AN ORDINANCE OF THE CITY OF SEAL BEACH
PROVIDING FOR THE PROHIBITING OF SALOONS AND PROHIBITING
THE SALE OF DISTILL~D ALCQHOLIC LIQUOR, AND PROHIBITING
THE SALE AND SERVICE OF VINIOUS AND ALL ALCOHOLIC LIQUOR
WITHIN THE CITY OF SEAL BEACH.

SECTION L.
Every person, who, as owner, ~rincipal, agent,
employee, or otherwise, opens, establishes, keeps,
maintains or carries on a pla.ce where alcoholic liquor
or other intoxicating drinks are sold, kept for sale.
offered for sale, distributed, divided, delivered or
given away, in the City of Seal Beach, is guilty of a
misdemeanor.
SECTION II.
Every person, who. as owner, principal, agent.
employee, or otherwise, sells, keeps for sale, offers
for sale. distributes, divides or gives away alcoholic
or other intoxicatinB drinks in the City of Seal Beach.
is guilty of a misdemeanor.
SI!:CTIOll' III.
Every person,who, as owner, princi9al, agent,
employee, or otherwise, has in his or her possession
any alcoholic liquor or intoxicating drinks, with intent
to use the same inviolation of any of the ~rovisions
of this Ordinance, in the City of Seal Beach, is guilty
of a misdemeanor, and all such alcoholic liquor or other

abatement the police shall seize all such liquor, bottles
barrels and other vessels, and upon conviction of such
person for unlawfully having the same in his or her
possession destroy such liquor, bottles, barrels, or
other vessels.
SECTION IV.
Every person, who. as owner, ~rincipal, agent,
emp~oyee or otherwise, lets or leases any building, room,
tenement or place to be used in violation of any of the
provisions of this Ordinance in the City of Seal Beach,
or who being the owner thereof, or having control thereof
permits any building, room, tenement or place to be used
in violation of any of the provisions of this Ordinance
in the City of Seal Beach, is guilty of a misdemeanor,
and upon the se~ond conviction thereof the building shall
be locked for one year unless he shall furnish sufficient
bond to insure its not being used for that purpose again.
SECTION V.
Every person, who, as owner, principal, agent,
employee. or otherwise, serves alcoholic liquor or other
intoxicating drinks at any public dining room of any
hotel, apartment house, rooming house, lodging house,
cafe, restaurant or cafeteria, club or club house, in
the City of Seal Beach, is guilty of a misdemeanor.
SECTION VI.
Every person who drinks alcoholic liquor or any other
intoxicating drinks at any publiC dining room, c~fe,

lane, or place in th~ City of Seal Beach, is guilty of a
misdemeanor.
SECTION VII.
Every person, who, as principal, agent, employee,
or otherwise, solicits or takee order for the sale or
delivery of alcoholic liquor or other intoxicating drinks,
in the City of Seal Beach, is guilty of a misdemeanor.
SECTION VIII.
Every act in violation of any of the provisions of
this Ordinance shall separately and for each day of its
continuance be deemed a separate offence, and every clerk,
servant, agent, or other person committing any act in
violation of any of the provisions of this Ordinance shall
separately and for each day of its continuance be deemed
a separate offence, and every clerk, servant, agent or
other person committing any act in violation of any of
the provisions of this Ordinance shall be deemed guilty
as principal.
SECTION IX.
Every person who in any manner encourages, aids,
abets or assists in the violation of any of the provisions
of this Ordinance in the City of Seal Beach is guilty of
a misdemeanor.
SECTION X,
For the pur90ses of this Ordinance, alcoholic
liquor or other intoxicating drinks shall be any such

1 alcoholic liquor or intoxicating drinks as shall contain
2 more 'than one half of one per cent alcohol by volume.

SECTION XI.
Provisions of this Ordinance shall apply to
and prevent and make unlawful the keeping, furnishing
or giving away of alcoholic liquors or other intoxicotin~
drinks in a private residence, home, or in a room, suite
of rooms, in a hotel, apartment house, rooming house,
or lodging house, occupied by any ~erson as a regular
place of residence, and shall for the purpose of this
Ordinance be deemed to be the orivate residence of such
person, and for the violation of this Section any person
convicted of such act shall be guilty of a misdemeanor.
SECTION XII.
It shall be the duty of the Police Department
to place all persons suspected of violating any of the
provisions of this Ordinance under police surveillance
and t~ use all legal means of detecting and convicting
persons violating any of the provisions of this Ordinance,
including the exercise of the right of search given by
the laws of the State of California in Chapter 3 of
Act 2, of Title 12, of the Penal Code of the State of
California, as far as the same may be ap91icable, is
hereby made to apply and be enforced in the City of Seal
Beach.
SECTION XIII.
Every person who violates any of the .rovisions
of this Ordinance is guilty of a misdemeanor and uoon

conviction thereof shall be punished by a fine of not to
exceed $500.00 or by imprisonment in the city jail of the
City of Seal Beac~ for not more than six months. or by
both such fine and imprisonment.
