Tse, Personnel Manager 0" SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AMENDING RESOLUTION NUMBER 5545 ADDING THE SALARY RANGE FOR THE POSITION OF BEACH LIFEGUARD TRAINEE SUMMARY OF REQUEST: Staff requests that Council adopt the proposed resolution by adding the salary range for the position of Beach Lifeguard Trainee. e BACKGROUND: Each summer, the Lifeguard Department holds a lifeguard try-out to recruit part-time beach lifeguards for the summer season. The Department holds a swim test after which the top fifteen to twenty applicants would be retained and enrolled into a training class. The training class usually produces between five to ten eligible guards. The lifeguard training class consists of 100 hours of training. The participants would be compensated a stipend at the completion the class. The stipend would be equal to minimum wage for the hours of training. The City's Personnel Division counsel firm, Liebert, Cassidy, Whitmore, in the recent past assisted the City with a Federal Labor Standards Act (FLSA) assessment, to assist the City in ensuring that it is in compliance with federal guidelines. One of the recommendations of the assessment is to cease the practice of providing a stipend to participants at the end of training. The trainees are to be retained as temporary, at-will, part-time employees and compensated at an hourly wage of at least minimum wage. OF THE CITY OF SEAL BEACH AMENDING RESOLUTION NUMBER 5545 ADDING THE SALARY RANGE FOR THE POSmON OF BEACH LIFEGUARD TRAINEE WHEREAS, the City Council adopted Resolution Number 5545 on June 25, 2007 establishing hourly rates for part-time, seasonal, and temporary employees; and WHEREAS, the beach lifeguard trainees have been compensated a stipend at the end of training; and WHEREAS, the best practice to meet federal FLSA guidelines is to include the position : of Beach Lifeguard Trainee and establishing a salary range. NOW, THEREFORE, the City Council of the City of Seal Beach hereby resolves: Section I.
