ot Fiftl DollarS($50eot
pel' year; prOVided, however, tbat nothing in tkis section shall be
constrded to prohibit any person, t6rm or corporation from advertisi
only the goods, wares, merchandise or b1IBiness of such person, firm I
or corporation by meaDS ot any electric sign placed 01' maintained on
the premises or buil1ings occupied 01' used Dol' the business so adve
tised by such person, firm or corporation, within the City ot Seal
Beach.

Sec.4. AIRCRAPl.' FOR HIRE. Every perscn conducting, managing or
carrying cn the business ot maintaining any air-port or air-cratt
tor hire or tor carrying passengers or freight tor hire in any ai:r-
cratt, shall pay a license tax ot TW!n~-tive Dollars($25.00) pel'
year.
It shall be dnlawful to carry cn the ~usiness or businesses
specit1ed in this section without first procuring a permit from the
Chiet ot Police ot the City ot Seal Beach so to do, and provided,
further that any violation ot the federal Rules and Regulations for
the tperation 01' air-cratt shall e~h~tttute a violation ot this ordi
: naDCe and tor which any l1cense issued hereunder may be cancelled
without notice.
Sec.5. AMUSEMENT DEVICE OR ElOlIBITION. Every person conducting,
managins or carrying on the bus1ness ot maintaining any game, exhibi -
ion, amusement or recreational device, 01' any kind ot amusement or
entortainment not otherwise provided for in this ordinance, and o~r -
ing 01' collecting any too tor play6Dg or ansaglng theroin or accept-
ing allT treowill ottering theretor, shall pay a l1cense tax ot hve .

further that tho holder ot a l1cenae to operate such game or games
and similar amusement devices shall conduot and carry on such busi-
ness in such a aanner that it shall not cODstitute an offense 01'
violation under Section 330 ot the P.nal Code ot the State ot Cali-
tornia, prOhibiting ilhe operation ot a biinkiDg or percentage gamo to
money, checks, credit 01' other representative ct ~lue.
Sec.6. AMUSEMENT PARK. Every person conducting, managing 01' car -
ing on an amusement park within allT enclosure whore an admission
tee is charged, shall pa7 a license tax ot Twenty-tive Dollars($25. )
pOl' year, 01' r1ve Dollars($5.00)pel' day.

I I Sec.7. APPLICATION FOR LICE!8E. Every porson liable to pat aDJ'
license tax under this ordinsDce shall make application to the City
Clerk for a license, stating the business 01' pursuit desired to be
carried on and the street number 01' location whore it is proposed to
condnct such business) and it shall be the duty ot the City Clerk be
tore the issuance thereot it desired to' reteI' such app'lication tcr
investigation to the Chiet 01' Police ot said City aJ1d7or to the City
Council tor further investigation as to whether such applicant has
compl1ed with all prcvis10ns ot city ordinancea-, including this ordi
nsnce, roquired tor securing such license, and thereatter aaid lice e
shall be issued, signed by the City Clerk, attested by tho City Seal
and shall state thoreon the amcunt of such license tax, the period ,
ot time tor which issued,' the nsme ot the person to whom issued, the
business ot the person licensed, and the location where such bsuinos
or pursuit is to be carried on, and thereatter said license shall be
dolivered to said applicant. Provided further, howevor, that allT lic
ense or lacenses issued hereunder shall be non-transterable trom the
place ot business designated therein to another an~or trom the pers n,
firm or corporation to .whom issued tc1l another, and that said "'1icense
or licenses issued herewadf'r shall be revccallle by the City Council
ot said City at aD7 time atter the issuanoe thereot, should the City
CounCil, atter such investigation as it may deem sutticient, detlDllli e
that the holder thereot has violated any 01' the terms and conditions
ot this ordinamce, and,11kewise tho issuance of said license may be
refused, it in the opinion 01' such City Council, the conduct of said
business thereunder. would be or has become det~ental to the publi
weltare, health or morals 01' the community or inhabitants therect.

Seca.AUCTION HOUSE. Every ierson condncting, managing or carryi
on the business ot an auction E.buse, 01' maintaining or conducting an
place ot business whore the business ot selling goods, waros or me:r-
chandise at public auction is carried on, or any place where the goo s,
wares 01' merchandise ot more than one person is being sold at allT on,
time by publ1c auction, shall pay a license tax 01' Three Hundred Do11
lars($300.00) per year; said license shall entitle the holder thereo~

