I OR1GINA OFICIAL COpy NOT TO E Tt.;(1:N F~OM THii C:'T''l C:_-=~.;~'S OFFICE LUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, APPROVING AND ADOPTING PROPOSED LAW ENFORCEMENT MUTUAL AID PLAN AND AUTHORIZING PARTICIPATION IN THE BY ITS OFFICERS AND EMPLOYEES, RESOLUTION NO 600 I WHEREAS, there has been submitted to this Council a proposed plan for receiving and dispatching law enforcement mutual aid be- tween and among the various political subdivisions and municipal corporations of this State in times of emengency, as defined in the plan; and WHEREAS, it is deemed in the interest of an~ for the protection of the citizens of this community and their properties that such a plan be adopted and approved; NOW, THEREFORE, BE IT RESOLVED, that certain plan desiginated 1 , IISTATE of CALIFORNIA LAW ENFORCEMENT MUTUAL MiD PLANII, a copy of which is attached hereto and hereby made a part hereof, as though set forth in full, be and the same is hereby approved and adopted, BE IT FURTHER RESOLVED; That the Chief of Police Depa,rtment be and he is hereby authorised and empowered to order the performance of such law enforcement mutual aid services, including the use of personnel and fac11ities, as may be requested and he may deem avail, able without unnecessarily depleting the City'S agencies, outside the territorial limits of this jurisdiction in accordance r.ith and pursuant to 4aid Law Enforcement MUTUAL AID PLAN, and subject to all provisions of law govenning such extra-territorial service, _ . Resolution Number LA1V ENFORCEMEi~T MUTUAL AID PLAN ----- SECTION ONE - - - - - - PUR P 0 S E - ------ The purpose of this plan is to coordinate the dispatch and use of law enforcement personnel and equipment 11I'henever, because of enemy action, disaster, civil disturbance, or other cause, any local 1a\7 enforcement agency requires the dispatch to it of law enforcement assistance from any other jurisdiction. SECTION TWO - - - - - - D E FIN I T ION S - - 1 a. "State Law Enforcement Coordinator" as used herein means the person appointed qy the Governor in accordance with the provisions of Subdivision b of Section 1532 of the California "Tar Powers Act. b. "Regional Law Enforcement Coordinator" as used herein means the person selected in any region of t~e state by the county leu enforcement coordinators of such region to act in such capacity. c. "County Law Enforcement Coordinator" as used herein means the person selected in any county by the chiefs of the police departments, the sheriff and the head!! of the other law en- forcement agencies within such cOlmty to act in such capacity. d. "Region" as used herein means those areas designated by the Governor as "protective regions" in accordance with the authority contained in the California War Powers Act. e. "Coordinating Centers" as used herein means those loca- tions uhere law enforcement coordinators receive and trans- mit information and requests for aid. I f. "Emergency" as used herein means the, existence, or tJu'eat- cned existence, of conditions, resulting from enemw action, d:\:saster, civil distrubance, or other cause, of such magnitude that a local 1a~ enforcement agency requires tre dispatch to it of 1au enforcement assistance from any other jurisdiction in 0rder to effectively combat the same. SECTION THREE - - - - -!...l...1! MUTUAL AID 1 a. Whenever an emergency as herein defined exists, the Chief of Police or Sheriff in vlhose jurisdiction the emergency occurs, shall be, and continue to be, in co~~d in connection ':lith all matters pertaining to law enforcement. He may request such 1avI eni'orcement mutual aid as is req.uired from other juris- djctionc and agencies uithin the county (~~ or throURh the Q2ordinator) provided, ho.7Elver, that \Then the cause of the emer- gency is of such a nature that more than one jurisdiction is en- dangered, then such request shall be made in the first inst~e to the County La\7 Enforcement Coordinator. If such sufficient laVl enforcel"snt mutual aid is not ir.unediate1y available in the county in \/hich the omergency exists, the Chief of Police or Sheriff, as the case may be, shall request such additional aid as is required from the County La':l Enforcer.tent Coordinator .7ho shall trnnsrnit such request to the Regional Lai7 Enforcement Coordinator. Whenever any Chief of Police or Sheriff requests rautua1 aid directly from any other law enforc"lment 'lgency I/ithin his county, he shall immediately inform the CO"ntl' Law Enforce- ment Coordinator of such request and shall the)'l'a:"ter keep him fully advised as to all developments in connectjon ~ith the eroer- p,ency. 1 c. ihenever any County Lan Enforcelnent Coordinator receives any reCJ.uest for mutual aid or any information concerning the existence of an emergency within his county he shall immedi- ately advise the Regional LavI Enfol'cement Coordinator of such request find furnish such information to him. , - 2 - I' , c , Resolution ~umber d. 'Thenever any Regional Law Enforcement Coordinator receives any request for mutual aid or is informed of the existence of any emergency t1ith:l1l his region he shall immediately advise the Stute Law Enforcement Coordinator of such request and furnish such 'infot'lllB.tlon to him. e. ~henever any law enforcement department or agency receives any direct request for mutual aid or dispatches any mutual uid, the head of such department or agency shall immediately noti- fy his County Law Enforcement Coordinator of thc same. r. ,7henever~' County Law Enforcement Coordinator is unable to communicate a request for mutual aid to his Regional Law Enforcement Coordinator, he may make such request to any County Law Enforcement Coordinator vlithin the region and shall thereafter, as soon as possible, inform the Regional LaIV Enforcement CoordimL- tor of the action taken. In each county there shall be a County La" Enfo::'cement Co- ordinator, uho shall be appointed by a majority vote of the heads