SUMMARY OF REQUEST:

City Council adopt the attached Resolution No. _ authorizing staff to submit a
permit application to the California Coastal Commission for the Pier Deck Rehabilitation
Proj ect.
BACKGROUND:
The Seal Beach Municipal Pier was constructed in 1906; it is approximately 1800-feet
long consisting mostly of poly-wrapped timber piles, timber support members and a
timber deck. The Pier was severely damaged by the winter storms in 1982 and 1983 and
it was repaired to minimal working conditions. Lifeguards and Public Works' crews
regularly inspect and monitor various components of the Pier. On August 26, 2002,
Council awarded a professional services contract to Han-Padron Associates to inspect and
evaluate the timber Pier.
Inspections and testing were conducted in November 2002. The inspection included a
visual and tactile examination of all accessible components of the structure, above and
below the waterline. The report concludes that the Pier is in fair condition according to
the standards set by the American Society of Civil Engineers (ASCE) Standard Practice
Manual on Underwater Investigations. However, at that time, several elements of the
Pier were in need of repair and replacement including structuraJ components, utilities,
preservation components and aesthetic features.

Overall, the Pier and its deck are in fair condition and because of its timber construction,
surfaces and appearance are rough and rustic. Routine inspections are performed by the
Public Works Department to identify components needing repair, adjustment, and

preventative measures. In the past "flipping over" the boards has been a method of repair
with limited success due to the splintering/splitting of the decking. However, the historic
aged timber surface can be rough and uneven. Pedestrians are cautioned with signs at the
entrance to the Pier regarding the uneven surfaces.
A study was conducted by Moffatt & Nichol in May 2006 to study alternatives for
rehabilitation of the decking on the Pier. A life cycle cost analysis was prepared along with
other factors including aesthetics, safety, comfort, and fire resistance and the
recommendation of the report was to replace the decking on the Pier with an imported
"Greenheart" hardwood. The hardwood is a higher costing alternative than replacing the
decking with the existing Douglas fir wood. The life expectancy of the hardwood is 25
years as opposed to 15 years of the Douglas fir wood. By choosing the hardwood the
benefit would be over 10 years longer life.

Due to the length of the pier and the associated cost, this project was divided into 4 phases,
each phase totaling approximately one-quarter the length of the pier. Currently, phase one
is complete, phase two's design is substantially complete, phase three design has begun and
phase four is on hold for future funding. Upon the successful execution of the contract
documents, the contractor will have several months to procure the Greenheart Hardwood for
phases two and three, but only 8 to 12 weeks to construct the improvements. There are no
daytime Pier closures scheduled with this project. The contractor will be working at night
and reopen the Pier every morning.
The City constructed Phase One of the subject project without a Coastal Commission
permit citing Section 3061O(d) of the Coastal Act which renders certain types of repairs
and maintenance activities exempt from permit requirements. However, the Commission
does not view pier deck replacement projects as meeting all criteria necessary for
exemption status under this Section. Newer guidelines established in 1978 that the City
further referenced are not applicable as well. Thusly, the City received a notice of
violation from the Coastal Commission that can be cleared by applying for a Coastal
Commission permit. Staff has prepared the necessary (attached) permit application to
cover Phases 1-4 of the Pier Deck Rehabilitation Project. The approval process to obtain
this permit is approximately 4-6 months through the Coastal Commission.
FISCAL IMPACT:
There is no fiscal impact to the City to apply for the permit from the California Coastal
Commission.

WHEREAS, The City of Seal Beach wishes to rehabilitate the decking on the Seal
Beach Municipal pier: and
WHEREAS, Section 13252 of Title 14 of the California Code of Regulations requires a
permit application to the Califomia Coastal Commission to perform the
required construction acbvities; and
WHEREAS, the City has prepared an application to the Califomia Coastal Commission
for a permit to rehabilitate the decking on the Seal Beach Municipal Pier.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES
HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. Authorizes the submittal of an application to the California Coastal
Commission for the Seal Beach Municipal Pier Deck Rehabilitation Project.

Section 2. The Director of Public Works or hislher designee, of the City of Seal Beach is
hereby authorized and empowered to execute in the name of the City of Seal Beach all
necessary applications, contracts, agreements, amendments, and payment requests hereto
for the purposes of securing a permit with the Califomia Coastal Commission for the Seal
Beach Municipal Pier Deck Rehabilitation Project.
Section 3. The City will comply with all permit requirements for the development of the
project.

