I 1 1 , ~ .. --... ~,., RESOLUTION NO.~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH CALIFORl~IA, DECLARING NOXIOUS AND DANGEROUS ~1EEDS GRO~ING UPON THE STREETS AND SIDE- WALKS OR UPON PRIVATE PROPERTY WITHIN SAID CITY TO , BE A PUBLIC NUISANCE, CREATING A LIEN UPON THE PROPERTY FRONTING UPON SAID STR~ETS OR SIDEWALKS OR UPON WHICH SAID NUISANCE EXISTS FOR THE COST OF ABATEMENT OF THE SAME. Whereas there are growing upon the streets or sidewalks or upon private property within the ~ity of Seal Beach, California, weeds which bear seeds of windy or downy nature, or attain such large growth as to become a fire menace when dry or which are otherwise noxious or dangerous upon the streets or sidewalks in front of, or upon the property hereinafter described, which the City Council of the City of Seal Beach de hereby declare to be a public nuisance; and RES 0 L V E D, THE REF 0 R E, that the City Council of the City of Seal Beach, California, does hereby resolve as follows: Section 1. That the City Council of said City does hereby declare all weeds growing upon the streets or sidewalks in front of, or upon, the private property on the fol10wing streets within said City of Seal Beach to be a public nuisance. That the Street Superintendent of the City of Seal Beach shall cause to be conspicuously posted in front of the property on which or in front of which such nuisance exists, at not more than one hundred feet (100') in distance apart, but np less than three in all, notices headed "Notice to Destroy Weeds", such heading to be in words not less than one inch (1") in height and substantial- / ly in the form required by law. Section J. That the proceedings herein provided for shall be had and taken under and in accord With an Act of the Legislature of the State of California entitled "Act ,197-Deering-Municipal Weed Abatement Law," an Act aut1'!orizing municipalities to declare noxious or dangerous weeds growing upon the streets or sidewalks, or upon private property within municipalitiea, to be a pUblic nuisance, creating a lien upon the property fronting upon such streets or side- walks or upon which such nuisance exists for the cost of abating the same. That after final action has been taken by the legislative body (City Council) on the disposition of any protests or objections, or in case no protests or objections have been received, the City Council by motion or resolution, will order the Street Superintendent to abate said nuisance by having the weeds referred to removed, and he and his assistants or deputies will be expressly authorized to enter upon private property for such purpose. Any property owner shall have the right to have such weeds removed at his own expense providing the same is done prior to the arrival of the Street Superintendent or his representatives to do the same. The Street Superintendent shal1 keep an account of the cost of abating such nuisance, and shall render an itemized report in writing to the City Council showing the cost of removal of such weeds on each separate 10t, or in front thereOf, or both, which amount or amounts shall be added to the respective assessments for taxes against the respective lots or parcels of land for municipal purposes and collected at the same time and in the same manner as ordinary municipal taxes are col- lected and shall be subject to the same penalties and the same pro- cedure Under foreclosure and sale in case of delinquency as provided for ordinary municipal taxes. Section i. That the City Clerk shall certify to the adop- tion of this resolution by the C~ty Council and it shall thereupon ta~e effect. Adopted, signed and approved this ~ day of ~~ 1946. .,.."C< .