to cry sales anywhere within the City of Seal Beach, and also the
right to maintain one helper in said auction house. Aqr merchant wit -
in the Oity ot Seal Beach who desires to dispose ot his entire stock
ot goods at public auction may do so without securing the license
provided tor herein, provided said merchallt has been continuously en
gaged in business in the City ot Seal Beach tor a period ot one year
next precedllbg:;the date of the opening ot II1ch sale, and provided
further, that such auction does not continue tor a longer period tha
thirty(30)days trom the date ot such cpening. This section shall not
be construedto apply to any publ1c otticer selling any goods, wares
or merchandise under order of any court, commission 01' other legal
authority.
Sec. 9. AUCTIONEER. Every person condnoting, managing or carrying
on the business ot an auctioneer shall pay a license tax ot One Hun-
dred iDAJrttty Dollars($150.00)per year.
Sec.10. AUTO FOR HIRE. Every person conducting, managing or carry
ing on the business ot an auto tor hire shall pay an annual license
tax ot Thirty Dollars($30.00)per year.
Sec.ll. AUTOMOBILE PARKIln SPACE OR LOT. Every person conducting,
managing or carrying on the business ot maintaining an automobile
P'!rking space or lot shall pay a l1cense tax of 'l'W~:f':tv.a JDO'll1ars
($25.00)per year.
Seo.12. AUTO REPAIR SHOP. Every person condncting, managing or
carrying on the business ot an auto repair shop shall pay a license
tax ot Twelve Dollars($12.00)per year, provided, however, that such
business shall not be subject to the license tax provided tor herein
is conducted in connection with a public garage when such auto re-
pair shOp is owned and controlled by the owner of said publ1c garage
For the purpose ot this section the term "Auto Repair Shop" is de
tined as aqr shop, bul1ding, room,' place or space where sny automobi e,
or aqr parts thereot, are repai.ed, remodeled, overhauled 01' painted
and a compensation charged tcr the same.
Sec.13. AUTO WRIDKING SHOP. Every person, condncting, mansging 01'
carrying on the business ot an auto wrecking shop or yard shall firs
secure a permit trom the City Councl1 so to do, and in addition ther -
to shall pay a license tax ot Fitty Dollars($50.00)per year.
For the purpose ot this section the term "Auto Wrecking Shopllis
hereby detined as the maintenance ot a place, building or lot where
second hand automobiles, trucks, or parts thereot, are traded tor 01'
bought tor the purpose ot dismantling, wreoking or otherwise tearing
down the same; and the parts or accessories from such automobiles or
trucks are ottered tor sale or exchange as usable; and the storage 0
such metals and irons as may accumulate theretrom.
_ Sec.13a.AUTOMOBILE CAMP CARS OR TRAILERS AND TRAJ;[,ER CAMPS. Every
person conducting, managing or carrying on the baainess ot an auto-
mobile trailer camp shall pay a license tax ot Seventy-tive Dollars
($75.00)per year. See Ordinance No.214,adopted June 2, 1938,tor ap-
plication and regulations, which ordinance is not repealed hereby.
Sec.14. BATHHOUSE-PUBLIC. Every person conducting, managing or
carrying on the business ot a publ1c bathhouse or maintaining any
public bsthroom or public dressing rooms tor hire, shall pay a licen e
tax ot Twelve Dollars($12~00)per year, and it said public bathhouse
has in excess ot one hundred( 100 ) rooms , including both dressing rooms
bath rooms and/or lockers~ then such license tax shall be st the rat
ot ten cents(lO~)tor each! dresling room, bath room and/or locker in
excess ot one hundred(lOO)ot allot such rooms; and, provided fur tho ,
~n event that said public bath house has thirty-tive(35)or more dres -
ing rooms and accommodations tor such number ot bathers, the operato
thereot shall maintain a lite guard at his own expense upon the hoac
adjoining or adjacent to such bath house at all times during which

bathers are using the accomodations of such bath house and beach.
@ Sec.15. BARBER SHOP AND/OR BEAUTY PARLOR. Every person conducting,
,,~ managing or carrying on the business of a barber shop:'and/or beauty
parlor, shall pay a license tax of Twelve Dollars($12.00)per year.
Sec.16. BEACH UMBRELLAS, SURF B"ARDS AND SIMILAR DEVICES. Ivery
person conducting, managing or carrying on the business ot maintaini
a beach umbrella, surf board or similar device stand or place tor the
purpose ot renbing, leasing or selling the SRme to the public shall
pay a license tax ot Twenty-Five Dollars($25.00)per year per stand;
provided, however, that such business shall not be subject to the
license stated herein, if conducted from a' regularly established plac
of business in said City which is subject to and pays a general mer-
chandise livense tax otherwise provided tor in this ordinance.

