AN ORDIN~~CE REGULATING THE BUSINESS OF COlfDUCTING
MASSAGE PARLORS AND OTHER BUSINESSES SIMILAR THERETO

6 The City Council of the City of Seal Beach ordains as follows:
7 Section 1. DEFTIfITIONS - The following words, as used in this
8 ordinance, shall have the signification attached to them in this
9 section, unless otheruise clearly apparent from the context:
10 (a) PERSON - The word "person" shall mean and include both the
11 singular and plural, and shall also mean and include person, indivi-
12 dual, firm, corporation, co-partnership, association, club, society,
13. or any other organization,
14 (b) 1!ASS1I.GE - The word "rnassage" sho.ll mean and include a
15 method of treating the external parts of the body for remedial or
16 hygienic purposes, consisting in rubbing, stroking, kneading, adjust-
ing or tapping with the hand and/or hands, or any instrument,
_ (c) 1'ASSAGE PARLORS - The term "lnas rage parlors ". shall mean
and include any turkish bath parlor, battle creeK system treatments,

magn~tic healing institute, massage parlor or any place or institution
where treatment of the hwnan body is given by means of JilB.ssage or bath,
(d) ~\t4.SSAGIST - The r.ord "massagistll shall mean und include
both the singular' and plural! and shall aJ.so JJlean and include any
person who practices l:lo.ssage.
Sec. 2. RE1UIRK~NTS - It shall be unlawful for any pirson to

practice, engabe in or carryon the business of a lllB.ssagist or conduc4

a massage parlor in the City of Seal Beach without first having ob-
tained a license as hereinafter provided, frOll! said city, and comply-
ing with any and all ~egulatio~s and_r~quirements as hereinafter con-
tained and set forth in this ordinance. -
Sec. 3. APPLICATION - (a) Each and every person desiring to
carryon the business of a massagist or conduct a massage parlor in

1 the City of Seal Beach, sh~ll make a written application to the City
2 Clerk for a license to conduct said business. Said ap~lication
3 shall be signed &nd sworn to by said applicant and shall state the
4 true or fictitious name or nmaes of said applicant, his or her age,
5 present street addre~s, and other address or addresses where applican
,6 may have lived at any tim.e during the six (6) months immediately pre-
7 ceding the d&te of said application;, the nallle under which, and place
8 where said applico.~t proposes to conduct said business, together with
9 the street, city, cQunty and state address where said applicant
10 practiced or conducted any similar business, if any, within twelve
11 ,(12) months immediately preceding the date of ~aid application, and
12 the name under which the S~lme r;as so conducted.
(b) Said application shall also include a photograph in tripli-
cate, of said applicant, of a size prescribed by the City Clerk, said
photograph to be attached to the original ap~,lication, one to the
duplicate, and one to the license, if 0. license to conduct or carry
on said business is granted said applicant.
All applications shall be made in duplicate, one of which shal~

19 be transmitted by the City Clerk to the Chief of Police of said city
20 for investi~ation, and the license Hpplied for shall not be issued to
21 said applicant until the ex~iration of sixty (60) days from date of
22 s~id application, unless. a satisfactory report is made by said Chief
23 of Police before the expiration of said period. If no adverse report
24 ~oncerning said applicant is made by the Chief of Police, then said
25 application shall be presumed complete, ~nd a license authorized and
2() issued u:pon the payment of the required license fee.
27 Sec. 4. LICENSE tEE ~ (a) Any person owning, maintaining or
28 . conducting a massage parlor as defined herein, shall pay to the City
29 of Seal Beach a license fee of Twenty-five and no/100 Dollars ($25.00

per year.
(b) Every massagist operating, working or employed as a ma~seur
in the City.of Seal Beach, excepting any person who owns, op~rates or