The Seal Beach Municipal Pier originally was constructed in 1906, is approximately 1800-feetlong
consisting mostly of poly-wrapped limber piles, timber support members and a timber deck. The Pier
was severely damaged by the winter storms in 1982/1983 and it was partially rebuilt after the
damage. Ufeguards and Public Works' crews have regularly inspected and monitored various
components of the Pier. On August 26, 2002, Council awarded a professional services contract to

1. Proof of the applicant's legal interest in the property. A copy of any of the following will be
acceptable: current tax bill, recorded deed, lease, easement, or current policy of title insurance.
Preliminary title reports will not be accepted for this purpose. Documentation reflecting intent to
purchase such as a signed Offer to Purchase alqng with a receipt of deposit or signed final escrow
document is also acceptable, but in such a case, issuance of the permit may be contingent on
submission of evidence satisfactory to the Executive Director that the sale has been completed.
The identity of all persons or entities which have an ownership interest in the property superior to that
of the applicant must be provided.
2. Assessor's parcel map(s) showing the page number, the applicant's property, and all other
properties within 100 feet (excluding roads) of the property lines of the project site. (Available from
the County Assessor.)
3. Copies of required local approvals for the proposed project, including zoning variances, use
permits, etc., as noted on Local Agency Review Form, Appendix B. Appendix B must be completed
and signed by the local govemment in whose jurisdiction the project site is located.

SECTION VI, COMMUNICATION WITH COMMISSIONERS
Decisions of the Coastal Commission must be made on the basis of infonnation in the public record
available to all commissioners and the public. Pennit applicants and interested parties and their
representatives may contact individual commissioners to discuss pennit matters outside the public hearing
(an "ex parte" communication). However, the commissioner must provide a complete description of the
communication either in writing prior to the hearing or at the public hearing, to assure that such
communication does not jeopardize the fairness of the hearing or potentially result in invalidation of the
Commission's decision by a court. Any written material sent to a commissioner should also be sent to the
commission's office in San Francisco and the appropriate district office for inclusion in the public record and
distribution to other commissioners.

1. Fees are assessed at the time of application, based on the project as proposed initially. If the size of a proposed
dwelling or the amount of proposed grading is amended during the application review process, the fee is not changed.

3. Fees for after-the-fact permits shall normally be double the regular permit fee unless such added increases are waived
by the Executive Director when it is determined that the permit could be processed by staff without significant additional

4. The fee for development consisting of a change in intensity of use shall be based upon development cost as set forth in
part IV.
5. Permits shall not be issued without full payment of all applicable fees. If overpayment of a fee occurs, a refund will be
issued.
6. If a permit application is withdrawn, a refund will be due only if no significant staff review time has been expended (e.g.,
the staff report has not yet been prepared). Denial of a permit application by the Commission is not grounds for a
refund.
7. The application fee shall be determined from the type and size of the proposed development, except where size is not
readily determined and where the project is a change in intensity of use. In addition, if there is conflict over the
applicable fee, the Executive Director may use the project cost to determine the fee.
8. In addition to the above fees, the Commission may require the applicant to reimburse it for any additional reasonable
expenses incurred in its consideration of the permit application, including the costs of providing public notice.
9. The Executive Director shall waive the application fee where requested by resolution of the Commission.

Overall, the Pier and its deck are in fair condition and because of its timber construction,
surfaces and appearance are rough and rustic. Routine inspections are performed by the
Public Works Department to identify components needing repair, adjustment, and
preventative measures. "Flipping over" the boards has been attempted in the past with
limited success due to the splintering/splitting of the decking. However, the historic aged
timber surface can be rough and uneven. Pedestrians are cautioned with signs at the
entrance to the Pier regarding the uneven surfaces.
A study was conducted by Moffatt & Nichol in May of 2006 to study alternatives for
rehabilitation of the decking on the Pier. A life cycle cost analysis was prepared along
with other factors including aesthetics, safety, comfort, and fire resistance and the
recommendation of the report was to replace the decking on the Pier with an imported
"Greenheart" hardwood. The hardwood is a higher costing alternative than replacing the
decking with the existing Douglas fir wood, but has a longer life

Due to the length of the pier and the associated cost, this project is split up into 4 phases,
each totaJing approximately one-quarter the length of the pier. The attached plans will
detail phases one and two, and will outline the future phases three and four still to be
designed.
Phase one is completed, phase two's design is substantially complete, phase three has just
started design and phase four is on hold due to funding levels. Upon the successful
execution of the contract documents, the contractor will have several months to procure
the Greenheart Hardwood for phases two and three, but only 8 to 12 weeks to construct
the improvements. There is no daytime Pier closures scheduled with this project. The
contractor will be working at night and reopen the Pier every morning. Specific notices
will be sent to surrounding residents to inform them about the construction impacts.
