ORDINANOE NO. /..3.3 AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIF- ORNIA, ORDERING AND PROVIDING FOR THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON FRIDAY, THE 7TH DAY OF JANUARY, 1927, TO DETERMINE WHE.'rHF;R THE VOTERS ViI LL RE- CALL R. E. DOLLEY, JESsD R. JOJfN~ and C.O. WHEAT, MEMBERS OF Tim Bt>ARD OF TRUSTEES OF SAID CITY; ESTABLISHING AN ELECTION PRECINCT OF SAID CITY AS A WHOLE, DESIGNATING THE POLING PLACE AND APPOINTING OFFICERS OF SAlD ELEOTION. WHEREAS, on the 8th day ot November, 1926, a Petition was tiled with the City Clerk ot the City of Seal ~aoh, Calit- ornia, demanding the removal and reoall trom office ot R. E. Dolley, Jess;te R. JOPnI and C.O. Wheat aa members ot the Board ot Trustees ot said City; and - WHEREAS, within ten days trom the date ot such tiling of said Petition, the City Clerk of said City examined the same and found it to be sufficient, and on the 16th day of November, 1926, attached her certificate thereto showing that aaid Petition was signed by the requisite number ot qualified voters ot said City and so certified said petition to be sutficientI and WHEREAS, on the 18th day of November, 1926, at a re~lar meeting ot said Board of Trustees, aaid City Clerk'sub- mitted said Petition with such certificate thereto attaohed to the Board of Trustees of said City ot Seal Beach; NOW, THEREFORE, the Board ot Trustees of the Oity of Seal BeaCh, do ordain as follows: Section 1. That a speoial municipal eleotion shall be held in the City of Seal Beach on Friday the 7th day of January, 1927 tor the purpose of submitting to the qualified eleotors ot said City of Seal Beach, the question of, and to determine whether the voters of such City will recall R. E. Dolley, JessIe R. JOhnl and C. O. Wheat, now holding otfice 1. I 1 I . 7 8 9 10 11 12 l3 14 15 16 17 Ordinace Number 1- . . 1 as duly elected and qualified members of the Board of Trustees 2 of said City. 3 Sec. 2., That tor the purpose of holding said 4 5 special municipal election hereby called, the enti~City of Seal Beaoh is hereby designated~ fixed a~established as one speoial municipal eleotion preoinot, and/the boundaries of said precinot shall be the present boundaries and territorial limits 6 of said City; that the polling place for said'election shall be at the City Hall Building in said Oity ot Seal Beaoh; and the tollowing persons are hereby appointed otficers or said eleotion tor said special municipal eleotion precinot, res- peotively: Inspeotor~ : Judges: Fran~o~lath Edwin A. Murray and Albert E. Swain Clerks: Mrs.Adelaide Dodson, Mrs.Caroline Harding and Everett W. Reed. seo. 3. That the polls for said special municipal eleotion at the polling place herein designated shall l8 be opened at six 0' clock A. M. on the day of the speoial Mun- 19 icipal eleotion, and shall be kept open continuously thereafter 20 until seven o'olock P.M. of said day, when the polls shall be 2l closed; except that if, at the hour of olosing there are 22 any voters in the polling place, or, in line at the door, who 23 are qualitied to vote and who heve not been able to do so sI. nce 24 appearing, the polls shall be kept open a sutticient time to 25 enable them to vote, but no one who shall' arrive at the polling 26 place after seven o'clock P.M. of said day shall be entitled 27 to vote, although the pollS may be open when suoh one arrives; 28 29 and when said polls shall be closed, the eleotion offioers shall them proceed to canvass the ballots cast at said eleotion as 30 by law provided. 31 Seo. 4. Seo. 6. That the City Clerk is hereby instruoted to prepare and cause to be printed on the propel' kind of paper at the expense ot said City all supplies required for said elec- tion, and a sufficient number of ballots therefor, amd to fUr- nish and provide the same for the use of the voters at said election, and aaid City Clerk shall cause to be printed suoh sample ballots as may be !'Ctq1iired by law, and shall oause suoh . sample ballots to be mailed to the eleotors of said Oity at the time presoribed by law. Sec. 6. There shall be printed upon the sample ballot, whioh shall be mailed as hereinbefore provided for by the City Clerk ot said City, in not more than two hundred words, the reasons set forth in the Reoa~l Petition for demanding the reoall of the members ot the Board ot Trustees named and designat d in said Petition, whioh reasons are as follows: 1. That none of said members derive their main- tainanoe from or in the City ot Seal BeaCh, and in conse- quence are not, and have not been, in sympathy with, and have openly antagonized and discouraged business enterprise. They habitually meet in private, conduct the business of the oity in seoret, and but meet openly to give ettect to their plans, arrived at in star chamber. They have con- temptuously ignored the opinions of the other experienced members of the board, and thus have engendered distrust and disoord. 2. They have maintained a gloritied polioe department, composed of inexperienced and incompetent officers, in numbers, three times as large, or more, than heretofore neoessary, Where at most, three men heretotore were sufficient to polioe the city, they have kept from six to ten men on the pay rOll" thus adding an unnecessary burden on taxpayers. 3. Theil' administration of the business of the city has been extravagent, wastefUl and bungling through- out, they have lost the oonfidenoe of the oommunity; The taxpayers and qualitied ~oters recognize their inoom- petenoe, or capacity to properly administer the business interests ot the city, and the qualitied eleotors demand their removal and reoall trom office as members of the board of trustees; 3. That R. E. Dolley, JessJ.e R. JOhn' and C. O. Wheat, members of the Board of Trustees soughT to be re- called, are each owners of real properrty in this City and taxpayers. 2. That they have openly encouraged every legitimate business enterprise and without fear 01' favor have upheld the laws of the city, State and Nation. <: 3. That they have been solicitous of the right~ of residents and have refused' to be diotated to by corporate and unlawful interests. 4 5 6 7 8 4. effioient ol'der. They have been oompelled to maintain an police deparrtment in order to insure law and 5. They have reduced the taxes of the oity $0.45 on a hundred dollar valuat,-on; have protected the city's water supply; are in favor of public improvements in keep- ing with the demands of the community and are in tavor of industry and allll1sements under reasonable re~la'bion and zoning. That in addition to the above there shall be printed on such recall ballot as to eaoh officer whose recall is to be voted on thereat, the tollowing questions: "Shall R. l!:. Dolley be recalled trom the ottice ot a member of the Board of Trustees of the City of Seal Beach, Cal1rom iaY" "Shall Jessie R. JOhnl be reoalled trom the otfice of a member of the Board of Tl"Ilsteea of the City ot Seal BeaCh, California?" and "Shell C. O. Wheat be recalled from the ofr1,ce ot a member of the Board of Trustees of the City of Seal Beach, California?" and tollowing eaoh of which questions there shall be printed the . words "Yes" and "No" on separate lines with a blank at the right ot each in which the voter shall indicate by stamping a (x) his vote for 01' against suoh recall, and in all other respects suoh ballot shall be as by law prOVided. Sec. 7.
