HomeMy WebLinkAboutCC Ord 172 1932-09-15 . ...,. onDUTANCE NO~ 172 I AN" ORDINANCE CREATnTG AND PHOVIDING FOR A PLANlU~G COMMISSION AND AN OFFICIAL ~~STER PLAN OF THE CmTY OF SEAL BEACH, CALIFORNIA, PRESCRIBING THE POWERS AND WTIES OF SUCH PLANNING COM- MISSION AND THE PAYMENT OF THE EXPENSE OF THE MAINTENANCE THEREOF, AND RE- PEAL OF ALL ORDIJHU!CES IN CON- FLICT HERE/11TH. The Board of Trusteos and Clty Council ot ~he City of Seal Beach, California; do ordain as follows: Seotion 1. That in order to conserve and promote the public , he9lth, safety and general weltare, a Clty Plannlng Commlssion is hereby oreated end an official master plan is hereby edopted end established ln and tor the City ot Seal BeaCh, Californlo. Sec. 2. The Clty ~lanning Commlssion shall consist of the Clty Enginee~Jand slx(6)electors of the City ot Seal Beeoh who shall be appolnted by tho Mayor with the conflrmatlon of the City Council, I the Mayor and one other ex-ortioi~ member also appointed by t~e Mayor, and shall serve withoub compensatlon and durlng the pleasure of the lYISyor. Sec. 3. The Mayor may be the chairman of the oommission and. shall have the rlght to vote ln the delibe~etions thereof. The com- mission shall elect one of its members secretary, who shall serve for one year, or until hls or her suooessor is elected. The seoretary shall keep a proper reoord of the proceedings ot the commisaion, and shall recelve suoh compensation as shall be pl'escribed and authoi>1z6d by ordlnance by the Clty Council. The commiasion may appoint suoh I other offioers and employees as it may deem necessary fo~ its ~ork,and may also oontract with architects, city planners, engineers end other oonsultants for suoh servlces as it may reqUire. Sec.4. The City plannlng Commisslon shall hold its organize- tlon meeting in the legislative chamber of the clty council ui~hin ben dsya after appointment and quellfication of lts members, and shall thereafter hold at least one regulnn meetlng In each calendar month, at such tlme and place as lt shall flx by resolution. Special meetings 1. I I I / Ordinance Number . may be called at any tlme by the Mayor, or by three members of the commisslon by wrltten notice served upon each member of the commisslon at least three hours before the tlrne speoified for the proposed meet- lng. Four members of the commisslon shall constltute a quorum for the transaction of business, but a lesa number may adjourn from time to time. Sec. 5. Powers and Dutles. The City Plannlng 60mmisslon shall have the power, except as otherwise provlded by law: (a)master Plan. To make and adopt a master plan tor the physical development ot the Clty of Seal Beach, wlth accompanying maps, dlagtams. charts, descriptive matter and reports, which master plan shall lnclude the tollowlng subjects matter: 1. Major Traftlc Street Plan. Such plan to show the general locatlon and width of a comprehenslve system of major hlghways and thoroughtares. 2. Districting Plan. Such plan shall be comprehensive and shall show proposed dlstricts in whlch the use, height and bulk of buildings and premises are llmlted; provided, that ordlnances and amendments thereto esrabllshlng such districts shall be adopted only atter maklng of the reports, holding the publlc hearlngs and following the 8a~e pro- cedure as prescribed in Chapter 784 of the Statutes of the State of California of 1&29,Approved June 17, 1929, Act 5211b, Sntitled "An Act ~o Provide For The Establishment Of Otflclal Master Plans And 7he Appolntment ot Planning Commisslons In Cltles" ;and.as amended or here- atter amended and adopted. ~. Transportation Plan. Such plan may show the proposed loca- tlon of rights of way. terminals, vladucts, grade separatlons and otheI' tacilities for steam and electric ral1roads or other means for carrylng passengers and freight and related pnblic utillties and improvemonts; such plan may include plans for the developement of port,hatbor, and avlation tacllitles. 4. Translt Plan. Such plan ~ay show a proposed system of rapld transit 11nes, street car and motor bus llnes and facllitiea, and re- lated publlc utllitles and improvements. 2. I I I Ordinance Number . 