ORDINANOE No. --00000- AN ORDINANCE OF THE OITY OF SEAL BEACH DETERKmnlG THAT THE WATER BONDS VOTED THE 13th DAY OF NOEEMBER, 1917, IN THE SUM OF $46,000.00 IN THE CITY OF SEAL BEAOH, pAT.T. NOT BE ISSUED OR SOLD. Whereas on the 11th day of Oohber, 1917, the Board of Trustees of the City of Seal Beaoh, duly passed and adopted Ordinance No. 39 of said City, beirlg an Ordinance oalling a special election to be held in the City of Seal Beach on Monday, the 13th day of November, 1917, and submitting to the qualified electors of said City the proposition of inourring a bonded in- debtedness in the sum of $45,000 for the acquisi tion, oonstructiCll and completion by the City of seal Beaoh of a oertain revenue producing munioipal imprGVBment, to-wit: Water Works for supply- ing the Oity and its inhabitants with water, inoluding the ao- quisition of lands, rights of way, machinery, pipes, apparatus, welle, pipe lines, mains, laterals, meters and attacllments, and other works necessary therefor; and the proposition of inourr- ing a bonded indebtedness in the sum of $46,000 for the acqui- sition, construction and completion by said City of Seal Beach of a oertain municipal improvement, to-wit: A sewer system in said city, including all pipes, pipe lines, mains, laterals, cennections, attacllments, man-holes, maohinery, septio tanks, property, apparatus, and appliances necessary or convenient for the purpose of property and sanitarily disposing of the sewage of the Oity of Seal Beach; providing for the issue of bonds for each of said purposes, and for the levying of a tax for the pay- ment of said bonds, establishing a speoial munioipal election preoinct for the holding of such election, designating the poll- ing plaoe thereof, and appointing the Billard of Electio n Offic- ere therefor. -1- .... 1 1 9 10 11 12 ~ 13 14 15 I 27 28 29 30 31 32 Ordin..,. Nnmber ~ Whereas a special electibn was duly held in the City of Seal Beach on the 12th day of November, 1917, at which election one of the two proPGsitions submitted to the electors of the City of Seal Beach, was: (a). Proposition: Shall the Oity of Seal Beach incurr a bonded debt in the sum of $45,000 for the acquisition, con- struction and completion, by the City of Seal Beach of a certain revenue producing municipal improvement, to-wit: Water Works for supplying the Oity and its inhabitants with water, in- s eluding the acquisition of lands, rights of way, machinery, pipes I I apparatus, wells, pipe lines, mains, laterals, meters and I attachments, and other works necessary therefor? 'rhe said BGard of Trustees, did, on the 15th day of November, 1917, as will mare fully appear i~ Resolution No.20 of the Oi ty of Seal Blilach, California, approved and signed on the 15th day of November, 1917, signed and declared that there was polled at said special election, in favor of said proposition 113 votes, and 10 votes were cast against the said proposition, and the total number of votes cast at said election was 127; 1 2 3 4 5 6 7 16 17 IS 19 that the votes of mGre than tWG-thirds of all the voters voting at said special election were in favor of said proposition, and that the issuance of bonds of said Oity in the sum of $45,000 for said purpose, was duly authorized by said election. Whereae on the 22nd day of November, 1917, Ordinance No. 42 of the City of Seal Beach, was'duly passed and adopted by said Board of Trustees. Said Ordinance being an Ordinance pro- viding for the issuance of bonds of the City of Seal Beach, state of California, in the amount of $45,000, for the purpose of acquiring, constructing and completing a certain revenue producing municipal improvement, to-wit: Water works for suppl,.. ing the City and its inhabitants with water, including the ac- quisition of lands, rights of way, machinery, pipes, apparatus, wells, pipe lines, mains, laterals, meters and attachments, and other works necessary therefor, in accordance with and as au- thorized at a special election held in said City of Seal Beach 20 21 22 23 24 25 26 -2- .' Whereas that on the 15th day of December, 1917, the City Clerk of the City of Seal Beach, notified the said Board of Control, and the state Treasurer, at Sacramento, california, of the sale of said bonds, pursuant to section 678 of the Political Oode of the State of California. Whereas on the 6th day of December, 1917, the City Clerk of the City of Seal Beach, published notice of sale of bonds, and invited seal bids for the sale of said bonis. Whereas no bids were ever received. by the City of seal Beach, far the purchase of said bonds. NOW THEREFORE, the Board of Trustees of the City of Seal Beach, do ordain as follows: Section 1. The. t in accordance with Section 6i of, "an. act authorizing the incurring of :indebtedness by cities, towns and municipal corporations for municipal improvements and reg- ulating the acquisition,ce nstruction, or completion thereof" which became a law under Constitutional provisions without the Govenors approval, February 26, 1901. Amended 1907,pp. 570, 609, 634; 1909, p. 720; 1913 pp. 13, 29; 1915, pp. 97, 1453; 1917, p. 79. And the Board of Trustees of the City of Seal Beac. hereby determining that more than three years have elepsed since the date after the day of the election, wherein and where- by the proposi ti on of · Shall the City of Seal Beach incur a bonded debt in the sum of $45,000 for the ac~isition. construc- tion and completion by the Oity of Seal Beach of a certain rev- enue producing IIII1nicipal :improvement, to-wit: Water Works, for supplying the city and its inhabitants with water, including the acquisition of lands, rights of way, machinery, pipes, apparatus wells, pipe lines, mains, laterals, meters and attachments, and other works necessary therefor? Which proposition was submitted to the electors of the City of Seal Beach, at a special election which was duly held at the City of Seal Beach, on the 12th day of November, 1917, and which proposition received in favor thereof, 113 votes, and 10 votes against, and the total number 4 5 e -:5- .. 1 8 9 10 11 12 1 13 14 15 16 17 18 19 20 21 22 23 24 25 26 I 27 28 29 30 31 32 Ordinance Number ~ 1 2 3 4 5 of votes cast at said election was 127, and the Board then det- ermined that more than two-thirds of all the voters voting at said election were in favor of said proposition. That said bonds were never thereafter sold. The Board of Trustees, do hereby determine that none of said bonds shall ever hereafter be issued or sold. 6 Section 2. The City Olerk shall certify to the adoption of this Ordinance by a two-thirdS vote of the Board of Trustees of the said City, and ahall cause the same to be published once in the Seal Beach Post, a weekly newspaper, printed, published and circulated in said City of Saal Beach, and that thereafter this ordinance shall take affect.