1 conducts a massage parlor in said city, and having complied with the
2 requirements of this or~inance, shall pay a license fee of One and
,
3 No/IOO ($1.00) per year.
4 (c) No license issued under the provisions of this ordinance
5 shall be transferrable.
6 Sec. 5. MASSAGING ?:lEMBEB.S or' OPPOSI'l.'E SEX PROHIBITED - It shall
7 be unlawful for any female massagist to ~ssage any person of the male
8 sex, or any male massagist to massage any person of the female sex.
9 Sec. 6. RECORD TO BE KEPT - Every person maintaining, conducting
10 or operating a massage parlor in the City of Seal Beach, shall at all
11 times, in connection th~rewith, keep a registration bDok in which each

12 an~ every client or patient shall personally sign in his or her own
13 handwr~ting, his or her true name in full, place of residence, and
14 date of treatment, and provided further that such registration book
15 shall be open at all times to the inspection of any police officer of
16 the City of Seal Beach.
17 Sec. 7. EXCEPTIONS - None of the provisions of t~is ordinance
18 ,shall apply to any physician, surgeon, chiropractor, osteopath, or
19
any graduate nurse working under the supervision o~ a duly' licensed
physician, surgeon, chiropra~tor or osteopath, duly licensed to prac-
tice their respective professions in the State of California.
Sec. 8. REVOCATION - The City Council of the City of Seal Beach
shall forthwith revoke the license of any person upon receiving satis
factory evidence of the 'violation of any of the 'provisions of this
ordinance, or any other law or ordinance of the City of Seal Beach or
State of California relatin~ to such business, or UDon the recommenda
tion of the Chief of Police.
28 Whenever a license shall have been revoked under the terms of
.29 this ordinance_, no othe~ ap~lication by such person shall be considerEd
30 for a period of one (1) year fro;,l date of such revocation.
31 Sec. 9. EXPIRATION OF LICEI~SE - Upon the expiration of any licelse
32, issued under the provisions of this ordinance, the holder thereof sha_.l

4 setting forth that he or sh~ has conducted s~id business as designa~ed
5 in said license, at the street and number set forth therein, and in
6 a proper, rezular and laHful .wanner during the life of said lfucense.
7 Sec. 10. VALIDITY - If any section, subseotion, sentence, clause
8 phrase or uord of this ordinence is for any reason held to be invalid
9 or unconstitutional, such deoision shall not affect the validity of
10 the remaining p.ortions of this ordinance. The City Council hereby de-
11 clares that it would have passed this ordinance, and each section,
12 subsection, sentence, clause, phrase or word thereof, irrespective of
13 the fact that any one or more sections, subsections, sentences, clausel,
14 phrases, or uords be declared invalid or unconstitutional.
15 Sec. 11. PEl~LTY - Every person, as prinoipal, agent or otherwise
16 violating or f" iling or neglecting or refusing to comllly VIi th any of
17 the provisions of this ordinance shall be deemed guilty of a misde-
18 meanor, and, upon conviction thereof, shall be ~unished by a fine not
19 exceeding Five Hundrgd and no/100 Dollars ($500.00) or by imprisonment
20 in the city jail, or in the county jail, as may be designated by the
21 Judge upon conviction, for not more than six (6) m~onths, or by both
22
such fine and imprisonment; and each such person, as principal, agent r

otherwise, shall be deemed guilty of a separate offense for each day
24
dur ing any portion of ',hich ~he violation of, or fdlure, neglect or
25 .
refusal to comply with any of the provisions of this ordinance is
26
cOnllnitted, continued or permitted by suqh person.

Sec. 12. REPEAL CLAUSE - All Ocher ordinances and ~arts of or-
28
dinances in conflict herewith are hereby repealed.

Sec. 13. 'fhe City Clerk shall certify to the passage of this
30
ordinance by the City Council of the City of Seal Beach, and cause
31
the srume to be published once in the Seal Beach Post and TIave, mld to
32
be posted in three (3) conspicuous places in the City of Seal Beach,
