RESOLUTION i7t" NO. !- A RESOLUTION OF THE CITY COUNCIL OF SEAL BEACH EX- PRESSING ITS VIGOROUS OPPOSITION TO ASSEMBLY BILL NO. 3762 WHICH PURPORTS TO TAKE FROM THE CITY OF LONG BEACH THE REVENUE DERIVED BY IT FRCJoI OIL PRO- DUCTION ON ITS OWN TIDELANDS. WHEREAS, the City of Long Beach and many other coastal cities within the State are the sole owners of the tide and submerged lands within their respective corporate boundariest which owner- ship has been confirmed many times by the Supreme court of the . State during its long history; and WHEREAS, any revenue derived from such lands has al80 been judicially declared to be an integral part thereof and likewise property belonging to the City; and WHEREAS} Assembly Bill No. 3762, now pending in the current session of tne Legislature, purports to take from the City the revenue derived by it from oil production on its own tidelands; and WHEREAS, the Supreme Court of the State of California has previously held unequivocally that the Legislature may not con- stitutionally, by purported legislation, divest a city of its ownership of the tidelands and the revenue accruing therefrom; and WHEREAS. Assembly Bill No. 3762 would, if enacted, constitute a grievous breach of faith on the part of the State and would constitute a grave danger to the economic stability of every coastal city in California owning tidelands and submerged lands; \ NOW, THEREFORE, BE IT RESOLVED. that the Seal Beach City Council hereby expresses its opposition to Assembly Bill No. 3762 and hereby urges the Legislature of the State of California to reject Assembly Bill No. 3762 and thereby reaffirm the right and strengthen the efforts of the various coastal municipalities in providing. maintaining and improving the harbors and other public uses of the tidelands and submerged lands, severally granted to them, all in the interest and for the benefit of the people of the State of California; and BE IT FuaTHER RESOLVED, that copies of this resolution be immediately forwarded to the Honorable John A. Murdy, Jr.J Sen- ator from the 35th Senatorial District and the Honorable ~eRoy E. Lyon, Jr., Member of the Assembly from the 75th Assembly District. .
