PRC7v'IDING FOR THE OPENING AND. a.CSING OF nlE POLLS AND FOR nlE CltNPENSATION OF ELECTIal OFFICERSL,PROVIDING FOR THE OFFICES TO BE FILLED AND utE MEASURES TO BE VOTED ~ AND FIXING THE DUTIES OF THE CITY a.ERK. 7 ~EREAS, It is necessary that a regular general municipal el- 8 ection be held on Tuesday, April 13, 1954 for the purpose of fill- 9 ing certiin offices on the iegislative body of the City of Seal 10 Beach, and 11 WHEREAS, the election laws of the State of California provfde 12 that the City Council take certain action in respect to such elect 13 ~on, and 14 WHEREAS, the CSty Council desires to submit to the voters and 15 electors of the City of Seal Beach certain proposed ordinances at 16 said election, 17 NaN, THEREFORE, the City Council of the City of Seal Beach 18 does resolve as followsr- 19 ~, That pursuant to the election laws of the State 0 20 California, it is hereby ordered, and the City Council does hereby 21 call, a regular general municipal election to be held and conducte 22 on Tuesday, April 13, 1954. 23 ~r ' That the polls shali b~ opened at the houzo of 24 seven o'clock A.M. of said election day and be kept open contin- 25 uously until the hour of seven O'clock P.M. of such day, when the 26 polls shall be closed. 27 ~', That the City Council intends to canvass absent .. That the City Council will submit to the voters 9 a certain proposition for the adoption of an ordinance at said elec - 10 ion to be known 88 Ordinance No. ttlfb as follows: 11 DThe People of the City of Seal Beach, California, do ordain 12 88 follows: 13 Section 1. It is hereby declared to be unlawful and a nuisan e 14 for any person, whether as principal, agent, servant, employee or 15 otherwise, to drill any well for oil, gas, or other hydrcarbon sub- 16 stances upon those portions of the territorial limits and boundarie 17 of the City of Seal Beac~ lying landward from the Pacific Ocean or 18 prOduce oil or gas or. other hydrocarbon substances from any well so , ' 19 located, or to erect, construct or install, or cause to be erected, 20 constructed or installed, or to work upon or assist in any way in 21, the erection, construction or installation of any derrick, machine , 22 or other apparatus or ,equipment designed or intended to be used for 23 the purpose of drilling or producing any such well located landawrd 24 from the Pacific Ocean. 25 Section 2. Every person violating any of the provisions of 26 this ordinance shall be guilty of a misdemeanor and upon conviction 27 thereof shall be punished by a fine not exceeding three hundred 28 dollars ($300.00), or by imprisonment not exceeding three (3) month , 29 or by both such, fine and imprisonment; and every person who shall 30 so violate any of th6 provisions of this ordinance shall be deemed 31 guilty of a separate offense for each day during any portion of 32 which the viola~ion of any of the provisions of this ordinance is -4- . . Ordinance No. 230, adopted as an initia~ive meas- ure at an election held on March 7, 1939, is hereby repealed.- That said proposed ordinance will appear on the ballot, at sai election as Proposition No. 1 as follows: -Shall the ordinance making it unlawful to drill for, or erect, ~onstruct or install any derrick, mach~nery 01' apparatus for the pu~ose of drilling for or producing oil, gas or other hydrocarbon substances from any well located within the upland portion of the territorial limits and boundaries of the City of Seal Beach, California, and providing , , penalties f~ the violation thereof, and repealing ordi~ance No. 230 adopted as an initiative measure at an election held on March 7 1939, be adopted?-. '. ~r Th~t the City Council will submit to the voters a certain proposition for the adoption of an ordinance at said election to be known as Ordinance No. '-/~7 as follows: DThe People of the City of Seal BeaCh, California, do ordain as followsI' Section 1. That the compensation of each member of the City, i Council of the City of Seal Beach, California shall be the sum of Fifty ($50.00) Dollars per IDOnth cOllUl\enc1ng on the first day of May, 1954, and the amount so fixed shall, from such da,-. be a. regular charge against such City, payable the same as other fixed salaries are paid. Section 2. Ordinance No. 197 and all other Ordinances or par s of ordinances in conflict herewith are hereby repealed.- ..' . That Section 42 of Ordinanpe No. 154 of the City of 8, Seal Beach is hereby amended to read ae follows: 9 Section 42. Except as otherwise herein provided, in all cases '10 where real estate has been sold, or may hereafter be sold, to thf 11 City for delinquent taxes and the property has not been d'eded 10 12 the City as provided in Section 43 of Ordinance .0. 154, the person 13 whose estate haa been or may hereafter be sold, his heirs, executor 14 or other'auccessors in interest shall have the right to redeem such 15 real estate"by paying to the City Treasurer the amount of taxes, 16 penalties for delinquency and costa due thereon at the time of such 17 sale, with interest on the aggregate amount of said taxes at the , , rate of seven ~ercent per annum, and also all taxes that were a lien upon said real property at the time said taxes beoame del- 20 inquent and also all unpaid taxes of every description assessed 21 against the property for each year since the sale, as shown on the 22 delinquent assessment rolls In the ~ permanent cus~ody of the 23 City Treasurer, or, jf not so assessed, then upon the value of the 24 p~operty as assessed In the year nearest the time of such redempt- 25 ion, with interest from the first day of July of each said years, 26 respectively, at the same rate, to the time of redemption, and also all costs and expenses of such redemption and the additional penalties prescribed in Section 3817 of the Political Code of the 29 State of California, Amendment of 1929, Statutes of 1929, Chapter 422 and/or subsequent amendments theretoJ the right of redemption provided herein shall be lost and foreclosed from and after the 32 execution of the deed 'to the City provided for in Section 43 of 2 3 18 19 27 28 30 31 -6.. . ~. r ... 1 'I 1 .-a- ~ ..