of the law enforcement departments and agencies within the county immediately upon this plan becoming effective, who shall be an experienced 1ar. onforcement Officer, and t1ho shall serve at the pleasure of the ap!lcintlng authority. b. In each region there shall be a Regional Law Enforcement Coordinator, "Tho sr.all be appointed immediately upon this pLun becoming effective by a majority vote of the County Law En- forcement Coordinators within the region, who shall be an exper- ienced law ell.forcement officer and Vlho shall hold such position at the pleasure of the appointing authority. In each county there shall be established a Coordinating Center t1hich shall have on a twenty-four hour basis, t"o- vm::r shortvlave radio facilities, if the same are available vlithin tho 'county, as ,'ell as adequate telephone communications. The County Lau Enforcement Coordinator shall arrange to man such Co- ordinating Center continuously on a tuenty-.four hour basis either personally or by his duly authorized representative. b. In each region there shall be established a Coordinating Center rrhich shall have on a trrenty-four hour basis, tuo- I'laY shortuave radio facilities, if the same are available 11ithin the region, as vlell as adequate telephone communIcations. Regional Law Enforcement Coordinator shall arrange to man such Coord~Bting Center continuously on a t~enty-four hour basis either personally or by his duly authorized representative. SECTION, SEVEN - - - - - Q:..Q M M U N I CAT ION S Request for mutual aid shall be transmitted by either radio, tele- phone, teletype or messenger, whichever means may be available and most expeditious, but shall not be broadcast indiscriminately by means of commercial or amateur radio broadcasts, ~CTION EIGHT - - - - - ADDITIONAL DUTIES OF COORDINATORS a. Each County Law Enforcement Coordinator shall compile and keep llurrent a 11s'c of special lau enforcement equipment and specially trained personnel and the number of men in his de- partment I'rithin his county. He shall reta:ln this list at tho Co- ordinating Center and shall transmit three copies thereof to his Regional Leu Enforcement Coordinator. b. Each Regional Law Enforcement Coordinator shall compile and keep current a list of all special law enforcement equipment and specially trained personnel and the number of men in his department V1ith:ln his region, che original of I"lhich shall be retained at the Regional Coordinating Center, tllO copies of uhich he shall transmit to the State Lau Enforcement Coordinator. c. The State Lau Enforcement Coordinator shall compile a com- plete list of special 1au enforcSDent equipment and spec- ially trained personnel and the number of men in his department ";rithin the state, the original of l1hich he shall retain, and copics of ~rhich he shall furnish to each of the Regiollll1 Lavr Enforcement Coordinators. d. Each coordinator shall inform himself as to the assis- tance which can be rendered ~ithin his area by the state Guard and shall make arranger.lents for the utilization of the same \1hen required. Each coordinator shall inform himself as to the assistance ~hich may be obtained from tpo United States Armed Forces uithin his area, as to the circumstances under uhich it ui11 bc availab1c, shall make such arrangements as are necessary uith the appropriate authorities for its utilization, and shall keep his immediate superior coordinator !ul1y advised as to any and all such arrangements which have been made. . c. Each coordinator uithin his area shall ascertain thc as- sistance ryhich may be obtained from state agencies and make, in r;riting, the necessary arrangements for the utilization of the same rrhen required. - 4 - I' , Resolution 'Number ~ . f. rlhenever any Constable has any information regarding any emergency, he shall report the same to the Sheriff of his COlmty. SECTION NINE - - - - - - E F F E C T I V E D ATE ~ This plan shall become effective as to each city yrhen it is ap- proved by the legislative body of the same, as to the City and Coun~y of San Francisco when approved by its Board of Supervisors, as to the unincorporated area of each county when approved by the Board of Supervisors of such county, and as to state law enfo~ce- ment agencies when approved by the California State ~ar Council. In so far as this plan is operative by agreement between the cities, city and county and counties of this state, the benefits of this plan shall be available only to such cities, city and county and counties as approve the same. Each city, city and county and county approving the same shall continue to be a par- ty to this plan until'it nithdra\1s frOI'l the plan by giving thirty days notice in writing of its e1eotion so to do to its oounty 00- ordinator and to the Governor, and the withdra\7a1 of any one or more parties, either by the giving of notioe aa herein provided or the operation of 1au, shall not affect the oontinuance of the plan as to the other parties thoreto. EXCERPTS QUOTED FROM ACT 2323 DEERING'S G~LAWS 1944 , "In the event of National or local emergency created by military attack or sabotage or in the providing for adequate National or local defense, or upon the occasion of a great pub- lic calamity such as extraordinary fire, flood, storm, epide~c, earthquake, or other disaster, allY services performed, or expen- dit\Ires made in connection therewith, by any public agency with res~ect thereto, whether within or \7ithout the territorial limits of such agency, shall be deemed conclusively to be for the direct protection and be::!efit of the inhabitants and prop- erty of such agency. :Yhen such services are to be performed outside the territorial limits of the public agency so perform- ing them, such services shall be ordered by the chief adminis- trative officer in charge of the office or the department of such agency performing such services unless otherwise provided by the governing body of such agency."
