WHEREAS, Henry Russell Amory, State Adminis-
4 trator, and F. H. Smith, Acting Administrative Office,
o Work Projects Administration, Federal Works Agency,
6 has by letter dated the 6th day of August, 1942. re-
7 quested permission from the City of Seal Beach to
8 remove certain streetcar rails, track fastenings and
9 other metallic track material lying in the streets of
lO said city, and has ~reed that the Work Projects Admi -
II istration will restore the streets disturbed by such
12 removal in accordance with' the specifications attache
l3 to the letter referred to above; and.
WHEREAS, one of the requirements of the Works
l5 Projects Admini~tration, as set out in the letter
l6 above referred to, is that title to said rails and

l7 appurtenances shall be vested in Metals Reserve Com-
18 pany, a subsidiary of the Reconstruction Finance
19 Corporation, an agency of the United States Governmen ,
20 prior to Work Projects Administration commencing re-
2l moval of the rail, track fastenings and other metallic
22 track ma ter ial; and,
WHEREAS, said rails, track fastenings and
24 other track material, are urgently and immediately
25 needed in connection with the War program; and,
WHEREAS, the City of Seal Beach is desirous -,~
27 of having said rails, track fastenings and other
28 metallic track material removed from its streets and
2~ is willing to contribute the same to the successful

prosecution of the War program;
NOW, THEREFORE, BE IT RESOLVED:

of Seal Beach, be authorized to convey title to said
rails, track fastenings and other metallic track
material to Metals Reserve Company by a bill of sale,
the form of which shall be approved by Dana R.
Williams, City Attorney.
2. That Work Projects Administration be and
is hereby given permission to remove said rails,
track fastenings and other metallic trac~ material
located in the streets of the City of Seal Beach, the
location of which has been established by Work Pro- I
jects Administration in said letter and specification ,
and for that purpose to distur.b the pavement in the
streets where said rails are located, upon the follow
ing terms and conditions:
(a) Prior to commencement of removal of rail' ,
title to the same shall be vested in the Metals Re-

l7 serve Company;
l8 (b) All work shall be done in a workmanlike
19 manner and in strict accordance with said letter and
20 specifications;
2l (e) Rails shall be removed so that traffic
22 shall be disturbed as little as possible;
28 (d) No rails shall be removed unless and
24 until said Work Projects Administration is in a
25 position to proceed immediately with the restoration
26 of pavement. I

1 claimed by the City of Seal Beach, providing the
2 WPA performs the work in accordance with the specifi-
3 cations hereto attached, all said streets to be re-
4 paired and placed in good condition as may be require
5 by the Street Superintendent of the City of Seal Beac .
6 5. The Metals Reserve Company, and/or WPA
7 shall be responsible for all damages on account or
8 injuries occuring to any of its employees during the
9 prosecution Of the work, and shall defend at its
lO sole expense all damage suits which may arise in con-
1l sequence of such injuries.
12 6. The City of Seal Beach shall not in any
l3 manner be answerable or accountable for any loss or
l4 damage arising from negligence or carelessness of the
l5 Works Projects Administration and/or Metals Reserve
l6 Company to any person or persons and their property.

foregoing Resolution was introduced and adopted at a
regular meeting of the City Council of the City of
Seal Beach held on the 6th day of August, 1942, by