Sec.17. BeATS FOR HIRE. Every person conducting, managing or carry-
ing on the ba8iness of boats, canoes or kyaks tor hire, or maintaini
any boats, canoes 01' kyaks tor hire, rent or use by the public, shal
pay a license tax ot Fitty Cents(50~)per year tor each such cratt no
exceeding twenty-five(25)feet in length and Fitty Oents(50~)per toot
in addition thereto tor each such boat or cratt exoeeding twenty-fiv
(25)feet in length.'
Sec.18. BILLIARD, POOL ROOMS AND BOWLING ALLEYS. Every person con
ducting, managing or carrying on the business ot a public pool hall,
billiard hall or bowling alley, or maintaining any pool table, billi d
table or bowling alley for public use, shall first secure a permit
from the Chief of Police so to do; and in addition thereto, shall pay
a license tax ot Six Dollars($6.00Jper year tor each such table or
bowling alley ~hether the SRme is in use or not.
Sec.19. BRANCH OR SEPARATE OFFICE. A separate 11&ense tax: shall be
paid tor each branch established or separate oftice or place for
carrying on any business or pursuit specitied in th1s ordinance and
tor the amount ot tax therefor, unless otherwise herein specified,
shall be equal to the Rmount specftied for the carrying on of the
original place ot business or pursuit.
Sec.19a. BUILDING TRADES. Every person who commences or does, or
causes to be done or commenced, or constructs or causes to be con-
structed, any construction work or labor upon any building or struct
ure or inconnection therewith which is customarily done by the tollo
ing enumerated Building Trades shall p~ the license tax hereinatter
designated for each of such trades or occupations ot Eighteen Dollar
($18.00)per year; to wit: Building Contractor, Cement Worker, Etectr -
cian, Brick Layer, Carpenter, Lather, Plasterer, Plumber, Painter,
Sign Painter, Rooter, Sheet Metal Worker, Structural Steel Worker,an an
pther Skilled Labor whether herein specitied or not; except and pro-
vided, however, that the annual license tax herein provided tor shal
be payallle anmally in advance for a period of one year and expire
one year from the date ot issuance; and, provided further that no
license tax shall be required from the owner or occupant of any bul1 -
~ 01' structure doing construction wvrk or labor thereon which work
does not require the issuance ot a Oity Building Permit.
:~.JSec.20~' CHANGE OF LOCATION. Every person having a l1cense to car
on any business or pursuit at a tixed place of business who changes
the location of such place ot business 01' pursuit shall, prior to
carrying on such business or pursuit at the new location, have the
?ity Clerk endorse such new looation upon the license theretor.
Sec.21. CARD TABLES. Every person engaged in, managing or carryi
on the business or'maintaing a place where tables are used by the
public for playing carda, and tor the use ot which a tee or compemsa
tion is charged the players, shall pay a license tax ot Twenty-tive/

($25.00)per year tor each such table,'whether or no~ the same is in
actual use. Provided further, however, that betore engaging in any
such business an application tor such license shall be made to the
City Council in writing, stating the name or names ot the persons
making the application there tor, 14th the plese ot residence ot each,
and the street number of the proposed location ot such business; to
which application shall be attached the annual license tax hereinabo
provided for, either in cash or certitiedbor cashier's 9heck, and th
Cit~Council reserves the right to reject any such application, Shou d
it atter such investigation as it may deem sutticient, determine-tha
the issuance thereot and the conduct of such business thereunder, wo ld
be detrimental to the public weltare, health or morals, in which ev t
the annual license tax shall be refunded; and, provided further said
City Council also resevves the right upon the same grounds to revok
any license theretotore issued..
Sec.22. CIRCUS. Every perscn condncting, managing or carrying
a circus where an admission tee is charged the public shall pay a
license tax ot One Hundred and Fifty Dollars($l50.00)tor the tirst
day and Fitty Dollars($50.00)tor each additional day thereafter.
Sec.23. CIVIL SUIT. The amount ot any license tax provided her
in shall be deemed a debt dne the City of SeaD: Beach, and every pel's n
shall be liable in an action in the name ot the City ot Seal Beach
in any court ot competent jurisdiction tor all or any portion ot the
amount ot any license tax provided tor carrying on any business 01'
pursuit.specitied herein, together with costs ot suit.
~" Sec.24. CLEANING, PRESSING OR mEI1fG~CIlOTHES. Every person con-
~ ~ l ducting, managing or carrying on the business ot cleaning, p;oessine;
~')ri'.~ ~,~ or dyeing clothes shall pay a license tax of Twelve Dollars($12.00)

G9 Sec.25. COLLECTION AGENCIES. Every person engaged in, conducting
i~'l ,,( managing or carrying on the business ot a collection agency shall p
a license tax ot Twelve Dollars($12.00)per year.
Sec.26. COLD STORAGE PLANT. Every jerson conducting, managing or
;l.&~ " carrying on a cold storage or retrigerating plant tor the purpose of
~!- lItoring fruits, vegetables, fish, meats; eggs 01' dairy products shal
pay a license tax ot Twelve DOllars($12,OO)per year.

3<~"Sec.27. COLLECfiON OF TAll[ NOT BARRED BY CONVICTION. The convict-
ion and punishment ot any person for transacting any business or pu
suit hereunder without a license shall not excuse such person trom
the payment ot any license tax due or unpaid at the t1me ot such COD
viction; and nothing conta~ed herein shall prevent a criminal prose
cution tor the violation ot any ot the provisicns ot this ordinance.

Sec. 28. COMMISSION MEROHANTS OR BROKERS. Ever"Y person who engage
in, conducts, manages or carries on the business of a commission mer
chant 01' broker, within the City of Seal Beach shall pay an annual 1 _"
cense tax ot Fitty Dollars($50.00)per year.

