'fhe City Council of the 'City of Seal Beach, California,
do ordain; as follows:
Section 1. Transfer and Trucking and Selling from Vehicles.
That Ordinance No. 152, 'An ordinance licensing and regulating
certain businesses and pursuits carried- on within said City of Seal
Beach, be amended by adding thereto a section to read as follows:
Section 88-a. For ,every person, firm,or corporation con-
ducting or carrying on the business of peddling, selling, collecting

or delivering goods,war~s, mercnondise o~ arr! ~ther person/property
ot any kind ~rom a vehicle, wheth~r a motor vehicle or othe~nise, or
ot. sollciting tor work, labor or services to be performed upon the
public street, in or from 3 vehicle, or to be performed on goods,
wares, merchandise or other personal property to be taken for such

purpose to a plant or. estoblishmen't inside or outside of the city
limits of the City ot Seal Beach, according to the type of business,
and which business'i~ not ot~erwise classified in the within ordinance
No. 152, sholl pay a license, os follows:
(1) Those handling foodstuffs, liquids and other products
for human cons~ption, which are not kept wrapped in packages or sealed

The provisions of this section ~ are not to be con-
strued as imposing a tax upon vehicles, but as Q method of classification
of, businesses and distinguishing between those maintaining a place of
business in the conduct of whj,ch no vehlclE;ls are use,d, and those
maintaining a place ot business in the conduct ot whic~ vehicles are
used.
In computing the license tax ,to be p~id by any perRon
conducting a business or occupation in ~hich.a vehicle ls used, in
the manner stat,e,d in thisl section, the amount of the license lmposed
by this sectlon or sections shall be added to the license tax otherwise
paid or imposed under, other provisions pt said Ordinance No. 152,
and amend,ments thereto, :and the sum total thereof shall be considered as
the amount of license tax imposed upon sald business.
The City Clerk shall issue numbered plates to each
licensee, one plate for each vehicle so used, which plate shall be
plsced conspicuously on bhe rear of eoch vehicle referred to 'herein.
It shall be unlawful to place, any such plate on, a. vehicle not used. by
the licensee in such business, or to drive or operQte ~ vehicle u~on
, ,
which a plate is placed in violation of this'prov~sion, or to drive
or operate a vehicle engaged in any such business upon which -no pl~te
is placed.

Nothlng herein contained shall be c?nstrued as requiring
any fee hereunder from any person now or hereafter exempt from the pay-
ment of such fee either by the laws of the State ot California or of
the United states of America.
(5) Penal Clouse. It shall be unlawful for ,any person,
whether as principal, agent, clerk, employee or othe~flise, either' tor
himself, or for alW other p3rson, firm or corporation, or othe~vise,
to commence, carryon, or operate alW such vehicle or'business in said
City of Seal Beach, without first having procured a license from said
Cituso to do, or without complying with all of the regulations herein
contained, and a, failure to do so, shall constitute a separate violation
of this ordina:lce tor each and every clay that: Sitch businesA or vehicle

the provisions of this Ordinance slla.Ll '.lEl deemed Guilty of a misdo-
meanor, and upon conviction thereot, s;lall be punished by a fine ot
not more t~la n 'ihree iiundred (:)300.00) j)ol1ars, or by itlprisonment for a
torm of not oxceeding three (3) months, 01' by both such fine and im-
prisonment.
(6) Section 4, of Ordinanoe Ho. 167, An Ordinance ar~endinc;
Oro,inance ::0. 152, is ~Iereb~' repealed.
(7) ~J".e Cit;i Clerk 8:1a11 certify to the adoption of this
ordinance by the City":'Council of the Clty of Seal Beach, and cause the
same to be published once in 1110 Seal Beach Post and Hove, a newspaper
