'lIS' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH OF INTENTION TO ANNEX CERTAIN UNINHABITED TERRITORY IN ACCORD- ANCE WITH RESOLUTION NO. 9140F THE CITY COUNCIL DESIGNATING THE TERRITORY AS THE HELLMAN-NAVAL DEPOT ANNEXATION; DESCRIB- ING BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE WHERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR BE- FORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEX ED TO THE CITY OF SEAL BEACH. WHEREAS, the City Council of the City of Seal Beach did on the 9th day of January, 1956, adopt Resolut1on No. 914 describ\ng certain new terri- tory proposed by the Counc\l to be annexed on its own motion to the C\ty of Seal Beach; and WHEREAS, the proposal for the annexat\on of the territory here\n- after descr\bed to the C\ty of Seal Beach was subm\tted to the Boundary Com- m\ssion of the County of Orange, State of Cahfornia, and reported on by said Boundary Commission w\th respect to the defmiteness and certainty of the pre- posed boundaries; and WHEREAS, the terr\tory proposed to be annexed to said City of Seal Beach is situated \n the County of Orange, State of Californ\a, and is cont1gu- ous to the City of Seal Beach and is uninhab\ted terr\tory, and said Resolution No. 914 contamed a descr\pt\on of sa\d terr\tory \n words and f\gures as here- \nafter in this Resolution described; and WHEREAS, the City Counc\l f\nds from eV\dence and reports that at the time of the adoption of Resolution No. 914 the said territory proposed to be annexed to said City of Seal Beach d\d not form a part of any municipal corporation and that said territory was uninhabited and \S cont1guous to the C\ty of Seal Beach; and WHEREAS, the C\ty Council finds from sa\d Resolut1on No. 914 and evidence and reports received that the boundaries of the terr\tory so proposed to be annexed to the City of Seal Beach are as follows, to wit: 1. ~ 1 I 2 3 4 5 6 7 8 9 10 11 12 ~. 13 z -:5 ~~ 14 ilh ~IH 15 ~EI:iK 16 zip 13-. z !".w P~h:r 17 ~ !9 : il 18 19 20 21 22 23 24 25 I 26 27 28 29 30 31 32 PAGE < '~esol~tion Number " ~ - . "., Beginning at a pOlnt in the boundary of the Clty of Seal Beach, said polOt being the southwest corner of the north- west quarter of Section 12, Township 5 South, Range 12 west; S. B. B. &M., County of Orange, State of California; thence east along the south line of said northwest quarter of Section 12 to a point ln the northwesterly line of Bay Boulevard, 60 feet wide; sald pOlOt belng 30 feet northwest and measured at right angles, to the center line of sald Bay Boulevard; thence in a northeasterly direction along said northwesterly line of sald Bay Boulevard to a point in the East hne of the northwest quarter of said Section 12; thence north along the east line of the northwest quarter of sald Section 12 to the northeast corner of the northwest quarter of said Sectlon 12} thence west along the north line of sald Section 12 to a pOlOt in the Orange County Boundary; thence north and west along said Orange County Boundary to a pOlnt in a line 40 feet south of and parallel to the center line of Garden Grove Boulevard, 80 feet wide; thence east along last described hne to a point in a line 30 feet west of and parallel to the center hne of Bolsa Chlca Road, 60 feet wide; thence south along last described hne to a pOlnt in a hne 30 feet north of and parallel to the center line of Smeltzer Avenue, 60 feet wide; thence west along last described hne to a point in the common boundary between the Rancho Los Alamltos and the Rancho La Balsa Chlca; thence southwesterly along sald common boundary to the northeasterly line of Location 1#141, State Tide Land, described ln patent issued April 4, 1901; thence along sald northeast hne, the followlOg courses and distances: N 73 deg 45' W. 654.33 feet, N 44 deg 15'W., 495.00 feet; N 52 deg 45' W, 1069.20 feet) N 3 deg 45' W., 904.20 feet; N 87 deg 30' W, to the boundary of the Clty of Seal Beach; thence along said City boundary, to the point of beginning. v Now, therefore, the Clty Councll of the Clty of Seal Beach does re- solve as follows: SECTION 1: That such proposed annexatlon be designated as HeUman Naval Depot Annexation and that notice of such proposed annexation be given as hereinafter provlded. SECTION 2: That a public hearlng shall be had upon the date stated, not less than forty (40) nor more than sixty (60) days after the passage of this Resolution, unless the owner or owners of all of the territory to be annexed have petitioned for annexation or flled their consents to such annexation, ln writing, with the Clty Council, in whlch event the hear 109 shall be not less than flfteen (15) nor more than s1.Xty (60) days after the passage of thf.s Resolu- tion. (. bers in the Clty Hall of the City of Seal Beach as the day. hour and place when and where the City Council wlll hear protests made by any owner or owners of the real property wlth10 the terrltory proposed to be annexedJ and that at any time before the hour set for hearing obJections. any owner of property within said territory may file with the Clty Clerk a wrltten protest against the annexa tion. Sald protests shall be in writlng and shall state the name of the owner of the property affected and the description and area of the property ln general terms. SECTION 4: That the City Clerk be. and he is hereby, authoru;ed and directed to cause ~ copy of this Resolutt..~n to be pu~lished at least twice. but not oftener than once a week. in a newspaper of general clrculation. pub- , lished in the City. to Wlt, th.e SEAL BEACH POST AND WAVE. and also 10 a newspaper of general circulation. published outside of the City. but in the County of Orange. in which lS located the terrltory hereinabove proposed to be annexed to the City of Seal Beach. to wit. SANTA ANA REGISTER; and that such pubhcation shall be completed at least twenty (20) days prior to the date of the hearlng herelnabove specified. SECTION 5: That the Clty Clerk of the City of Seal Beach be. and he is hereby. authorized and directed to cause written notice of such proposed annexation to be mal led to each person to whom land withln the territory pro- posed to be annexed is assessed, in th.e last equalized county assessment roll address shown on said assessment roLL or as known to said City Clerk, and to any person who has fUed his name and address and the designation of land in wh ch he has any lnterest. elther legal or equitable. with said Clerk: and in the event that land with10 the territory proposed to be annexed to the City of Seal Beach. lS owned by a County. SECTION 6: That the proceedmgs for the sald annexation have been lnitiated by the City Council as Legislative body of the City of Seal Beach on ltS own motion. and its reasons for desiring annexation are that the County of 3. S. Naval Net and Ammunit10n Depot were at one 6 t1me w1thtn the corporate boundar1es of the City of Seal Beach as well as other 7 parts of the territory now sought to be annexed, and that unless such annexa- 8 hon is now made the CUy of Seal Beach may be faced with the problem of neve 9 being able to expand Us geographical boundar1es. 10 SECTION 7: That the CUy Council as leg1slative body hereby fixes th 11 5th day of March, 1956, as the date when, pursuant to Sect10n 35318 of the 12 Government Code of the State of Cal1fornia, the proposed annexation will peco e effective if such annex aU on lS completed.