Sec.29. DANOING AGADEMY. Every person conducting, managing or c
rying on the business ot a dancing aeademy shall pay a license tax 0
Twenty-tive Dollars($26.QO)per year; provided, however, that no lice
shall be required of any such person conducting, managing or carryi
on the business ot such dacing academy when the same is maintained 0
carried on in conjunction with a public dance hall tor which such pe
son is paying a license tax. The term"dahcing acadamy"as used herein
is defined as a place where dancing lessons are given tor which a
charge is made.
Sec.30. DANCE HALL. Every persOD conducting, managing or carryin
on the business of a public dance hall, shall tirst make application
to the City Council theretoI', as hereinbetore provided in Section 21
hereot, and in addition thereto shall pay a license tax of One Hun-
dred and Fifty Dollars($150.00)per year, and shall maintain at all

fined to be any place where public dances are regularly carried on

Sec.31. DRUG STORE. Every person conducting,managing or carrying
on the business ot a drug store, shall P81 a license tax ot Twelve
Dollars($i2,00) per year, which license tax shall include the right
to sell cigars, tobacco, ice-cream,'sott drinks and other goods of a
general merchandise na~re it owned; managed and controlled by the
licensee conducting said drug store, but such license hereunder shal
not include the right to sell or serve sandwiches, lunches or meals.

All Police Otticers are hereby appointed inspectors ot liceBs
and, in addition to their seVeral duties as police otticers, are her
reqpired to examine all places of business and persons liable to pay
a license, and to see that such licenses are taken out, and shall ex
cise the tollowing powers and duties:
1. To make arrests tor the violation ot any ot the provisions
of this ordinance; and, .
2. To enter, free ot charge, at any time, an)' place ot busines
tor wnich a l1cense is required by this ordinance and to demand the
exhibition ot suCh licenses tor the currebt term or year by any pel's
engaged 01' employed in the transaction ot such busbless and if such
person shall then and there tailor refUse to exhibit such license,
such person shall be liable to the penalty provided tor in violation
ot this Drdinance.
3. It is hereby made the duty ot the police otticers to cause
complaints to be tiled against all. persons violating any ot the pro-
visions ot this ordilJance. .
4. The Chiet ot Police is hereby directed to carry into eftect
the pro~ions ot this section.
Sec.35. ElIIl'LOYMENT BUREAU. Every person engaged in or carrying
on the business ot an emplo~ent bureau or agency shall pay a 11cens
tax ot Tewnty-five Dollars ($25.00)per year.
Sec.36. EXHIBITING LICENSE. Every person having a license unde
this ordinance and carrying on a bu4inesltor pursuit at a fixed plac
of business shall keep such license posted in a conspicuous place in
such plave ot business so as to be easily seen; and very person havi
a license but not carr,ying on a business or pursuit at a tixed place
ot business shall exhibit such license whenever requested so to do b

cense tax ot Two Hundred and Fifty Dollars($250.00)per year; provide,
however, that no person shall be reqpired to pay said tax tor the ad-
vertising or fbr the sale of goods, wares or merchandise where sllch
person was the legal owner ot such goods, wares or merchandise at th
t1me the same were salvaged.
Sec.38. FIREWORKS. Every person conducting, managing or carrying
on the business ot maintaining a stand or place tor the sale ot tire
crackers, tire works, flags, banners, h~ns and novelties, shall pay
a license tax ot Two Httndred Dollarsd'p200.00)per ~'.for the tirst
stand and in addition thereto shall pay a license tax of One Handred
Dollars($lOO.OO)per day tor each branch stand; provided, however, th t
the license tax required to be paid herein shall not apply to a regu -
arly established business, which tor the purposes ot this seetion
shall be de tined as a place ot business which nas been operated in
the same location tor not less than six months, and provided further
that no portion or part ot the premises ot such established place ot
business shall be rented, let, hired, sublet or leased to a third p ty
or parties for the sale ot articles hereinbefore enumerated without he
payment ot the said license tax herein provided; and, provided fUrth l'
that no such person shall maintain or conduct a stand or place tor t e
sale ot such articles within said City without first securing a per-

ing any intormatiOD not otherwise obtainable by the prdinary process s
ot knowledge, tor or without pay, by means ot occult 01' psychic powe ,
taculty or force, clairvoyance,. clairaudience, cartomancy, psycholo ,
pyschometry, phrenology, spir1ts, medfumship, seership, prophecy,au-
gu~, astrology, palmistry, necromancy, mind reading, telepathy, or
other cratty art, science, cards..talisman, charm, potion, magnetism
magnatized article or substance,JRYPsy cunning or toresi~t, crystal
gaxing, oriental mysteries or magic of any kind or nature, or engag-
ing in practicing or carrying on any art, protession or business, th

