AGENDA REPORT DATE: December 10, 2007 TO: Honorable Mayor and City Council TIIRU: David Carmany, City Manager FROM: Jeff Kirkpatrick, Chief of Police , SUBJECT: Hold Harmless Agreements for Police 'Eye-in-the-Sky' Crime Prevention Program e SUMMARY OF REQUEST: One of the unintended consequences associated with our large, north-end, commercial centers are a predictable increase in holiday-period crimes-of-opportunity (larcenies, auto thefts, assaults and batteries, and burglaries) in adjacent parking lots. To answer the problem, the Police Department has developed a crime prevention program entitled, "Eye-in-the-Sky" in partnership with the Target Stores, Inc., for deployment in our large, north-end, shopping center areas. The program places a police officer with several police volunteers on top of a shopping center business's roof, armed with binoculars and a radio, to provide an overview surveillance of adjacent parking lots and store entrances with the goal of preventing and interdicting crimes of opportunity against holiday shoppers. We are encouraging other businesses to become crime prevention partners using this tool. Staff is requesting permission of Council to sign City Attorney approved, hold-harmless agreements, which mutually protect the storekeepers, and the City of Seal Beach from unnecessary liability associated with the "Eye-in-the-Sky" crime prevention program. BACKGROUND: Crimes persons and property crimes escalate in and around commercial shopping centers during holiday shopping periods, based upon historical data. Heavily trafficked parking lots are subject to a variety of crimes of opportunity, including auto burglary, purse snatching, assault and battery, automobile theft, robbery and others. Businesses are subject to burglary, shoplifting, petty and grand theft, and others. FISCAL IMPACT: No General Fund impact. Police Officers working on over-time and supervising the volunteer teams will use existing COPS-SlESF grant funding to cover salaries. Surveillance equipment for the teams to use will be purchased with the same grant funds. e Agenda Item ~ . The City Council of the City of Seal Beacb bereby resolves as follows: SECTION 1. The City Council hereby approves of the police department's "Eye-in-the-Sky" crime prevention effort and authorizes the City Manager, or his ~ignee, to sign necessary bold-harmless agreements with businesses partnering in this crime prevention program. SECTION 2. The City Clerk shall certify to the passage and adoption of this resolubon. Kirkpatrick, I am writing to confirm that Target will grant Seal Beach Police Department permission to use Target's premises at 12300 Seal Beach Blvd Seal Beach, California from November 23, 2007 through January 2, 2008, during the hours of store operations for the purpose of conducting a surveillance operation to monitor the parking lot and shopping area. Please sign below to indicate your agreement that: 1. Seal Beach Police Department is conducting this operation at its own risk. Target shall not be liable for any damage to your property, or damage or injury incurred by your employees, volunteers, or both, arising out of or relating to the surveillance operation. 2. Seal Beach Police Department will indemnify and hold Target harmless from and against any liabilities, losses, claims, suits, damages, costs, and expenses (including without limitation, reasonable attorneys' fees) arising out of or otherwise relating to the surveillance operation. 3. Seal Beach Police Department maintains appropriate insurance coverage, including worker's compensation coverage, for these obligations.
