For the purpose of this Ordinance the terms l4 "inch of width of tire" shall be equivalent to the manufacturer's 15 rating of width in inches. stamped upon such tire. The term 16 one "motor power" as used in this Ordinance when applied to l7 mo:1lor vehicles shall mean the power furnished by one motor. and l8 when appli ed to horse drawn vehicles, shall lilean one team rep;ard- 19 less of the number of horses composing such teams. Section 2. No motor or other vehicle or other object 21 or contrivance. exclusively used in the carrying of r:lerchandise 22 or articles of freight. and of a capacity in excess of one ton 23 in wei~ht. shall be operated or moved upon or over any paved 24 hi~hway in the City of Aeal Beach. the wei~ht of which, resti~ 25 upon the surface of said highwav, road or brid~e. exceeds 700 26 pounds upon any inch of width of tire. when said vehicle is 27 equipt with pneumatic tires, nor lllore than 650 pounds u::;lon any 28 inch of width of tire when said vehicle is equipt with solid rub- 29 ber tires. or rubber tires other than pneumatic; and no motor or 30 vehicle. object or contrivance exclusively used in the carryinR 31 of merchandise. or articles of frei~ht and of a capacity in ex- 32 cess of one ton in wei~ht shall be operated or ~ovedupon or over any paved public highway or bridAe in the Oi ty of fleal L . : :. The ,rovisions of this Ordinance with 14 respect to the maximUll1Weip;ht of load upon the highways desi- 15 gnated herein as well as the maximum weip;ht of ,ounds upon any 16 inch of width of tires. shall a~plY. whether one or more 17 trailers are attached to such motor or other vehicle operated 18 on or over any of the paved roads within the Oity of Beal Beach. 19 and ?rovided that when a trailer is used at least fifty per 20 cent of the entire load hauled. shall be carried on the vehicle 21 used for motive power. 22 ~ection 4. It shall be unlawful for any person. firm 23 or corporation to operate or drive a motor or other vehicle upon 24 or over any paved public highway or bridp;e in the Oity of Seal 25 Beach. when such vehicle is equipt with solid rubber tires. 26 the oute;r circumference of which. or o~ any of which have a flat 27 space or surface thereon which pounds said paved hip;hway or 28 bridp;e. 29 3ection 5. Any person violatinF, any of the provisions 30 of this ordinance or any section thereof, shall be ~ilty of 31 a misderr.eanor and upon conviction thereof shall be punished by 32 a fine not exceedinp; ~OO.OO or bv imprisonment in the Oounty Jail of the Oounty of Cra~e. not exceedinp, six months, or by -2- I 5 6 7 8 9 10 11 12 Ordinance Number l , . , . . 1 both such fine and imprisonment, and any Peace Officer maki~ 2 the arrest, shall keep atch vehicle with its load in his 3 custody until ,:uch time as the load on such vehicle shall have 4 been reduced sufficientlY to brinp; its weip;ht within the max- ilnum of five tons for one vehicle, as provided in this Ordinance. Furthermore any Peace Officer may require the owner of such vehicle to drive the same to the nearest public scales to be desip;nated by such Peace Officer, for the purpose of establish- ing the weip;ht of such load and vehicle. Section 6. phrase 1 f any section, sub-section. sentence, clause or word of this Ordinance is for any reason held to be void or unconstitutional, such decision shall not affect the validity 13 of the remaining portion of this Ordinance. The Foard of 14 Trustees of the City of Seal Beach. hereby declares that it would 15 have passed this Ordinance and each section. sub-section. 16 sentence, clause , pHrase and words thereof, irrespective of the 17 fact that anyone or other section, sub-section, sentence, 18 clause. Ihrase or word hereof be declared void or unconstitution- 19 al, and all Ordinances or parts of Ordinances in conflict here- 20 with are hereby repealed in so far as they are inconsistent or 21 in con flict with this Ordinance or any provision ther eof. I 22 Section 7. That this is an emergency ordinance for the 23 immediate preservation of the public peace, in this; That l~ain 24 street, in said Citv, has been paved and is about to be o!,lened 25 to the public, and unless this Ordinance shall take affect 26 imrr.ediately, there is p:reat danp;er of heavily laden vehicles 27 being driven the:rElon to the ruination of said street. which 28 might thereby cause the driver of such vehicle to be attacked 29 by the inhabitants and tax payers in said City, and a breach of 30 the public peace. I 31 Mection 8.