City of Seal Beach, or who is not an agent or employee ot EUch perso

is not transterable.
Sec.47. ITINERANT VENDORS. Every person managing, engaged in,
conducting or ~arrying on the business or occupation of an itinerant
vendor, shall pay a license tax ot Ten Dollars($lO.OO)per day. For
the purposes cf this section the words) "itinerant vendor" is hereby
detined to mean and include all persons or indiViduals, both prinoip ls
and agents, who engage in a temporary or" transcient business in the
City ot Seal BeaCh, selling goods, wares, merchandise with the inten
tion of conducting said, business in said City tor a pl riod of not mo e
than ninety(90)days, and who, tor the purpose of carrying on such bu i'!!~
ness, hires, leases or occupies any room, doorway, vacant lot, build
ing or structure, for the exhibition or sale ot such goods, wares or
meroklmdis" and the person so engaged shall not be relieved from th
requirements of this section by reason ot associating temporarily wi h
any local de~ler, trader, merchant or auctioneer.
A license issued under this section shall be non-transterable.
The provisions of this sestion shall not apply to salesmen kno
as commercial travelers, ncm to selling agents selling their goods t
dealers, whether tor present or future deliveries, by samples or oth r-
wise, not to hawkers on the streets within said City, nor to peddler
from vehicles, nor to persons selling fruit, vegetables, butter, egg
01' other farm 01' ranch products ot their own production or raising.
Sec.48. JUNK COLLECTOR. Every person collecting junk, bottles,
tin cans, paper, old rags, sacks, or other artbles commonly known as
junk, either by going trom house to house, or from place to place,
gathering, collecting, buying, seeling 01' otherwise dealing in the
same, shall pay a license tax ot Twenty-five Dollars($25.00)per year
Two Dollars and titty cents($2.50)per day. License not transterable.
Sec.49. JUNK DEALER. Eve1'7 person conducting, managing or car1'7in
on the business ot a junk dealer shall pay a license tax ot Twenty-
five Dollars($25.00)per year, which shall not include the right to
collect junk and EUch license is not transferable.

Sec.50. LAUNDRIES. Every person conducting, managing or carrying
on the business ot a laundery,or soliciting laundry from an estab11s ed
place ot business, shall pay a license tax ot Twelve Dollars($12.00)
per year and in addition thereto, shall pay a license tax ot Five

Sec.51. LIMITATION OF TIME AND AMOUNT. No steater or less amount

Sec.52.LlWERY OR FEED STABLE OR RIDING AeADEMY. Every person con
ducting, managing or carrying on the business ot a livery ,feed or sal s
stable or riding academy shall pay a license tax ot Twelve Dollars
($12.00)per year.
See.53. LOAN COMPABIES. Every person' conducting, managing or
carrying on the business ot loaning money, either tor himself or tor
any other person, upon personal or real property security, evidence 0
debt, assignments ot salary, salary warrant, salary demands,automobil
or any' personal property, 01' purchasing tor himselt, 01' tor any other
person, automobile or other personal property purchase contracts, com
mercial paper, evidence at debts, salary demands, time checks, or oth l'
evidence ot salary 01' wages due or to became due shall pay a license
tax of Fltty Dollars($50.00)per year.
Nothing in this section. contained shall be deemed 01' construed to
apply to the holder ot a bond broker's license, 01' to any person con-
ducting a banking business under the laws ot the State or Nation, cr
a pawn broker's business.
Sec.54. MEDICINE SHOW. Every persOD conducting, managing or car
ing on the business ot a medicine show shall pay a license tax ot
One Hundred and F1tty Dollars($150.00)per year, or Ten Dollars($lO.O
per day. A livense issued hereunder is not transterable.

Sec.55. MILITARY OR NAVAL EXEMPTION. Every honorably discharged
soldier, sailor or marine ot the United States or the 80nleIBrate
States, who served in the Civl1 War, my Indian War, the Spanish-
American, the Philippine Insurrection, the Chinese Relief Expedition
or with' the American Expeditionary Forces in the WorltG! War against
Germany, who is physically unable to obtain a livelihood by manual
labor, shall be allowed to carry on any business or pursuit specitie
in this ordinanc&' without the payment ot the l1cense fee 01' tax re-
quired theretor;~provided, however, that said license tax or tee, as
fixed by this oi'dinanoe, does not exceed'fJhe sum ot Thirty-six Doll s
($36.00)per year; and, provided, further, that no more than one such
license s hall be issued to any such diaabled soldier, sal10r or mari e
during anyone year.
Each such soldier, sailor or marine, betore carrying on any such
business or other pu~sdit, shall tirst procure from the City Clefk
a license so to do, a nd shall be subject to all the provisions ot
this ordinance or any amendatory ordinance hereto. Each such soldier
sailor or marine cldming exemption uncil:er the provisions ot this sec iOZl
shall exhibit to the City Clerk his honorable discharge together wit
a letter from the Secretary ot the local American Legion Post as a
conditiOD precedent to sewr.ing such exemption and l1cense.
Sec.56. MINIATURE TRAINS, PO~ RIDES, AND SIMILAR DEVICES. Every
person conducting, managing or carrying on the business ot maintain-
ing or operating any miniature gasoline, electric or steam train, or
pony rides, and siml1ar devices for hire a nd amusement shall pay a
license tax 01' Twenty-tive Dollars($25.00)per year, cr rive Dollars
($5.00)per day,md shall tirst procure a permit from the Chief ot
Police of said City so to do.