5. Park and Recreation System' Plan. Such plan shall show the needs ot the clty or sections thereof tor parks, parkways, playgrounds, and school and recreation areas, and when practlcable the plan may show the proper and most advantageous locations for proposed p~rks, parkways, playgrounds, school and r~oreatlonsl areas. 6. Group Building and Other Plans. Such plans may show the pro- posed location, grouping and architectu~al treetment'ot public or ot~er~ bulldlngs, and proposed plazas, squares and opon spaces; and, the co~- misslon may make such other plans, studies end recommendstlons as it may deem neceosary for thc orderly,econo~ic and social development ot the area under lts jurlsdictlon, all ln accordance wlth thls ordlnance and the Gencral Laws of the State of Callfornla. (b) approval Of Moster Plan. No plan or map, hereafter, shall have lndlcnted thereon that it ls a part ot the master plan until lt shall have been adopted as part of the master plan by the legislative body 9S herelnatter provided. All !l10neY9 collected from the sale of an~' of the maps, plats, charts or other descriptive matter regarding the master plan publlshed by the commission shall be paid into the clty treasury and shall be credited to the funds budgeted or allocated for the use of sald commlssion. Sec. 6. Adoption Of M~st~r Plan. Betore adopting the master plan or any part of it, or any substantial amBndment thereof, the com- misslon shall hold at le~st two publlc he~rin~s at least tlfteon(15J days apart, notice ot the time of each of whlch shall be given by one publiclition in a newspapoL' of g,cnol'cl circulation in ti.le municipality 01' county., The adoptlon of the master plan, 01' of c.ny amendment, ex- tension or addition there.t, shall be by resolution of the con~ission carried by the affirmatlve votes of not less than :lmo-thiI'ds of the total ae~bership of tho cO~1DUission. The resolution sholl refer express- ly to the maps and descriptlve and other matter intended bj the com- mlsslon to constitute sa!a plan or any amendmont,addition or ~xtension thereot, and the action taken sholl be recorded on the map and plan and descriptlve matter by the indentlf~lng slgnature of the sec:.etary of the comm1ss1011. An attested plan adopted by the planning co~miss1on 3. I I I Ordinance Number . or any part, amendment, extenslon or addition of the master plan, shall be certifled by copy thereof to the legislatlve body. Sec. 7. approval By Legislativo Body. Upon recelpt of en attested copy of the master plan,' or any part thereof, as adopted by the plannlng commlsslon, a public hearlng thereon shall be held by the legls1ative body. at least ten(lOJdaye' notico of such publlc hcering shall be pub11~hod in an official publication of sald city, or in a newspaper of genoral clrculation thereln. No ohange or ad- dition to sold master plan, or any part of it ,s adopted by the plan- ning commlssion, shall be mo~o by thc legislative body until such pro- posed change ls referred bock to tho ~lcnning cormr.lssion for 0 report and an attested copy of said report flled wlth the legisletlve body; but the fallure of the commisslon to so report ~lthln thlrty(301daya from and atter the dote of the request for such report by the logis- letlve body shall be decmed to be an approval thereof, provlded,that lt such addltions or chsnges'bo cisapproved by the commission, a majoI'ity vote of the entire membershlp of thE legiolative body shall be necessary bo passany ordlnance overruling such desapproval by the commlss10n. Sec~ 8. Expenses. The Clty Councll,rnay, ln making lts annual tax levy and as a part thereof, levy and collect a tax, not to oxceed in any fiscal year the sum of two mllls on the dollor of assessed valuation for the parpose of defraylng the la~ful expenses lncurred by the planning commission in carrylng out the purposes of thls act, and may moke appropriations from other funds therefor. Sec.9. All ordlnances, or p81'1;s of ordlnances and I'esolutlons in contlict wlth thls oI'dinance are heI'eby repoaled. Sec;.. 10. The City Clerk s0.911 certify to the paasage of this ordlnance by the Board of Trustees and Clty Councll of t~c City of Seal Beach, and cause the same to be published once ln the Seal Beach Post and Wave, and to be posted in three public pIsces in sald city; towit: the 61ty Hall Building, The United State Post Office and the Californlo State Bank and thereupon it shall take effect.
