The City Council ot the City of Seal Berch does resolve

SEOTION 1. Section 13, Resolution No. 916 is hereby

Section 1. Offioe of City MAnager creeted.
The office of City M~nager of the City of Spsl Beach is
hereby created and ~stablishe~. The ai~y MpnRf,er Shall be apnoint
ed by the m:'Jority vote of the City Council BOlely on thc basis
of his exeoutive ~nd administrative qualifications and ability

Section 2. Eligibility.

Section 3. Bond.

Section 4. Absence.
The City Manager shall appolnt, subject to the ap?roval

i;anager, an~ in the eVE'nt that the 'CioY ll~nager fails to Make
such appointment, the City Council may designate a City McnRger,

~ection 5. Compensation.
The City rianar,er sh~ll receive such compensDt~on as the

Section 6. Po~ers and Duties.
The City Manager shall be the administrative head of the
City Government under the direotion anr control of the Oity
Council" except as otherl:ise proviiied in this Ordlnance. He shall
be responsible for the efficient administration of all the affairs
of the City \':hich are under !tiS contr.ol. In /i!.doition to hU,
general pO'l~rs as administrative head o~ the affairs of ,ths City
~~ich ar~ under'his control, and not as a limitation thereof,
it Shall be his duty and he shall have the power:
1. To see that the laws of the State of California p~r-
taining to the City ~nd all laws an( ordinances of the City
are duiy ~ntorced, p.no that all franchises, permits and pri-
vileges granted by the City are faithfully observed.
2. To'appoint, procote, discipline, demote ~nd remove
all heads of departmen~s, and all subordinate officers and
employee~ of the City except the Oity Clerk, the City Attorney,
ana the Oity'Treasurer; to Dransfer employees from one depart-
ment to another" and to conQoliliate or comb~ne offices,
poa~tions, cepartments or units under his jurisdiction.
). 'To' exercise control over and to supervise in ~eneral
all departments and divisions' of the City Government and all
appointive officers and employees thereof except the City
Clerk, the City Attorney and the City Treasurer.
4. To attend all meetings of the City Council and its

Section 7. Duties of Other Officers.

Section 8. ,Terms of Subordinates.
Upon any appointm~nt of a Ci ty lkna~er, the tercs of
subordinate ~rficers ~no em~loyees over ~hich he has the po~er
of appointroent Shall cease upon his taking office, unless they
[l,I'e reappointed by him, ,;>rovided, however, thl't this shall
not apply to the City Clerk, City Trensurer or City Attorney;
provided however, th~t nothing in thls ordinance, ~nd more
particul&rly in Sections 6 and 8 hereof, shall in any ~anner
contravene,Ordinances )07 and 476 of the City of Seal Beach,
more commonly knol'm as the Civil Service Ordin~nces or any part
of said Ordinances.

Section 11. Removal After Municipal F.leotion.
Notwi~hstanding the ~rovisions of the ordinance here1n-
qefore enu~er&ted, the City ~an~gQr shall not be removed frm~
offic'e rturing or wi thin a period of ninety days next succeeding
any general municipal election held in said City at ~mich said
election a'meMbar of the City Council is elected. The puroose
of thiS prQvision is to allow any ne~ly elected member to the
City Councilor a reorGanized City Oouncil to observe the actions
and ability of the City l.anar,er in the performance of the pOl-rars
and duties nf his office. After the expiration of said ninety
day period aforementioned, theprovisions or the preceding sec"ion