',/Sec.57. MISTAKE IN AMOUNT. In no case shall any mistake in the
amount collected tor any license tax or any penalty prevent the coll ct4
ion ot the amount actually due for such license.
Sec.58. MOTION PICTURE SHOW. Every persOD conducting, managing or
carrying on the business ot taking 01' produc~g one or more moving
or motion pictur~s, shall pay a license tax of Fitty D~11ars($50.00)
per year.

of viewing which a fee or admission is charged, collcted or received
shall pay a license tax ot Twenty-tour Dollars\$24.00)per year.
Sec.60. OIL DRILLING, PRODUCING AND REFINING. Every person con-
dncting, man!sing or carrying on the business ot drilling, producing
manutactdring or retining oil or other hydro-carbon substanoes or th
by-products thereof, including the distillation, marketing, selling
and delivering ot oil and its gy-products shall pay a license tax ot
One Hundred and Fitfy Dollars($150.00)per year, and prior to the
issuance ot such license shall make written application therefor to
the City Council and be governed in the matter ot such license as
more par~ioularly provided tor in the preceeding Section 21 ot this
ordinance, and no such license shall be issued ubtil and unless the
applicant shall agree to comply and shall comply with any and all
regulatory ordinances pertaining to the pperation ot such business
now in etfect or which may hereafter be adopted with reterence there o.
The provisions ot this section snall also include Wholesale dis-
tributors ot petroleum o~ the products thereot maintaining tankage
or storage plants within the City ot Seal Beach. That nothing in thi
section contained shall be deemed or construed as applying to auto-
mobile service or filling stations.
Sec.61. OTHER AMUSEMENTS. Every person conducting, managing or
carrying on or engaging in the business of exhibition shows or amus -
ments ot any character whatsoever, not otherwise provided tor in thi
ordinance, where an admission fee is charged, received or collected,
or any amount is paid tor the privilege ot viewing or participating
therein, shall pay a license tax ot Twenty-tive Dollars($25.00)per
year.
Sec.62. ORGANIZATIONS EXEMPTED. Religious, charitable, edncation 1
and tratel'nal organizations operated not for profit shall be exempte
from paying any license tax provided tor in this ordinance, and any
such organizations operating tor a protit shall pay a license tax
ot Ten Dollars($lO.OO)per year.
It shall,however, be unlawful,.tor any person as principal, agent
cr employee of any such organisation to carry on any business 01' pu
suit specified in this ordinance without f'irst"procuring a permit
from the Chiet ot Police ot said City so to do, and the Chiet ot
Police may issue a permit on every such applicatton therefor when th
business of pursuit shall not be detrimental to the best interests 0
the City ot Seal Beach or the inhabitants thereof.
Sec.63. PAWNBROKER. Every person conducting, managing or carryi
on the business of a pawnbroker shall tirst tile a written applicati n
theretor with the City Council as more particularly provided tor in
the preceeding Section 21 hereof, and in addition thereto shall pay
license tax ot One Hundred Dollars($lOO.OO)per year.
Sec.64. PEDDLING AND SOLICITING-GENERAL. Every person peddling,
soliciting, canvassing or taking orders for any <<oods, wares or mer-
chandise not otherwise specified in this ordinance not having a fixe
place ot business within the City of Seal BeaCh, conducting, managi
or carrying on the business ot running, driving or operating any aut _
mobile, autooobile truCk, automobile tank wagon, 01' any other vehicl
used for the transportation, selling, collection or delivery ot goo ,
wares, merchandise or other personal property of any kind from a veh
icle, either as his or its principal place ot business, or in con-'
nection with any other place ot business, or ot soliciting tor work,
labor or services to be pertormed upon the public street,in or trom
a vehicle, 01' to be perfuamed on goods, wares or merchandise or othe
personal property to be taken tor such purpose to a plant or establi h-
ment inside or outside ot the city limits ot the City of Seal Beach,
shall pay a license tax of Twenty-tive Dollars($25.00)per year per
vehicle so used in said business in said City.

