AN ORDINANCE ORDERING, PROCLAIMiNG, CALLING, GIVING NOTICE
OF AND PROVIDING FOR THE HOLDING OF A SP:ECIAL MUNICIPAL
ELEx:TION TO BE HELD IN THE CITY OF SEAL BEACH, CALIFORNIA,
ON TUESDAY, THE 7TH DAY OF MARCH, 1939, FOR THE PURPOSE OF
SUBMITTING TO A VOTE OF THE QUALIFIED ELECTORS OF SAID CITY
A PROPOSED ORDINANCE ENTITLED:

INSTALL ANY DERRICK, MACHINERY OR APPARATUS FOR THE PURPOSE
OF DRILLING FOR, PUMPIIID OR PRODUCING OIL, GAS OR OTHER HYDRO-
CARBON SUBSTANCES FROM ANY WELL NOT EXISTING AT THE TINE THIS
ORDINANJE TAKES EFFECT, OR TO MAINTAIN, PUMP OR OPERATE SUCH
NEW WELL, WITHIN THE TERRITORIAL LD4ITS AND BOUNDARIES OF SAID
CITY OF SEAL BEACH, CALIFORNIA, AND PROVIDING PENALTIES FOR THE
VIOLATION HEREOF, REPEALING ALL ORDINANCES OR PARTS OF ORDINAN-
CES IN CONFLICT H.:.REWITH; ESTABLISHING A CONSOLIDATED SP:ECIAL
MUNICIPAL ELECTION PR:ECINCT, D;!:SIGNATING THE POLLING PLACE, AND
APPOINTING THE OFFICERS OF ELEx:TION.
The City Council ot the City ot Seal Beach, Calitornia, do ordain;

Section 1. A Special Municipal Election is hereby ordered, proclaim-
ed and called to be held in the City ot Seal BeaCh, Calitornia, between
the hours ot six O'OlODk A.M.,and seven o'clock P.M.,on Tuesday,the 7th
day ot MarCh, 1939, under an Act ot the Legislature, General Laws of the
State ot California, entitled: "City Initiative and Reterendum Law" (Stats.
Ex. Sess.1911, p.131;.AIIlended Stats .1915,p.319, Stats .191'( ,p.655), being an
Act to provide tor direct legislation by cities and towns, including init-
iative and reterendum; tor the following purposes, to wit:
(a) For the purpose ot submitting to a vote ot the registered quali-
tied electors of said City said ordinance proposed and submitted by the
City Council ot said City, without petition theretoI', which proposed ordi-
nance is in words and tigures; as tollows:

IN G THE POLLING PLACE, AND APPOINTING THE OFFICERS OF ELEx:TION."
The People of the City ot Seal BeaCh, Calitornia, do ordain;as tollows:
Section 1. It is hereby declared to be unlawful and a nuisance tor any
person, whether as principal, agent, servant, employee or otherwise, to
erect, construct, or install, or cause to be erected, constructed, or in-
stalled, or to work upon or assist in any way in the erection, construct-
ion, or installation ot any derrivk, machinery, or other apparatus or
equipment designed or intended to be used for the purpose ot drilling for
oil, gas, or other hydrocarbon substances, 01' to drill, or operate, OD to
work upon or assist in any way in the drilling or operating ot a well tor
oil, gas, or other hydrocarbon substances, or to pump or produce, or to
work upon or assist in any way in the pumping or producing of oil, gas, or
other hydrocarbon substances from any well not ac;ually being drilled or
existing at the time this ordinance takes ettect, within the territoriAl
limits and boundaries ot said City of Seal Beach, Calitornia.
Section 2. Every person, whether as ~rincipal, agent, servant,employee
or otherwise, violating any ot the provisions ot this ordi~ance, shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be pun-
ished by a tine ot not exceeding Three Hundred Dollars($300.00j or by im-
prisonment for not exceeding three(3)months, or by both such fine and tm-
prisonment; and every such person shall be deemed guilty of a separate
offense tor each day during any portion ot which the violation ot any ot
the provisions ot this ordinance is committed, continued, or permitted.

Section 3. All ordinanoes or parts ot ordinanoes in oonflict with
this ordinanoe are hereby repealed.
Section 4. That the polls tor said election shall be openea at six
o'clock A.M., ot the day ot said eleotion and shall be kept open until
seven o'clook P.M.,of the same day, when the polls shall be olosed; pro-
vided, however, that it at the hour ot closing there are any voters in
the polling plaoe, or in line at the door thereof, who are qualitied to
vote and have not been able to do so sinoe appearing, the ~olls thereat
shall be kept open a sutticient length ot time to enable them to vote,
but no one who shall arrive at the polling place atter seven o'clock P.M.,
ot said day shall be entitled to vote, although the polls may be open
when he arrives.

Seotion 5. The City Clerk shall cause this ordinancd or proposition
to be printed and shall mail a copy thereot, inclosed in an envelope
with a sample ballot to each voter at least ten days prior to the electio~
and at said election the Cler' shall have printed ballots to be used tor
voting upon suoh ordinance or proposition in the manner provided under
the "City Initiative and Reterendum Law" ,hereinabove referred to, and it
a majority of the qualified electors voting on this ordinance as proposed
shall vo.te in tavO'l' thereof, such ordinance shall thereupon become a bind-
ing and valid ordinanoe of the City ot Seal Beach, California.
Seotion 6. For the purpose ot holding said election the entire City
ot Seal Beaoh is hereby designated, fixed and established as one oonsoli-
dated speoial munioipal election preoinct, oonsisting of PrecIncts One
and Two in said CIty now established for the holding ot State and County
Eleotions therein, and the boundaries ot said precinct shall be the pre-
sent boundaries and territorial limits of said CItYi that the polling
plaoe for said election shall be the City Hall Building in said City ot
Seal B~ach and that the persons hereinatter named, being competent and
qualitied eleotors at said City and ot su~h election precinct, are hereby
appointed otticers ot election tor suoh election preoinot and they shall
hold said election and make return thereof in the manner provided by law,

Seotion 7~ That in' all particulars not reoited in this ordinanoe,
said election shall be held and conduoted as provided by law tor the
holding of municipal eleotions in said City.
Section 8. Tnat the City Council ot said City shall meet at their
usual plaoe ot meetIng in the City Hall Building on Monday, the 13th
day of Maroh, 1939, at 7:30 o'clock P.M.,ot said day and proceed to
oanvass the election returns and declare the results ot said eleotion.
Section 9. That the City Clerk shall cause this ordinance to be
published once in the Seal Beaoh Post & Wave, a newspaper ot general
circulation, pI' ted and published in said City and no other notioe ot
