DOLLEY, JESSE R. JOHN and C.O. WHEAT. MEM- BERS OF THE BOARD OF TRUSTEES OF SAID CITY; ESTABLISHING AN ELECTION PRECINCT OF SAID CITY AS A WHOLE. DESIGNATING THE POLING PLACE AND APPOINTING OFFICERS OF ~AID ELECTION. WHEREAS, on the 4th day of ootober. 1927, three oertain Petitions were filed with the City Clerk of the City of Seal Beaoh, California, demanding the. removal and recall from office of R. ~. Dolley. Jesse R. John and G. O. Whest, . J respectively, as members of the Board of Trustees of Baid Ci ty; and. WHEREAS, within ten days from the date of such filing of said Petitio~ the City Clerk of said City examined the same and found them to be sufficient, and on the 5th day of Ootober, 1927, attached her oertificate thereto showing that Baid Petitions were signed by the requisite number of qualified voters of said City and so certified said petitions to be sufficient; and, " WHEREAS, on the 6th day of October, 1927, at a regplar meeting of said Board of Trustees, said City Clerk submitted said Petitions with such oertificate attached there- to to the Board of Trustees of said City of Seal Beach; NOW, THHREFORE, the Board of Trustees and City Council of the City of Seal ~each, do ordain as follows: I Section 1. That a special municipal election sha be held in the City of Seal Beach on e 28th day of' Augpst,1928, for the purpose of submitting to the qualified electors of said City of Seal ~e~ch, the question of, and to determine whether the votere of such City will recall R.E. Dolley, Jesse R. John and C. O. Wheat. now holding office '. , 1. ~ " I I I. Ordinance Number t - as the duly eleoted and qualitied members of the Trustees and Oity Council of said City. Sec. 2. That for the purpose of holding said special municipal election hereby called, the enthe Oity of Seal Beach is hereby designated, fixed and established as one special municipal eleotion precinct, and the boundaries of said precinct shsll be the present boundaries and territorial limits of said City; that the polling place for said election and the officers of said election, shall be at the same place and the same offioers of election, as shall be designated by the Board of supervisors of the County of Orange, for the holding of the stste Primsry Eleotion, to be held in said City of.Seal Beach on ssid 28th day of August, 1928, as by Isw provided. sec.~. That the polls for ssid special municipal election at the polling place herein designated shall be . opened at six o'clock A. M., on the day of the special Muni- cipal election, and shall be kept open continuously thereafter until seven o'clock P. M., of said day, when the polls shall be closed~ except that if, at the hour of closing there are any voters in the polling place, or in line at the door, who are qualified to vote and who have not been able to do so since appearing, the polls shall be kept open a sufficient time to enable them to vote, but no one who shall arrive at the polling place after seven o'clock P.M., of said day sha11 be entitled . to vote, although the polls may be open when such one arrives; and when said polls shall be closed, the election officers shall then proceed to canvass the ballots cast at laid eleotion as by law provided. Sec. 4. Notice is hereby given of the holding of said special municipal election and of the time and place of 2. --, I I I Ordinance Number . - holding the same and that in all particulars not recited in this ordinance, said eleotion shall be held as provided by law for holding municipal elections in said City of Seal ~each. Sec. 5. That the City Clerk is hereby instructed to prepare and cause to be printed on the proper kind of paper at the expense of said City all supplies required for said eleo- tion, and a sufficient number of ballots therefor, and to fUr- nish and provide the same for the use of the voters at said election. Sec. 6. There shall be printed upon the ballots, which shall be prepared as hereinbefore provided for by the City Clerk of said City, in not more than two hundred words, the reasons set forth in said Recall Petitions for demanding the recall of the members of the Board of Trustees named and designated in said petitions, which reasons are as follows: That said Trustees, R.E. Dolley, Jesse R. John and O. O. Wheat, are incompetent to properly administer and transact the business interests of the City of Seal Beach, and by reason of said incompetency have not properly administered aId trans~cted the business of said City) and upon such ballots there shall be printed in not more than two hundred words a statement whereby said Trustees and City Councilmen sought to be recalled, justify their course in office which shai 1 be as follows: 1. That R.E. Dolley, Jesse R. John and C.O. Wheat Trustees and City Councilmen of said City sought to be recalled, are each owners of real property in this City and tsx payers. 2. They have openly encouraged every legitimate busimess enterprise and without fear or favor have upheld the laws of the City, County, State and Nation. 3. They have regarded the rights of residents and have refused to be dictated to by corporate and unlawful intere~ts. 4. They have maintained an efficient polioe de- partment and insured law, order and safety to the inhabitants of the City. 5. They represent civic improvement and advancement ; 3. ., I I I Ordinance Number , . . are in favor of industry and amusement under reasonable regplations and the city has advanced under their administration, in spite of the fact that they have been charged with incompetency by a political minority seeking to recall them from the offioes to which they have been duly elected by the votere of Seal Heaoh, and which offi- ces they are each respectively qualified to administer. That in addition to the above there shall be printed on'such recall ballots as to each officer whose recall is to be voted on thereat, the following cp.estions: "Shall R.E. Dolley be recalled from the office of a member of the Board of Trustees of the oity of Seal Besch, California?" "Shall Jesse R. John be recalled from the office of a member of the Board of Trustees of the Oity of Seal Beach, California?" and "Shall 0.0. Wheat be recalled from the office of a member of the Board of Trustees of the City of Seal BeaCh, California?" and following each of which questions there shall be printed the words "yes" and "No!' on separate lines with a blank at the right of each in which the voter sm 11 indicate by stamping a "X" his vote for or against such recall, and in all other respects such ballot.shall be as by law provided. Sec. 7. ~t the City Clerk shall attest this Ordinance and certify to the passage and adoption of thie Ordinance... order, Notice and proclamation by the Board of Trustees of the City of Seal Beach, and oause it to be printed and posted . in four public and conspicuous places in said City of Seal Beach, and published once in the Seal Beach Journal and the Seal Beach Post and Wave, newspapers of general circulation, printed and pUblished in said City of Seal BeaCh, and this Ordinance, being an Ordinance calling an election, shall there- upon take effeot immediately upon its passage and adoption. _/J ., .....r> ~"'v, _ f/UJ Jj;......