toy balloODs, canes, horns, trumpets, musical or noise making instru
ments ot any kind, toys, badges, buttons, shoestrings, hairpins, led
pencils, combs, or other souveniers or novelties of any kind, shall
p~ a license tax ot Five Dollars($5.00)per da~ of Fitty Dollars
($50.00)per year. ,
Sec.6lil.. PEDDLING PRODUCE. Every person peddling either on toot
or by vehicle, or by boat, any fruit, nowers, nursery stock, vege-
tables, pi8kled goods, gum, nuts, ice cream, tamales, box lunches,
pp~atoe chips, poultry, eggs, dairy products(except milk),meats,

t.'Sec.69. PENAL CLAUSE. It shall be unlawfUl tor any person whether
as principal, agent, clerk, employee or otherwis8, either tor himsel ,
or tor an. other person, or tor any body corporate, or as en otticer
of any corporation, or otherwise to commence 01' carry on any trade,
calling, protession or occupation in this ordinance specitied in the
City of Seal BeaCh, without tirst having prooured a license from sai
City so to do, or without complying with any and all regulations ot ":
such trade, calling, protession or occupation contained in this ordi
nance; and the carrying on ot any trade, calling, protession or oceu
pation mentioned in this ordinance without tirst having procared a
license from said City so to do, or without complying with any or al
regulations ot such trade, calling, protession or occupation contain
ed in tbis ordinance, shall constitute a separate violation of this
ordinanee tor each and every day that such trade, calling,protession
or occupation is so carried on, and the violation of any ot the pro-
visions of this ordinance shall be deemed a misdemeanor and upon con
viction thereot shall be punished by a fine ot not to exceed Three
Hundred Dollars($300.00), 01' by imprisonment for a term not exceedin
three(3)months, or by both such tine and imprisonment.
? Sec.70. PENALTIES. All license taxes specified in this ordinance
shall be due and payable in advance; and every person or individual
who shall carry on tor ten days or less, any business or pursuit, to
which a license is required, whether having previously had a license
therefor or not, without tirst having procured a license theretoI',
shall be re~ired tc pay the regular,license tee or tax herein pro-
vided tar such business or pursuit end an additional ten per centum
thereot tor such license; and every person or individual who shall
carry on, for more then ten days, any business 01' pursuit for which

real estate salesman, solicit others to rent, buy, sell or exchange

in such license shall be deemed by the City Council detrimental tc

license shall be revoked, then in such event it shall be within the
discretion of said City Council whether a refund ot all or a portion
ot such license tax shall be made. That a license tax paid hereunder

Sec.78. SALE OF SECURITIES. Every person who shall sell or otfer
tor sale or to sell any securities of any corporation, trust, partne -
ship or other association, except such securities as may be the pro

For the purpose ot this section an "arcade"is detined to be one
ot general enclosure in which is conducted the business ot operating
or exhibiting any phonograph, graphophone, tall:~~g machine, kinetosc
biograph, projectoscope, or any other instrument or machine ot like
character, fbr the use ot which a compensation 01' tee is charged, an
exhibiting, showing 01' letting the use ot any microscope, ldng teste

Sec.72. PHOTOGRAPHS-GENERAL. Every person conducting, managing
or carrying on the business ot making photographs, tintypes, postcar
pictures, or other views or pictures made by any photographic proces ,
for compensation, and who maintains a regularly established photo-
graphic stddio within the City ot Seal BeaCh, shall pay a license t
ot Twelve Dollars($12.00)per year. Such license shall include the
right to solicit orders tor the same.
Sec.73. PLUMBING BUSINESS. Every person conducting, managing or
carrying on the business ct plumbing or doing any work tor Which a
plumbing permit is required shall pay a l1cense tax of R'1ghteezi ~l-
lars($18.00)per year.which license shall include the right to sell
plumbing fixtures, and aup)lies.

