ORDIl'lANCE NO. /8 I> AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, PROVIDING FOR THE LIC ENSING AND RIDULATION OF PUBLIC DANCE HALLS AND RESTAURANTS AND CAFES,WITH DANCING AND ENTERTAINi\IENT,CARRIED ON UITHIN SA:J:D CITY,AIdEND- ING ORDINANCE NO.152,BY ADDING t NEW SE:JTIONSNO.79-a and NO.79-b THERliIlrO, FIXING P ENALTI BE FOR THE VIOLATION HEREOF AND REPEALING ORDINUl'JE NO.182 AND ALL ORDINANCES OR PARTS OF ORDINANCES IN COl'lFLICT HERE\'lITH. The Clty Council of the City of Seal B.each,Callfarnia,do ordain; as tollows: Section 1. PUBLIO....DANCE HALL. That Ordlnance No.152,entitled,"An Ordinance of the Oity or ~eal Deach,Californla,Providing For Licensing and Regulating irertain Businesses and Pursuits Carried On \flthin Said City,Repealing Ordinances Nos.7,53,55,9l,94 and All Other Ordinances In Conflict With This Ordinance And Fixing Penalties For the Violation Hereot" ,be amended by addling thereto a section to read;as follows: Sec.79-a.Every person,as defined in said Ordinance No.152,conduct- tng,managing or carrying on the business of a public dance hall, shall first secure a permlt from the City Council,as hereinafter provided, to conduct or carry on such buslness, and in addition thereto shall pay a license tax ot Twenty-five Dollars(~25.00}per month, or Two Hun- dred and Fitty Dollarsl~250.00)per year In advance,it payable yearly. The term"public dance hall"as used herein is defined to be any place where public dances are regula~ly carried on tor either a tixed charge or a charge tor each dance, with or without entertain- ment,and other than a restaurant or cafe with dancing and entertainment. Sec.2. RESTAURANTS AND CAFES WITH DAll'JING. ~hat Ordi~ance No.152,above entitled,be amended by adding thereto a section to read; as follows: Sec.~9-b. Every person,as detined in said Ordinance No.152,con- ducting,managing ~ carrying on the business of a restaurant and cats with dancing and entertainment, shall first secure a permit from the City Council,as hereinafter provided, to cobduct or carry on such busi- ness,and in addition thereto shall pay a license tax of One tlundred and Fifty Dollars(~150.00}per year in advance. Sec.3. The holder of a license hereunder shall not operate such a public dance hall or dancing in restaurantl or cafe as designated in Section 1 and 2 hereof without keeping present and on duty at all times when dancing is carried on a special police officer commissioned by tae-Chief ot Police of the City ot Seal Beach but to be compensated page 1. ~ I I I Ordinance Number , for such services by the person, firm or corporation carrying on or operatlng such public dance hall or restaurant or cafe. Sec.4.APPLICATION ~ LICENSE. Application tor such License or Licenses to operate or carry on dancing as designated in Sections 1 and 2 hereot shall be made to the City Council pf said City in Writlng, statlng the name or names of the person,tirm or partnership, or corpor- ation,making the appllcation,with the place of residence ot each, the street number of the proposed location of said business;the application shall be presented with the annual or monthly license tax,as the BaSe may be,in cash or cashier's check drawn in tavor of said City upon a Los Angeles or an Orange County bank, and the City Council hereby re- serves the right to reject any and all such applications should it, after such investigation as may seem sufticient,determine that such lice8se or licenses, or the conduct of such business thereunder, would be detrimental to the public welfare, in which event the annual license tax shall be refunded or the cbBck returned. Sec.5.REVOCATION OF LICENSE. 5hodld such license be granted then the llcense clerk sUSll issue a license hereunder; and, provided further, that any license issued hereunder shall be non-transterable from the ~ place of business designated therein to another and/or from the person . to whom issued to another, and that said license shall be revocable by the City Council ot sald city at any time after the lssuance thereof, should the City Council,atter such investigation as lt may deem suf- ficlent,determine that the holder thereof has violated any of the terms and conditions of this ordinance or other ordinances ot the city and/or that the conduct of the business thereunder has become detrimental to the public weltare. Sec.6.PEMAL CLAUSE. It shall be unlawful tor any person, whether as principal,agent,clerk,emplluee or ptherw14e, either for himselt,or tor any other person, firm or eorporatlon, or otherwise,to commence, carry on, conduct or operate any public dance hall or restaurant and cafe with dancing as herein defined without first having procured a license from said City so to do, or Vlithout complying with allot the regulations herein contalned,and a failure so to do,shall constitute a separate violation of this ordinance for each and every day that page 2. I I I Ordinace Number such business shall be operated in said city and any such person violating any of the provisions of this ordinance shall be deemed guilty of a mis- demeanor, and upon conviction thereof, shall be punlshed by a fine of not mpre than Three rlundred Dollars(~300.00),or py imprisonment tor a term of not exceeding three(3}months, or ny both such flne and imprlsonment. Sec. 7.REP~. That Ordinance No.1B2 and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. Sec.B. That Clty Clerk shall certify to the adoption of this ordinance by the City Cmuncil of the City ot Seal Beach,Callfornia, and cause the same to be published once in the Seal Beach Post & Wave, a newspaper of general circulation, prlnted, published and circulated ~n said City,and it shall thereupon take effect.
