'" RESOLUTION NO. g~1Y A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH DIRECTING THE STREET DEPARTMENT TO ABATE A CERTAIN WEED NUISANCE AND PROVIDING FOR A REPORT OF THE COST OF SUCH ABATEMENT. WHEREAS, the CIty Council of the City of Seal Beach has by Reso- 1ution declared all weeds growing upon the streets or sidewalks, or upon private property Wlthin the CIty of Seal Beach, and which bear seeds of a wmgy or downy nature, and WhICh attain such a large growth as to become a fire menace when dry and which are otherWIse noxlOUS or dangerous, a publ1c nuisance, aU as provided by that certam Act of the Califorma State LegIS- lature, bemg Act 5197, Deering's General Laws, Statutes 1915 "MunIclpal Weed Abatement Law", as amended, and WHEREAS, the Street Department of the Clty of Seal Beach has posted notices in accordance WIth said Resolution, being Resolutlon No. 867 of the City of Seal Beach, and entitled "A RESOLUTION OF THE CITY COUN- ClL OF THE CITY OF SEAL BEACH DECLARING CERTAIN WEEDS TO BE A PUBLIC NUISANCE. CREATING A LIEN UPON CERTAIN PROPERTY FOR THE COST OF ABATEMENT OF SUCH WEEDS", aU of whIch fully ap- pears from the affIdavlt of a representatlve of saId Street Department on fUe with the City Clerk of sald Clty, and WHEREAS, said notice to destroy weeds so posted by sald Street Department required that aU property owners having any objections to the proposed removal of such weeds were required to attend a meeting of the CIty Council of the CIty of Seal Beach to be held on the 1st day of March, 1955, at 7:30 o'clock p. m. at the Clty Hall, Seal Beach, Califorma, and WHEREAS, the City Council of the Clty of Seal Beach has heard and cc>nsidered all objections and protests to the proposed removal of weeds; NOW, THEREFORE. the City Councll of the CIty of Seal Beach does resolve as follows , -- SECTION 1: That all obJections and protests are hereby overruled. SECTION 2: That the Clty Council of the CIty of Seal Beach now has -1- , j I I I ..~- ...-. SECTION 3: That the Street Department of the City of Seal Beach, and more particularly its senior member, is hereby instructed and -r,q directed to abate said nuisance shown by said Resolutlon No. -867, as afore- said, and said senior member and said Department and It and/er he and/or hiS assistants or deputies are hereby expressly authorized to enter upon private property for the purpose of abating sud nuisance. SECTION 4: That any property owner shall have the nght to 10 have any such weeds removed at hiS own expense, provlCiing the same is done 11 prior to the arrival of the Street Department representatives or such other 12 public officer or his representatlves to do the same. 13 SECTION 5: That the Street Department shall keep an account 14 15 of the cost of abating such nUisance in front of or upon each separate lot or parcel of land where the work is done by it or lts deputles, and shall render 16 an ltemued report m wrltmg to the City Councu of the City of Seal Beach show 17 ing the cost of removmg such weeds on each separate lot, or in front thereof, 18 or both. 19 SECTDN 6: That before said report of said Street Department 20 shall be made to the City CounCil of the said City, a copy of the same shall be 2l posted for at least three days prior thereto on or near the bulletin board 10- 22 cated on the first floor of the City Hall next to the room m which said City 23 Councu normally meets, together with a notice of the tlme when said report 24 shall be submitted to the said City Council for confirmation. 25 THE ABOVE AND FOREGOING Resolution No. ".2 was 26 27 28 29 30 31 32 introduced and passed at a ~jJc..A>Jt. meeting of the Seal Beach City Council held on the /6' day of March, 1955, by the following vote.