Sec.79. SELLING CLUB PLAN. Every person selling or ottering for
sale ~emberships in any club or co-operative association whereby the
purchaser of such membership is to be allowed a discount upon goods,
.ares, or merchandise purchased by such member, or a percentage ot
memberships sold, and any person otfering goods, wares or merchandis
at a discount, 01' free,or partiall~ free, as an inducement or reward
tor the pruchase of such club membership, shall pay theretor a licen e
tax ot Two Hundred Dollars($200.00)per year. Such license shall in-
clude the right to engage salesmen in the conduct ot such business.
Sec.80. SELLING TERRITORIAL RIGHTS. Every person engaged in the
business or occupation ot selling, or soliciting, or can.assing tor
the sale of territorial rights 01' privileges, exclusive or otherwise
to dispose ot 01' sell any goods, wares or merchandise within the Cit
ot Seal Beach, shall pay a license tax ot One Hundred Bollars($lOO.O )
per year.
Sec.81. SHOOTING GALLERIES. Every person condncting, managing or
carrying on the bBBiness ot a shooting gallery shall pay a license
tax ot Twenty-five Dollars($25.00)ppll'1' year, a nd shall tirst secure
a permit from the Chi~t ot Police of said City.
Sec.82. SHOWs.-DOG, CAT, S'J)OCK AND POULTRY. Every person conducti g,
managing or clU"1"Jing on a stock show, pet Show, or exhibition or liv
animals, poultry or birds, where an admission or entry tee is charge ,
or a show or exhibition where stutted, mounted or dead animals or
birds, or tish or similar curiosities are exhitited, and for which
an admission tee is charged, mall pay a license tax ot Five Dollars
($5.00)per day, or One Hundred Dollars($lOO.OO)per year.
Nothing in this section shall be deemed or. construed to authoriz
the holder ot any license hereunder to conduct, maintain, or carry 0
any other business in connection w~ such show or exhibition withou
tirst obtaining a license so to do as in this ordinance provided, an
in addition thereto a,permit shall be tirst obtained from the Chiet
ot Police of said City.
Sec.83. SHOWS:: TRAINED ANIMALS AND WILD WEB'll. Every person con-
dncting, managing or carrying on the business ot a trained animal
show or wild west show shall pay a license tax ot Fitty Dollars
($50.00)tor the firea day and Twenty-Five Dol~ars($25.00)tor each
additional day thereatter, and in addition thereto a permit Shall
tirst be obtained from the C~iet or Police or said City.
Sec.84. TANGO GAMES AND SD.{ILAR AMUSEMENT DEVICES. Every person
conducting, managing or carrying on the business ot maintaining a
place within the City ot Seal Beacb where a Tango Game, or games,
Hollywood Bridge, Darbs, and s1milar amusement and.recreational de-
vices are operated shall pay a license tax ot One Thousand Dollars
($l,OOO.OO)per year. And the applicant tor such a license shall tir t
make written application to the City Council, stating the name or
names ot the persGns or individuals making such application, with t e
street and number of the proposed location ot said business, Which
application shall be presented with the annual license tax herein-
above stated in cash o~ certitie~ or cashier's check, and the 6ity
Council re&BVes the right to reject any and all such applications
should it, atter such investigation as it may deem sutficient, de-
termine that the issuance of such license or the conduct ot such
business thereunder, would be detrimental to the public welfare,
health or morals, in which event such license tax shall be returned
and, provided further, said City Council reserves the right to re-
voke such license, in event the same is issued, upon the same groun s
that the further conduct ot such business would be detrimental to t e
public weltare, health or morals; and, provided, further that no S? h
business shall be operated in any place or in connection with or at
a locatdon which is a part ot the premises wherein alcoholic bever-
ages are sold or served under a license issued by or through the
State Board of Equalisation, nor shall any such business be operate

the lite thereot or the period tor which issued, in case ot.sale ot
the property covered'. thereby, unless otherwise provided in this ordi
nance, provided, that an indorsement is made by the original license
on the back thereot, giving the name ot the party to whom such trans
ter is made, date and signature ot the party transtering the same.
Said license must then be presented to the City Clerk an a duplicate
license issued to the holder or thransteree thereot in lieu ot the
former license tar the unexpired period ot time, if any, and without
additional charge theretoI'.
Sec .87. UNDERTAKERS. Every person conducting, managing 01' carryi g
on the business ot an undertaker, embalmer or funeral director, shal
pay a license tax ot Twenty-tive Dollars($25.00)per year.
Sec.88. VENDING MACH:nNES. Every person condncting, managing or
carrying on the business ot selling goods, wares, merchandise by
means of vending machines, shall pay a license tax ot Two Dollars
($2.00)per year tor each one-cent vending machine, and tor each tive
cent or more machine and punch boards teC.Dollars\$mO.OO)per year.
Sec.89. WAREHOUSES. Every person condncting, managing or carrying
on the business ot a warehouse, or maintaining a place tor the pur-
pose ot keeping or storing goods, wares 01' ~erchandise tor hire,
shall pay a license tax of Twenty-five Dollars($25.00)per year.
Sec.90. WEIGHING MACHINES. Every person carrying on the business
ot renting, leasing or maintaining any weighing machine wherein a
sum is charged by means of a coin slot or otherwise, shall pay a ~
license tax ot Four Dollars($4.00)per year tor each such machine;
provided, however, that no such license shall be issued tor the opel' -
tion of such a machine upon any street, alley, way or court, or upon
public property within the Cit,y ot Seal Beach.
Sec.91. WHOLESALE BBSINESS. Every person,conducting, manag:llig~or
carrying on the business ot wholesaling of any character within the
City ot Seal Beach not otherwise specitied in this ordinance,sijall
pay'a license tax ot Twelve Dollars($12.00)per year.

~.Sec.92. WHERE more than one occupation or business upon which a
ltcense tax is imposed by this ordinance is carried"on or conducted y
one person, tirm or corporation at anyone location, the license tax
for the combined business or occupation shall be the tax hereinbetor
imposed on that one ot said occupatdons or businesses on which the
highest license tax is paid hereunder.

ot this ordinance is tor any reason held to be invalid or uncpnstitu
tional, such decision shall not etfect the Validity ot the remaining
portions ot the ordinance. The City Oouncil ot the City ot Seal Beac
he:r:,eby declares that it would have passed this ordinance, and each
section, sub-section, sentence,clause or phrase thereot, irrespectiv
ot the tact that anyone or more other sections,sub-sections,clauses
or phrases be decll..d to be invalid or unconstitutional.
